BERNHARDT ANNEXATION
STATEMENT ON COMMUNITY NEED
The Bernhardt property is contiguous to the Town of Milliken along portions of the south
boundary and surrounds the Town's wastewater treatment plant on the north, east, and west
sides. This property is a logical extension of the Town. The Comprehensive Land Use Concept
Plan included in the Comprehensive Plan shows Town Residential and Open Space designations
for the property.
The Bemhardts and Hall-Irwin are proposing to mine this site for sand and gravel and then
reclaim the site as: lined reservoirs, ponds, wetlands, open space, limited residential
development, and limited light industrial development. The reclaimed site will add
approximately 256.5 acres (including water surface) of open space to the Town along the Big
Thompson River corridor through this property. This concept is consistent with the
Comprehensive Plan and the Johnstown/Milliken Parks, Trails, Recreation, and Open Space
Master Plan. The residential development will bring diversity to the housing stock with its
proximity to the open space corridor that will be created. The light industrial development is not
consistent with the Comprehensive Land Use Concept Plan. However, it fits with the character
of Frontier Commercial Center and Milliken Corporate Center to the south. The residential and
light industrial development will expand the property and sales tax base in Town.

I. Project Description
The proposed Bernhardt Annexation, Zoning, and Concept Plan are shown on the attached maps. The
area to be annexed in The Bernhardt Annexation includes 295.075 acres of land currently zoned A-
Agriculture in Weld County. The subject property is bounded: to the south by Weld County Road 48;
to the west by Weld County Road 23; and to the east by Weld County Road 25. In conjunction with
the annexation, the zoning is proposed to change from Weld County A-Agriculture to Town of Milliken
PUD.

IV. School District Impact
The Bernhardt Annexation application has been referred to the Weld County School District RE-5J for
their review. However, based on the land uses shown on the Concept Plan, the total number of
residential units proposed is approximately 75. Based on the calculation shown below, the
approximate impact will be 49 additional students. We will continue to work with the School District to
address potential impacts from this annexation.

Section One: Project Intent and Vision
A.Type of Development:
Hall-Irwin proposes to mine this site for sand and gravel. A separate Use by Special Review
application will be submitted to the Town at a later date. Reclamation of the site, shown on the
concept plan, includes: lined water storage, unlined ponds, enhancement of the Big Thompson
River corridor, open space, low-density residential development and light industrial development.
B. Goals for this Project:
The goals for the Bernhardt Annexation are Big Thompson River corridor enhancement, light
industrial development, low-density residential development, and lined water storage. This
development is consistent with Milliken's mission statement"To promote prosperity while retaining
our rural character and high quality of life for the citizens of Milliken."
C.The Character of the Project:
The Bernhardt Concept Plan is designed around the Big Thompson River corridor and the bluffs to
the north of the river. The majority of the site will function as open space including lined water
storage. The southern edge of the property will be developed as low-density residential and light
industrial.
D. Reasons for Developing in Milliken:
The Bernhardt family has lived in the area for several generations. They are vested as both
stewards of the land and in Milliken's well being. This property is very special because one mile of
the Big Thompson River corridor flows through it. The Milliken Comprehensive Plan emphasizes
the importance of conserving sensitive areas and enhancing the river corridor to provide recreational
opportunities. It also discusses diversifying the housing stock and providing economic
opportunities. The Bemhardts feel this project gives them the opportunity to Milliken's high quality
of life and economy.
E. What this Development will bring to Milliken:
• Protection/Enhancement of the Big Thompson River corridor
This is an important goal in the Comprehensive Plan and the Johnstown/Milliken Parks, Trails,
Recreation, and Open Space Master Plan. We are working with the U.S. Fish and Wildlife
Service to develop a Preble's Meadow Jumping Mouse Habitat Conservation Plan as part of
this project.
• Water Storage
Portions of the reclaimed gravel ponds will provide water storage reservoirs. With the recent
drought, everyone is aware of the importance in broadening the Town's water supply system.
The Town of Milliken could use their water storage shares for augmentation water including
reusable municipal return flows, excess consumptive use credits, and stream flows during run-
off periods. The Bernhardts will retain the surface rights associated with the ponds created.

