The property is located AT 35409 WCR 18, and is surrounded by property currently zoned IIA11 The property is currently utilized as a natural gas processing facility, and was previously permitted as USR#274. Since the permit was issued,the equipment used on site has evolved,and accordingly Duke is seeking to update its permit. Duke has already taken significant steps to minimize off-site impacts, and will continue to do so. The site is currently the subject of remediation efforts related to events that occurred on the site while it was operated by Devon Energy. As part of those efforts, Devon is installing a flare on adjacent property owned by Devon. During this permit process, Duke will work with the County to make sure the proper parties receive permits. Finally, it should be noted that there is apparently no septic permit for the site. Duke is willing to work with the County to confirm there is in fact no permit and then if necessary procure one. RESPONSES TO USE BY SPECIAL REVIEW QUESTIONNAIRE 1. The Proposed Use of the Property: Duke currently operates an oil and gas processing facility on the property. The equipment includes compressors associated with gas processing and other equipment to allow gas produced in Weld County to be transported to market and sold. Consistency with Weld Comprehensive Plan: The proposed use is consistent with the Comprehensive Plan because it seeks to use the land to foster the development of the vast natural resources in Weld County. Over time,this facility has allowed the numerous mineral interest owners in Weld County to capitalize on their investments. Moreover,given the property's size together with the absence of any water rights attached to the property, it is impractical to use this property for farming. 3. Consistency with the Intent of the Weld County Zoning Ordinance and the zone district: The proposed use is consistent with the intent of the Agricultural Zone District, as it will foster the development of oil and natural gas resources, and Section 31.2 of the Weld County Ordinance provides that Oil and Gas Production Facilities are allowed as a matter of right in the Agricultural Zone District. It will not interfere with any agricultural operations, and further, given the current economics of the agriculture industry, many farmers in fact rely on the royalty payments which can only be realized through facilities such as the Roggen plant. 4. This past summer the Department of Planning Services asked Duke to update the special use permits for its various compressor sites in Weld County. Following discussions with Planning Staff, Duke has committed to submit appropriate applications for each site. As you can appreciate,each permit application packet requires a significant amount of time and work to put together,even before application can be reviewed. Duke has already submitted an application for its largest site, the Roggen site, and is very close to submitting the application for its other relatively large site,the Platteville site. The applications for the other sites, including the Marla site, which are by comparison much smaller, are proceeding expeditiously. We will file all the applications by the end of the year. Due to the extended period of time it takes to prepare and process the applications, Duke has no choice but to update various pieces of equipment to keep current with various regulations and recognize certain operating efficiencies. There are currently several relatively small projects that are critical and require immediate attention, e.g., the installation of a scrubber and some meter boxes at various sites. I have discussed this situation briefly with Kim Ogle, and he recommended I contact you directly. Duke requests that the Department of Planning Services authorize the release of its building permits during the application process on the condition that such changes will be reflected in the application packets, and that all such applications will be turned in before the end of 2002. Although I believe this letter adequately sets forth Duke's commitment,if you like,I would be happy to work with Lee Morrison and put together a more formal agreement concerning Duke's obligations. In the meantime,however, I would appreciate discussing this matter with you to work to a quick resolution. Emissions of air pollutants shall not exceed the following limitations (as calculated in the Division's preliminary analysis). Compliance with the annual limits shall be determined on a rolling (12) month total. By the end of each month a new twelve month total is calculated based on the previous twelve months' data. The permit holder shall calculate monthly emissions and keep a compliance record on site for Division review. (Reference: Regulation 3, Part B, III.A.4) Volatile Organic Compounds: 51.60 tons per year. Compliance with the yearly emission limits shall be determined on a rolling twelve(12) month total. The permit holder shall calculate emissions monthly and keep a compliance record on site in order to demonstrate compliance with the above emission limitations. The permit holder shall calculate annual emissions by the end of each month. Annual emissions shall be calculated based on the previous twelve (12) months' emission data. These calculated annual emissions shall be used to demonstrate compliance with the yearly emission limit listed above. 