RE: REQUEST WITHDRAWAL FROM SOUTHWEST WELD DRAINAGE AUTHORITY
AND CONSENT TO TERMINATION OF INTERGOVERNMENTAL AGREEMENT
PURSUANT TO SECTION 29-1-204.2, C. R. S., FOR THE CREATION OF THE
SOUTHWEST WELD DRAINAGE AUTHORITY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on March 13, 2002, the Board of County Commissioners approved Weld
County's membership in the Southwest Weld Drainage Authority by approving and authorizing
the Chair's signature on the Intergovernmental Agreement Pursuant to Section 29-1- 204.2,
C. R. S., for the Creation of the Southwest Weld Drainage Authority("the Agreement"), and
WHEREAS, Section 8 of the Agreement allows members to withdraw from membership
in the Southwest Weld Drainage Authority by requesting such withdrawal and by having such
withdrawal approved by a two-thirds vote of the Board of Directors, and
WHEREAS, Section 1 of the Agreement allows the Agreement to terminate if all of the
members consent to such termination and the Southwest Weld Drainage Authority's outstanding
obligations have been either paid in full, or proper arrangements have been made to ensure full
payment, and
WHEREAS, although some type of entity may be necessary to oversee and coordinate
efforts to control drainage of storm waters within the affected basins, it is evident to the Board of
County Commissioners that at present, the Southwest Weld Drainage Authority is not the proper
entity to accomplish those efforts.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Board hereby requests that the Southwest Weld Drainage
Authority Board of Directors approve the withdrawal of Weld County from membership in the
Southwest Weld Drainage Authority.
BE IT FURTHER RESOLVED by the Board that it hereby expresses its desire to
terminate the Southwest Weld Drainage Authority when its outstanding obligations have been
paid, or proper arrangements have been made to ensure payment of such obligations.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