• Open Space
256.5 acres of the property will be devoted to the Big Thompson River corridor open space.
This includes the reclaimed gravel ponds. It accounts for 87% of the total project area. The

trail is planned through the open space corridor. Habitat will be enhanced and expanded
through the development proposed.
• Expansion of Light Industrial development
The light industrial development proposed with this application will strengthen the light
industrial center that has developed with Frontier Commercial Center and Milliken Corporate
Center. The light industrial development will expand the employment base in Milliken and the
sales tax base.
• Diversification of the housing supply
The residential development proposed is unique because of its proximity to the Big Thompson
River open space corridor that will be created.
• Provision for close and ready supply of aggregate, concrete, and asphalt products
Developing this site as a sand and gravel mine will allow Hall-Irwin to reduce the number of
regional truck trips coming into town and reduce the cost of development in Milliken with a
close supply of aggregate, concrete, and asphalt products.
F. The Impacts the Bernhardt Annexation will have on Milliken:
A maximum of 75 single-family residential units will be built, if all of the single-family residential
areas are developed with a density of 5.0 dwelling units per acre. They will require approximately
33,000 gallons of potable water per day (440 g.p.d. per single family tap). This figure does not
account for irrigation of common open space. The developer will incur the costs for the
improvements necessary to serve this development. The Milliken Fire Protection District will
provide fire protection. Further information regarding the development impacts will be given with
future subdivision and site plan applications.
G.How the Bernhardt Annexation is consistent with the 1998 Comprehensive Plan and how it is
not:
Section 2.4.1 of Milliken's Comprehensive Plan (Parks, Recreation, and Open Space) lists several
policy recommendations including:
• "Recognize that parts of the community are extremely sensitive and unsuitable to be
developed, thus should be included within a community open space framework;" and
• "Develop a community trail system that services the local needs and links to regional trail
systems."
This project addresses both of these policy recommendations with the 256.5 acres of open space that
will be created and the trail connection planned through the open space corridor. Goal #2 under
Parks, Recreation and Open Space states, "Support the recreational use of local and regional open
space and trail networks for the Town's residents and visitors." This project seeks to find a balance
between accessibility to the Big Thompson riparian corridor for residents of the community and
surrounding areas and the preservation of wildlife diversity.

The Transportation section of the Milliken Comprehensive Plan (Section 2.4.4) listed several goals.
Goal #1 was to provide for the safe and efficient movement of vehicles and pedestrians throughout
the community. This goal will be met with a trail connection through the open space and clustered
development.
The Natural Environment and History section of the Milliken Comprehensive Plan (Section 3.7)
listed two goals. Goal #1 is to preserve and protect valued natural features and resources, and their
natural function. Goal #2 is to provide opportunities for the Town's residents to easily access and
experience the natural environment for their health and enjoyment. The Big Thompson riparian
corridor and the bluffs to the north will be preserved. The trail connection that is planned will
provide an opportunity for Milliken's residents to easily access and experience the natural
environment.
H. Has the design process in Chapter 3 of the 1998 Comprehensive plan been used?
Several principles that are listed under the neighborhood design principles are incorporated into the
site plan. This project demonstrates: ecological responsibility, open spaces, mixed use and
maintenance. The site design is in harmony with the Big Thompson riparian corridor. A mixture of
land uses are incorporated in the Concept Plan and occur in clusters so that the Big Thompson River
open space corridor is the dominant feature of the project. Maintenance will be minimal. Native
plantings will be incorporated in the open space corridor. Other landscaped areas will use xeriscape
principles. Raw water will be used for any irrigation required for common open space.
Section Two: Community Enhancement
A. One of the most important aspects of Milliken is its small town, rural character. How does the
Bernhardt Annexation fit in with Milliken's Character?
1. Product Type, design, and diversity of units
The product type, design, and diversity of units will be addressed with covenants that will be
drafted and included in future development applications.
2. Project Design and Layout
The concept plan shows the general design and layout of the site. Future development
applications will address specific design and lot layout.
3. Special Features of the Project
The Bernhardt Concept Plan is designed around the Big Thompson riparian corridor. The bluffs
north of the Big Thompson River will be preserved from future development. This is consistent
with the Opportunities and Constraints map adopted from the draft Johnstown/Milliken Parks,
Trails, Recreation, and Open Space Master Plan. The corridor will be enhanced through the
sand and gravel mining and reclamation activities planned for the site. Reclamation of the site
will include water storage reservoirs and a trail connection through the open space.
4. Magnitude and Scale of the project in relation to the Town
The Bernhardt annexation is 295.075 acres in size. This is approximately 50 acres smaller than
Settlers Village (346.128 acres). The project includes: 15.0 acres for low-density residential
(may include up to 75 dwelling units with a density of 5.0 dwelling units per acre); 16.9 acres

for light industrial development; 6.7 acres for right-of-way; and 256.5 acres of open space.
5. Consistency with the Neighborhood Planning Criteria

