HomeMy WebLinkAbout20032586.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST DOROTHY ELIA FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Dorothy Elia, VI #0300098, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 14th day of October, 2003, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Dorothy Elia, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until January 13, 2004, to allow adequate time for the property owner to return the garage to it's original use and for her to move back into the house. RECOMMENDATION The Department of Planning Services recommends that this case be referred to the County Attorney's Office for legal action, but to delay any legal action for 90 days of which, if applicable, a PUD application shall be completed and submitted to the Department of Planning Services within the first 30 days. As I told Bethany, I would work with her and get rid of the things that were in violation. She was very nice in giving me some time. In regards to me living in my shop/office, I am real sorry but I was misled into believing that it was ok. I am asking you to please give me at least three months to move out of the building. I have a young man,James Grunniman and his Son living there now and they have been looking for a house to buy.
