HomeMy WebLinkAbout20032780.tiff 411RESOLUTION RE: ACTON OF THE BOARD CONCERNING REQUEST FOR EXTENSION OF TIME FOR CERTIFICATE OF COMPLIANCE FOR A MOBILE HOME PERMITTED AS A TEMPORARY ACCESSORY TO THE FARM - JACKIE BRUCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Department of Planning Services staff, on March 23, 1999, did issue Certificate of Compliance #CSC-99-0036 for a Mobile Home permitted as a Temporary Accessory to the Farm, to Jean Brown, 15487 Weld County Road 46, LaSalle, Colorado 80645, and WHEREAS, said mobile home is located in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: E1/2 SW1/4 of Section 10, Township 4 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, said Certificate of Compliance has been periodically renewed on an annual basis by Department of Planning Services staff, and WHEREAS, on July 18, 2003, Department of Planning Services staff reviewed the request of the current property owner, Jackie Bruce, 2010 46th Avenue, Unit#3, Greeley, Colorado 80634, for renewal of said Certificate of Compliance and determined that justification no longer exists to establish the accessory to the farm for said mobile home, and WHEREAS, on October 6, 2003, and pursuant to Section 23-4-170 of the Weld County Code, the request for renewal of said Certificate of Compliance has been presented to the Board of County Commissioners, and WHEREAS, the applicant failed to appear at said hearing, therefore, this matter was continued to October 13, 2003, to allow the applicant to be present to discuss her request with the Board of County Commissioners, and WHEREAS, pursuant to Section 23-4-170 of the Weld County Code, the request of Jackie Bruce for renewal of said Certificate of Compliance was continued to the 13th day of October, 2003, at which time and having heard all of the testimony, finds that the Temporary Accessory to the Farm is no longer justified, therefore, the request should be denied. The legal description is described as the E2 SW4 of Section 10, T4N, R66W of the 6th P.M., Weld County, Colorado. The property owner is Jean Brown, who has since passed away, leaving the property to his daughter Jackie Bruce. The sign for his hearing was posted on September 26, 2003. The Department of Planning Services staff met on July 181h, 2003, to discuss the renewal for a mobile home being used as a Temporary Accessory to the Farm. Staff has denied this request as there was not enough justification for an additional home to continue as an accessory to the farm. There is currently a house and the mobile home on the parcel. The occupant of the mobile home provides maintenance for the property, and is employed with King Soopers 40 hours a week,which does not justify the need for full time help. There are no animal units on the property, and corn and beets are the only crops listed, which is also unclear as to who maintains these crops. Should the Board approve for the use to continue, the Department of Planning Services is requesting that a Zoning Permit for a Mobile Home for an accessory to the farm application be applied for, as the Certificate of Compliance is an application that is no longer used by the Department. Staff would also recommend that an inspector from the Building Department inspect the current condition of the mobile home as the stairs leading to the home appeared to be dangerous.