The future residential and light industrial development will comply with Milliken's architectural
guidelines. Future development applications will address this issue more specifically.
B. In what ways will the Bernhardt Annexation add diversity to the housing supply in the Town
of Milliken?
The proposed residential development will add diversity to the housing supply with its unique
location adjacent to 256.5 acres of open space along the Big Thompson riparian corridor.
In what ways does The Bernhardt Annexation support the Neighborhood/Village concept
deemed important to retain local character?
The residential and light industrial development occurs in clusters so that the open space corridor
and trail connection through it are the predominant feature. This is consistent with the principles of
the Comprehensive Plan and the Johnstown/Milliken Parks, Trails, Recreation, and Open Space
Master Plan.
C. Explain how your project will benefit the Town of Milliken's economic base.
This development will serve to expand Milliken's residential property tax base. The increased
number of residents will increase the demand for goods and services, increasing sales for local
commercial developments. The light industrial development will increase the sales tax base. In
addition the light industrial development will add employment opportunities to the local economy.
The light industrial development will complement and strengthen the commercial/light industrial
development occurring to the south(Milliken Corporate Center and Frontier Commercial Center).
D. How will the Bernhardt Annexation meet transportation requirements in Milliken?
1. How will your project tie into the transportation circulation system in Milliken?
The Bernhardt Annexation will tie into Milliken's transportation circulation system with the
main access points on WCR 48, WCR 23, WCR 23 3/4 and WCR 25. The visibility and
location of these access points will provide for the safe and efficient movement of vehicles and

pedestrians.
2. How will your project promote alternative modes of transportation?
Development will occur in compact nodes leaving the open space corridor as the dominant
feature. A trail connection is planned through the open space corridor.
E. How will parks, open space, and other recreational activities be incorporated into the
Bernhardt Annexation?
The Bernhardt Concept Plan is designed around the 256.5-acre open space corridor, which accounts
for 87% of the property to be annexed.
F. How will the Bernhardt Annexation protect the environmental quality of the Town of
Milliken?
1. Compliance with noise, air, and water quality standards
The gravel mining operations and future development will comply with applicable noise, air,
and water quality standards and will not provide undue strain upon the Town's resources.
2. Use of energy-efficient design
Energy-efficient architectural design will be encouraged in the residential and light industrial
development.
3. Use of water conservation techniques
Water conservation techniques will be incorporated in the Bernhardt Annexation development
with the use of xeriscape design principles into all landscape improvements.
4. Preservation of natural features and resources
This site is irrigated cultivated agricultural land. The Big Thompson River runs from west to
east through this property. This corridor will be enhanced and preserved from future
development. This is consistent with the Comprehensive Plan and Johnstown/Milliken Parks,
Trails, Recreation, and Open Space Master Plan.
5. Preservation of wildlife habitat
Enhancing the Big Thompson riparian corridor will diversify the existing wildlife habitat. The
existing ditch corridors will be maintained and enhanced to create habitat and a connection
through the property. Wildlife habitat will be created in and around the ponds, reservoirs, and
wetlands.
6. Subsidence
There is no known undermining in this area. Subsidence should not be an issue for this site.
7. Abandoned oil and gas wells
There are no known abandoned oil and gas wells on this site. A 150' radial setback is being
maintained from existing oil wells. A 200' radial setback is being maintained from existing
tanks.

