RE: ACTON OF THE BOARD CONCERNING REQUEST FOR EXTENSION OF TIME
FOR CERTIFICATE OF COMPLIANCE FOR A MOBILE HOME PERMITTED AS A
TEMPORARY ACCESSORY TO THE FARM - JACKIE BRUCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Department of Planning Services staff, on March 23, 1999, did issue
Certificate of Compliance #CSC-99-0036 for a Mobile Home permitted as a Temporary
Accessory to the Farm, to Jean Brown, 15487 Weld County Road 46, LaSalle, Colorado 80645,
and
WHEREAS, said mobile home is located in an A (Agricultural) Zone District on a parcel
of land being more particularly described as follows:
E1/2 SW1/4 of Section 10, Township 4 North,
Range 66 West of the 6th P.M., Weld County,
Colorado
WHEREAS, said Certificate of Compliance has been periodically renewed on an annual
basis by Department of Planning Services staff, and
WHEREAS, on July 18, 2003, Department of Planning Services staff reviewed the
request of the current property owner, Jackie Bruce, 2010 46th Avenue, Unit#3, Greeley,
Colorado 80634, for renewal of said Certificate of Compliance and determined that justification
no longer exists to establish the accessory to the farm for said mobile home, and
WHEREAS, on October 6, 2003, and pursuant to Section 23-4-170 of the Weld County
Code, the request for renewal of said Certificate of Compliance has been presented to the Board
of County Commissioners, and
WHEREAS, the applicant failed to appear at said hearing, therefore, this matter was
continued to October 13, 2003, to allow the applicant to be present to discuss her request with
the Board of County Commissioners, and
WHEREAS, pursuant to Section 23-4-170 of the Weld County Code, the request of
Jackie Bruce for renewal of said Certificate of Compliance was continued to the 13th day of
October, 2003, at which time and having heard all of the testimony, finds that the Temporary
Accessory to the Farm is no longer justified, therefore, the request should be denied.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Jackie Bruce for renewal of Certificate of
Compliance #CSC-99-0036 for a Mobile Home permitted as a Temporary Accessory to the
Farm be, and hereby is, denied.

This is case COC-99-0036-a renewal for a Certificate of Compliance for a mobile home permitted
as a Temporary Accessory to the Farm. The legal description is described as the E2 SW4 of
Section 10, T4N, R66W of the 6th P.M., Weld County, Colorado.
The property owner is Jean Brown, who has since passed away, leaving the property to his
daughter Jackie Bruce.
The sign for his hearing was posted on September 26, 2003.
The Department of Planning Services staff met on July 181h, 2003, to discuss the renewal for a
mobile home being used as a Temporary Accessory to the Farm. Staff has denied this request
as there was not enough justification for an additional home to continue as an accessory to the
farm.
There is currently a house and the mobile home on the parcel. The occupant of the mobile home
provides maintenance for the property, and is employed with King Soopers 40 hours a week,which
does not justify the need for full time help. There are no animal units on the property, and corn and
beets are the only crops listed, which is also unclear as to who maintains these crops.
Should the Board approve for the use to continue, the Department of Planning Services is
requesting that a Zoning Permit for a Mobile Home for an accessory to the farm application be
applied for, as the Certificate of Compliance is an application that is no longer used by the
Department. Staff would also recommend that an inspector from the Building Department inspect
the current condition of the mobile home as the stairs leading to the home appeared to be
dangerous.

I called Jackie Bruce, 2010 46`h Avenue Unit 3, Greeley, CO 80634. I spoke with her husband
and /or son and left a message with him asking which option she was choosing to pursue,
either the Recorded Exemption or did she wish to appear before the BOCC on her appeal for
the annual review for the mobile home use for a temporary accessory to the farm. According to
whom I spoke, Mrs. Bruce will not be available for a few days, but I was assured that she would
get back to me with her decision.

The Department of Planning Staff met on Friday, July 18, 2003, and discussed the information you provided on July
8, 2003 regarding the mobile home being used as an accessory to the farm. Although we understand the
circumstances, unfortunately there is no longer enough justification to establish the accessory mobile home.
At this time the mobile home will need to be removed from the property, or you do have the option to go before the
Board of County Commissioners who would have the final determination or contact our office for other possible
alternatives.
If you wish to schedule a hearing,please notify me as soon as possible to do this,otherwise the mobile home will need
to be removed within 30 days, unless other arrangements are made through our office. Should have any questions,

NOTICE
The applicant, agents and employees shall comply with all the rules, restrictions and requirements of Weld County Zoning and
Building Code Ordinances governing location, construction, demolition and erection of the above proposed work for which this permit
is granted. The Building Official is authorized to order the immediate cessation of work at any time a violation of the adopted
codes appears to have occurred. Violations of any codes or regulations may result in the revocation of this permit.
Buildings must conform with the plans as submitted to the Building Inspection Department. Any changes to the plans or lay-out must
be approved prior to construction. Any changes in the use or occupancy of the building must be approved.
It shall be the duty of the property owner or the person doing the work authorized by this permit to notify the Weld County Building
Inspection Department that such work is ready for inspection.
This permit shall expire by limitation and become null and void if the building or work authorized by this permit is not commenced
within 180 days from the date this permit is issued, or if the building or work authorized by this permit is suspended or abandoned
at any time after the work is commenced for a period of 180 days. Before such work can recommence a new permit shall be required
and the charge shall be 1/2 the fee under the current Weld County Building Inspection Fee Schedule provided that such suspension

problems with getting a referral response from the Health Department. Hope that this did not
cause you any problems.
Brown will need to substantiate her need for the continued use of the mobile home as an
accessory to the farm use. Since Ohe has an existing Zoning Permit for a Mobile Home on file
we ask that $he fill out the application for a Certificate Of Compliance (C.O.C.) to substantiate
the accessory use. She does not, however, need to pay the $50.00 dollar application fee.
