Colfax, #138 Aurora, CO80018 Dear Mr. and Mrs. Eastman: This letter is addressed to you as a purchaser of a parcel in the unincorporated townsite of Dearfield, Weld County, Colorado. You purchased this parcel, unplatted Block 48, from Dearfield Homes, LCC on or before July 12, 2002 along with a manufactured home to go on this lot prior to the County's decision to hold building permits because of unresolved issues regarding construction and maintenance of the roads in the townsite. You understand that the County will not bear the cost of upgrading the townsite roads and that the developers' representative, Mr. David Drake, has been asked to bring the roads currently up to County gravel road standards. The County has also requested some engineering analysis of the drainage to be preformed by the developer and that there be provision for paving at the expense of the landowners in the future if traffic warrants such improvements. Drake and the County have had extensive negotiations on these issues and these discussions are continuing but there is no agreement finalized with the developer at this time to guarantee improvement to the,roads. In addition, the developer has prepared covenants which address paving as well as certain design standards. I understand you still wish to proceed to obtain building permits with the understanding that you are not assured construction and maintenance of roads to access your lot in Dearfield and that there may be drainage issues which have not been studied which could affect your lot. I also understand that you agree, in concept, to be bound by the covenants prepared by the developer subject to your review of the specific terms of the covenants even though you already own your lot. You are also agreeing to contribute a proportionate share of the costs of further upgrading the roads to a paved road if traffic warrants in the future. This would take into account the number of lots using the paved roadway and the distance traveled on such roadways. You also understand that the County is making this representation to you based upon the unique circumstances of your situation but that this is not intended to be a general change of position by Weld County. �LR�Lsi� 1z ; Ve 43 2003-0642 Eastman, Letter February 27, 2003 Page 2.