according to the U.S. Department of Agriculture Soil Conservation Service is listed below:
• Aquolls and Aquents, gravelly substratum: "These soils have good potential as a source of
sand and gravel."
• Dacono clay loam: "This soil has only fair potential for urban and recreational use. Above
the sand and gravel substratum the soil has a moderate to high shrink-swell potential, low
strength, and moderately slow permeability. These features create problems in dwelling
and road construction. Excessive permeability in the substratum can cause contamination
of the ground water supply from septic tank leach fields. Sewage lagoons need to be lined."
• Kim loam "has good potential for urban and recreational development. ... The chief limiting
soil feature for urban development and road constriction is the limited capacity of this soil
to support a load. Septic tank absorption fields function properly,but community sewage
systems should be provided if the population density increases. Because of the
permeability of the substratum, sewage lagoons must be sealed."
• Nunn loam "has fair to poor potential for urban development. It has moderate to high shrink
swell, low strength, and moderately slow permeability. These features create problems in
dwelling and road construction. Those areas that have loam or sandy loam in the lower part
of the substratum are suitable for septic tank absorption fields and foundations. Some areas
are adjacent to streams are subject to occasional flooding. This soil has fair potential for
such recreational development as camp and picnic areas and playgrounds."
• Paoli loam "has good potential for urban and recreational development in areas protected
from flooding. The chief limiting feature is the rapid permeability in the substratum, which
causes a hazard of ground water contamination from sewage lagoons. Road designs should it
be modified to compensate for the moderate frost potential."
• Tassel fine sandy loam "has poor potential for urban development. The chief limiting
features is the shallow depth to sandstone."
• Ustic Torriorthents: "Potential is poor for urban and recreational development. The chief
limiting soil features are the loose, coarse textured soil, steep slopes, and rapid
permeability."
G.How will the Bernhardt Annexation enhance the cultural, historic, educational, and human
service opportunities in the Town of Milliken?
1. For property that the Comprehensive Plan Land Use and Public Facilities Map shows a school
site on, work with the School District to determine where to set aside land for a school.
Not applicable; no school site is shown for this property.
2. Property for parks, open space and trails as related to the Thompson Rivers Park and Recreation
District.
It is the intention to preserve the Big Thompson riparian corridor. Therefore, the trail
connection planned through the open space is not adjacent to the river. It will be located within
the corridor in cooperation with a wildlife biologist, the Colorado Division of Wildlife and the

U.S. Fish and Wildlife Service. It will be available to the residents of Milliken and the
surrounding area to enjoy.
3, Consider providing some kind of community gathering space or activity center for families
children, teens, seniors, or other special groups.
The trail through the open space and future ponds will serve as a community gathering space.
No other formalized gathering space is planned for this project because of the presence of
sensitive habitat along the Big Thompson riparian corridor that we are trying to preserve.
Section 3: Technical Criteria
A. Bernhardt Annexation Project Information
1. Where is Your project located in relation to the Planning Area Boundary?
The Bernhardt Annexation is the south one-half of Section 1, Township 4 North, Range 67
West. It is located north of WCR 48 between WCR 23 and WCR 25. Access to the site from
State Highway 60 is provided via WCR 233/4. This property surrounds the Town's wastewater
treatment plant on three sides. Frontier Commercial Center and Milliken Corporate Center are
located to the south.
2. How many feet is the perimeter of your property and how many of those feet are contiguous
with the existing Town of Milliken boundary?
The perimeter of the property is 19,969.44 feet of which 5,223.96 feet are contiguous to the
existing town limits.
3. What is the land use designation for your property? What land use are you requesting? How
does the land use you are requesting relate to the location criteria listed under Sections 2.3 and
2.4 of the Comprehensive Plan?
The land use designation for this property in the Comprehensive Plan is Open Space and Town
Residential. We are requesting this property be zoned PUD with this application. Generally,
the land use proposed for this application is consistent with the land use shown in the
Comprehensive Plan. The light industrial development is not consistent, however given the
nature of the development occurring to the south in Frontier Commercial Center and Milliken
Corporate Center it is compatible with surrounding land uses.
4. What is your property zoned? What are you requesting the property be zoned? Is your
proposed land use permitted in this zoning district? Please reference the page number in the
Zoning Code where you find this information.
The property is zoned A-Agriculture in Weld County. The proposed uses in the Bernhardt
Annexation are permitted in the PUD zone. The description for the PUD zoning district is
found on page 25 of the Zoning Code.
5. What is your anticipated development schedule for your property?
Mining is expected to begin as soon as the necessary permits are in place. Reclamation will
occur concurrently. Development will be phased as portions of the site are reclaimed.

