REI, LLC
A public hearing was conducted on May 28, 2003, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 18, 2003, and duly published April 24, 2003,
in the South Weld Sun, a public hearing was conducted to consider the request of REI, LLC, for
a Site Specific Development Plan and Planned Unit Development Final Plan, PF #1021, for the
Second Filing of Beebe Draw Farms for 406 lots. Lee Morrison, Assistant County Attorney, made
this a matter of record. Monica Mika, Department of Planning Services, stated the applicant has
requested a 60-day continuance of this case, to allow additional time to work with the mineral
owners to address their concerns. Ms. Mika stated staff concurs with the request and recommends
this hearing be continued to August 6, 2003, at 10:00 a.m. In response to Commissioner Vaad,
Ms. Mika stated the Change of Zone was approved many years ago, and there have been ongoing
discussions regarding the oil and gas uses. Responding to Commissioner Geile, Ms. Mika stated
this proposal was initially denied by the Board, and a Substantial Change was later approved for
an additional 406 lots.
Alan Dicke represented the applicant and stated a continuance will accommodate additional
negotiations with the mineral owners regarding surface use agreements.
Chris Greneaux, Kerr-McGee Rocky Mountain Corporation, stated they are moving forward with
negotiations; however, this is a large project which requires significant research to determine the
locations of existing infrastructure. He explained they are working to identify all of the natural gas
pipelines, as well as the oil and gas facilities, owned by various companies. Mr. Greneaux stated
he is awaiting a revised plat from the applicant indicating the identified lines, and that information
will be used in finalizing the surface uses. In response to Commissioner Jerke, Ms. Mika stated
if this matter is continued, a renotification to surrounding property owners is not required; however,
due to the lengthy process a courtesy notice will be sent in this instance. She further stated if the
plat comes back with substantial changes, staff must determine whether the entire matter should
be returned to the Planning Commission for additional review prior to further Board consideration.
Responding to Commissioner Masden, Ms. Mika stated there are 20 pages of plats and she wants

to ensure staff has adequate time to review the details proposed by the applicant, therefore, she
proposes the matter be continued to August 6, 2003, to allow some additional review time.
Molly Sommerville, attorney, stated she represents the interests of Anadarko EMP Company and
Anadarko Land Corp. She stated each company owns all the minerals under Sections 5, 9, and 17.
She stated the oil and gas rights have been leased to various companies, which are currently
operating approximately 60 wells. Ms. Sommerville stated there are multiple pipelines that run
through the property, and there are additional oil and gas interests not owned by her clients which
the applicant also needs to address. She stated a finalized surface use agreement, with an
attached plat indicating oil and gas facilities, setbacks, and lot lines. Responding to Commissioner
Vaad, Mr.Greneaux stated a majority of the existing pipelines are covered by easements, but some
do not have specific meets and bounds descriptions, therefore, they are trying to eliminate blanket
easements and clarify the specific descriptions. In response to Commissioner Jerke, Ms.
Sommerville stated it may be difficult for the applicant to complete all the necessary plat work by
August 6th. Mr. Greneau stated Kerr-McGee has identified all its infrastructure, which is currently
being surveyed for platting purposes; however, the applicant is still waiting for other oil and gas
interests to do the same. There being no further testimony, Chair Long closed public testimony.
Mr. Dicke stated he feels a continuance to August 6, 2003, will allow adequate time to complete
the surface use agreements and add the necessary information to the plat.
Based on the request of the applicant and the recommendation of Planning Services staff,
Commissioner Jerke moved to continue the request of REI, LLC, for a Site Specific Development
Plan and Planned Unit Development Final Plan, PF #1021, for the Second Filing of Beebe Draw
Farms for 406 lots, to August 6, 2003, at 10:00 a.m. The motion was seconded by Commissioner
Geile, and it carried unanimously. There being no further discussion, the hearing was completed
at 10:30 a.m.
This Certification was approved on the 2nd day of June 2003.
