RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST DOROTHY ELIA FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Dorothy Elia, VI #0300098, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of October, 2003, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Dorothy Elia, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until January 13, 2004, to allow adequate time for the property owner
to return the garage to it's original use and for her to move back into the house.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0300098 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Dorothy Elia to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until January 13, 2004, to allow
adequate time for the property owner to return the garage to it's original use and for her to
move back into the house.

Currently the property is in violation of Chapter 23, Article 111(3), Division 2 of Sections 23-3-110,
23-3-110.8, 23-3-1102.1, 23-3-110.C and 23-3-110.D and Chapter 29, Article 111(3) of Sections 29-3-10
and 29-3-320 of the Weld County Code.
REMEDY
To bring the property into compliance the Noncommercial Junkyard shall be removed. Additionally, it was
brought to our attention that Ms. D Elia and other individuals are residing in the garage. This is not an
allowed use per the R-1 (Residential)Zone District. The garage shall be returned to its original use or a
PUD (Planned Unit Development) application shall be completed and submitted to the Department of
Planning Services.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for legal action, but to delay any legal action for 90 days of which, if applicable, a PUD application
shall be completed and submitted to the Department of Planning Services within the first 30 days.

As we discussed,in the R-1 Zone District,such as your property is zoned,a"Noncommercial
Junkyard"consisting of derelict vehicles or automobile parts,such as auto hoods and tires,is
not an allowed use. I understand that you are in the process of obtaining license plates for
your son's truck. Please let me know once you have been able to obtain them. Additionally,
please inform me when the automobile hoods and tires have been screened. Thank you for
your prompt attention to this matter.

Additionally, it has been brought to my attention that you are going to move back into the
Principle Dwelling Unit (house) and abate the garage/shed as dwelling unit, but retain a
bathroom. This will require a letter of intent stating your intentions. A building permit for the
partial demolition of the kitchen and dwelling areas and an Electric Permit for any previous
installation and/or removal will also be required.
Lastly,any septic issues will need to be addressed with the Department of Public Health and
Environment.

I suppose by now you have received my letter dated August 7th, in response to yours
dated July 29th. I had stated that the vehicles had been cleaned up. However, I
haven't heard from you or seen you. I should get an inspection from you so you can
send me a letter stating that it is in fact cleaned up. I think that is what you told me
your were going to do. I hope you haven't forgotten me.
Please call me any time at 303.931.9709 and set it up.
Since I have taken care of the vehicles, why is there a meeting? Please let me know.
I am going to be out of town on the 9th through the 16th of September, my Mom in
California is not doing well and my Brother suggests I come see her. I hope you can
please reschedule me for after that if at all possible. I have one more trip October 1"
thru the 8th and that should be it for the year.

even if screened. Thank you for your prompt attention to this matter. It has also
been brought to our attention that someone might be living inside the garage/shed,
this would be considered a violation as well.
NONCOMMERCIAL JUNKYARD: An area where any waste,junk or used or
secondhand materials are stored or handled, including but not limited to scrap
iron and other metals, paper, rags, rubber tires, building materials and bottles. A
NONCOMMERCIAL JUNKYARD may also include the storage or keeping of
DERELICT VEHICLES registered last or currently registered under the property
owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district
allows, the NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a
BUILDING or STRUCTURE or visually SCREENED from all ADJACENT
properties and public rights-of-way.

DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own
power); is partially or totally dismantled; has all or portions of its body work
missing or is substantially damaged; is not registered with the State, as required
by Section 42-3-103, C.R.S., or by Section 42-3-138 or 42-12-102, C.R.S., and/or
the number plate assigned to it is not permanently attached to the vehicle, as
required by Section 42-3-123, C.R.S.; or is lacking proper equipment to the extent
that it would be unsafe or illegal to USE on public road rights-of-way or otherwise
not equipped with lamps and other equipment as required in Sections 42-4-202 to
42-2-227, C.R.S. This definition shall not include implements of husbandry,farm
tractors or vehicles customarily operated in a FARMING operation.
This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County
Centennial Center,915 10th Street, Greeley, Colorado. It is recommended that you or a representative
be in attendance to answer any questions the Board of County Commissioners might have about the
violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation,and that you were given sufficient time to remedy this violation. If you have any

Dear Mr. & Mrs. D Elia:
It has come to the attention of the Department of Planning Services'staff that the uses on your property may
not be in compliance with the Weld County Code, Chapter 23. The potential noncompliance with the Weld
County Code is the presence of a "Noncommercial Junkyard" consisting of derelict vehicles. Since your
property is zone Residential (R-1), a"Noncommercial Junkyard"is not an allowed use. Please be advised
that any vehicle parked outside of a completely enclosed structure shall have current license plates and be
in running condition.
DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power);or is partially or
totally dismantled; or has all or portions of its body work missing or is substantially damaged; or is not
registered with the State of Colorado,as required by Section 42-3-103,CRS,or by Sections 42-3-138 or42-
12-102,CRS,and/or the number plate assigned to it is not permanently attached to the vehicle,as required
by Section 42-3-123, CRS; or is lacking proper equipment to the extent that it would be unsafe or illegal to
USE on public road rights-of-way or otherwise not equipped with lamps and other equipment as required

JUNK: Scrap brass, iron, lead, tin, zinc; all other scrap metals and alloys; bones; rags; used cloth, rope,
rubber, tinfoil, botttes, old or used machinery of any type; used tools, used appliances; used lumber or
crates; building materials; fabrication of any material; used pipe or pipe fittings; used conduit or conduit
fittings; used automobile parts; DERELICT VEHICLES; used tires and other manufactured goods that are
so worn, deteriorated, or obsolete as to make them unusable in their existing condition.

Failure to close this violation or efforts to show progress, will result in a thirty-day violation notice being

DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own
power);is partially or totally dismantled; has all or portions of its body work
missing or is substantially damaged; is not registered with the State, as required
by Section 42-3-103, C.R.S., or by Section 42-3-138 or 42-12-102, C.R.S., and/or
the number plate assigned to it is not permanently attached to the vehicle, as
required by Section 42-3-123, C.R.S.; or is lacking proper equipment to the extent
that it would be unsafe or illegal to USE on public road rights-of-way or otherwise
not equipped with lamps and other equipment as required in Sections 42-4-202 to
42-2-227, C.R.S.This definition shall not include implements of husbandry, farm
tractors or vehicles customarily operated in a FARMING operation.
This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County
Centennial Center,915 10th Street, Greeley, Colorado. It is recommended that you or a representative

This is to state that the Derelict vehicles and etc. have all been removed and/or
covered so that no neighbors could see any thing, (I live on four acres). When I got a
complaint, I was not aware that I was in violation. I have lived here since the end of
1996 and have never had a complaint before. Honestly, I wasn't aware it was a
violation. As I told Bethany, I would work with her and get rid of the things that
were in violation. She was very nice in giving me some time.
In regards to me living in my shop/office, I am real sorry but I was misled into
believing that it was ok. I am asking you to please give me at least three months to
move out of the building. I have a young man,James Grunniman and his Son living
there now and they have been looking for a house to buy. They should be settled by
then and it would be after the Holidays,which would be greatly appreciated. I
intend to move back into the house at that time.