This project will be privately funded.
R. The application materials that are required vary according in the typo of application.
Attached is a Town of Milliken Application Submittal Requirements Matrix that summarizes
the requirements for each type of application. Please submit a complete application package.
Submitting an incomplete application will delay the processing of your application.
C. The Town of Milliken's Zoning Code lists the land use requirements for each zoning district.
The requirements that you need to consider are the following:
1. Lot size, width, depth, shape, and orientation
2. Minimum building setbacks
3. Maximum building height
4. Minimum building square footage
5. Density
6. Off-street parking
Please refer to the Zoning Code to determine your property's zoning district requirements. List this
information in a table along with the land use standards that your plan is following. Please note
next to the table the Zoning Code you referred to.
This information will be provided with future development applications.
D. In your pre-application conference with the Town, you received a list of referral agencies that
will review technical portions of your application package. The following items will be
reviewed by these agencies if they are included in your application package:

E. Section 2.4.2 of the Milliken Comprehensive Plan, 1998 states that public improvements
should be installed to provide a high level of service efficiently and in a timely manner. This is
done in conjunction with utility providers. Please describe the utility and road improvements
necessary to serve your project.

Notice is hereby given of a public hearing to be held before the Milliken Town Board of Trustees
at 7:00p.m, Wednesday, January 22, 2003, at the Milliken Community Complex, Community

RESOLUTION NO. 02-26
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
MILLIKEN, WELD COUNTY, COLORADO THAT:
1. At the regular meeting of the Board of Trustees on 11`h, of December ,
2002, the Petition for Annexation of Bernhardt Annexation was submitted to
the Board of Trustees by the Clerk as a communication pursuant to Section
31-12-107(1)(t),C.R.S. The location of the property described in the petition
is set forth on Exhibit "A" attached hereto and incorporated herein by
reference.
2. The Board of Trustees has reviewed the petition and finds that the
requirements set forth in Section 31-12-107(1)(f), C.R.S. have been
substantially complied with.
3. Pursuant to Section 31-12-108(1), C.R.S., the Board of Trustees hereby
sets the date for the hearing on the annexation petition for January 22, 2003
at 7:00 P.M. in the Milliken Community Complex, Milliken Community
Room located at 1101 Broad Street , Milliken, Colorado. Notice of this
hearing is to be published in accordance with Section 31-12-108(2), C.R.S.
4. The purpose of this hearing shall be to determine whether the area
proposed to be annexed meets the applicable requirements of Sections 31-12-
104 and 31-12-105, C.R.S. and is eligible for annexation.
5. At this hearing if the Board of Trustees finds that the statutory
prerequisites for annexation have been met, the Board will hold a public
hearing on the ordinance annexing this property.
This resolution was passed by a vote of "'• in favor and 't opposed at the meeting of
the Board of Trustees on the 11th day of December, 2002.

CONTIGUITY:
The perimeter of the proposed annexation has a distance of 19,969.44 feet of which 5,223.96 feet are
contiguous to the existing Town limits of Milliken.
This contiguous distance results in a minimum of 1/6th of the perimeter of proposed annexation to the
Town of Milliken.
The proposed annexation contains approximately 295.075 acres.
We further allege:
1. It is desirable and necessary that the territory be annexed to the Town of Milliken.
2. A community of interest exists between the territory and the Town of Milliken.
3. The territory is integrated or capable of being integrated with the Town of Milliken.
4. The territory is urban or will be urbanized in the near future.
5. No land held in identical ownership is divided into separate parcels unless the owner of
said tract has consented in writing or joins in this Petition.
6. No land held in identical ownership compromises 20 acres and together with
improvements had an assessed valuation in excess of$200,000 in the year preceding
the filing of this Petition, unless the owner of said tract has consented in writing or joins
in this Petition.
7. No proceedings for annexation of the territory have been commenced for annexation to
another municipality.
8. The signers hereof comprise the landowners of more than 50% of the territory
proposed to be annexed exclusive of streets and alleys, and are in fact owners of 100%
of the hereinafter described property.

Therefore, the undersigned hereby request that the Town of Milliken approval the annexation of the
area described herein.
Attached to this petition are four copies of the annexation map containing:
a. A written legal description of the boundaries of the area proposed to be annexed.
b. A map showing the boundary of the area proposed to be annexed.
c. Within the annexation boundary map, a showing of the locations of each ownership
tract in unplatted land and, if part of all of the area is platted, the boundaries and the
plat numbers of plots or of lots and blocks.
d. Next to the boundary of the area proposed to be annexed, a drawing of the contiguous
boundary of the annexing municipality and the contiguous boundary of any other
municipality abutting the area proposed to be annexed.
Upon the Annexation Ordinance becoming effective, all lands within the area proposed to be annexed
will become subject to all ordinances, rules and regulations of the Town of Milliken, except for general
property taxes of the Town of Milliken which shall become effective as of the January 1 next ensuing.