4. The East Side and Northwest Systems shall be equipped with an enclosed flare capable of reducing uncontrolled emissions of Volatile Organic Compounds by at least 85.0%. Operating parameters of the control equipment shall be identified prior to final approval of this permit. The identified operating parameters will replace the control efficiency requirement on the final permit. (Reference: Reg.3, Part B,IV.E.) 5. Prior to final approval being issued, the applicant shall submit to the Division for approval an operating and maintenance plan for all control equipment and control practices, and a proposed — record keeping format that will outline how the applicant will maintain compliance on an ongoing basis with the requirements of condition numbers 3, and 4 listed above. The compliance plan shall include records of actual frequency of contaminant concentration measurements and emission calculation procedures. At a minimum the plan shall include monitoring frequency of once a week for the first month, once a month for the next two months, and then once every three months there after. READ ITEMS 5,6,7 AND 8) 1. This permit is issued in reliance upon the accuracy and completeness of information supplied by the applicant and is conditioned upon conduct of the activity,or construction,installation and operation of the source,in accordance with this information and with representations made by the applicant or applicant's agents. It is valid only for the equipment and operations or activity specifically identified on the permit. 2. Unless specifically stated otherwise,the general and specific conditions contained in this permit have been determined by the APCD to be necessary to assure compliance with the provisions of Section 25-7-114.5(7)(a), C.R.S. 3. Each and every condition of this permit is a material part hereof and is not severable. Any challenge to or appeal of, a condition hereof shall constitute a rejection of the entire permit and upon such occurrence,this permit shall be deemed denied ab initio. This permit may be revoked at any time prior to final approval by the Air Pollution Control Division(APCD)on grounds set forth in the Colorado Air Quality Control Act and regulations of the Air Quality Control Commission(AQCC), including failure to meet any express term or condition of the permit. If the Division denies a permit,conditions imposed upon a permit are contested by the applicant,or the Division revokes a permit, the applicant or owner or operator of a source may request a hearing before the AQCC for review of the Division's action. 4. This permit and any required attachments must be retained and made available for inspection upon request at the location set forth herein. With respect to a portable source which is moved to a new location,a copy of the Relocation Notice(required by law to be submitted to the APCD whenever a portable source is relocated)should be attached to this permit. The permit may be reissued to a new owner by the APCD as provided in AQCC Regulation No.3,Part B, Section III.B.upon a request for transfer of ownership and the submittal of a revised APEN and the required fee. 5. Issuance(initial approval)of an emission permit does not provide"final"authority for this activity or operation of this source. Final approval of the permit must be secured from the APCD in writing in accordance with the provisions of 25-7-114.5(12)(a)C.R.S.and AQCC Regulation No.3, Part B,Section IV.H. Final approval cannot be granted until the operation or activity commences and has been verified by the APCD as conforming in all respects with the conditions of the permit. If the APCD so determines,it will provide written documentation of such final approval, which does constitute"final"authority to operate. Compliance with the permit conditions must be demonstrated within 180 days after commencement of operation. 6. THIS PERMIT AUTOMATICALLY EXPIRES IF you(1)do not commence construction or operation within 18 months after either the date of issuance of this permit or the date on which such construction or activity was scheduled to commence as set forth in the permit,whichever is later;(2)discontinue construction for a period of 18 months or more;or(3)do not complete construction within a reasonable time of the estimated completion date. Extensions of the expiration date may be granted by the APCD upon a showing of good cause by the permittee prior to the expiration date. , 7. YOU MUST notify the APCD at least thirty days(fifteen days for portable sources)prior to commencement of the permitted operation or activity. Failure to do so is a violation of Section 25-7-114.5(12)(a),C.R.S.and AQCC Regulation No.3, Part B,Section IV.H.1.,and can result in the revocation of the permit. You must demonstrate compliance with the permit conditions within 180 days after commencement of operation as stated in condition 5. 8. Section 25-7-114.7(2)(a),C.R.S.requires that all sources required to file an Air Pollution Emission Notice(APEN) must pay an annual fee to cover the costs of inspections and administration. If a source or activity is to be discontinued,the owner must notify the Division in writing requesting a cancellation of the permit. Upon notification, annual fee billing will terminate. 9.
