Weld County Building Violation Cases: VI-0300106, Larry L. Lohmann Chapter 29, Article III (3), Section 29-3-10 of the Weld County Code The property owner shall obtain a new building permit and pay all applicable fees. VI-0300145, Charles Miles/Mastersson Construction Management Inc Chapter 29, Article VIII (8), Section 29-8-40of the Weld County Code The property owner shall obtain a new building permit and pay all applicable fees. The Department of Planning Services staff is requesting that the Board review the individual cases and determine whether or not to authorize legal action to remedy the violations. Weld County Zoning Violation Cases: VI-0300090, Mr. Ross Early Chapter 23, Article 111(3), Division 2 of Sections 23-3-150, 23-3-150.6 and 23-3-150.C of the Weld County Code. The Noncommercial Junkyard consisting of derelict vehicles, metal/iron, trash, automobile parts, wood and miscellaneous debris shall be restored or removed from the property. VI-0000097, Mr. & Mrs. Larry Torrez Chapter 23, Article 111(3), Division 1 of Sections 23-3-20, 23-3-30, 23-3-30.D, 23-3-40, 23-3-40.O and 23-3-40.R of the Weld County Code. The business shall be permitted either through Home Occupation, Home Business (Use by Special Review)or the business shall be removed from the property. VI-0100216, Mr. & Mrs. Dewitt Emerling Chapter 23, Article 111(3), Division 1 of Sections 23-3-20, 23-3-30, 23-3-30.1, 23-3-40 and 23-3-40.H of the Weld County Code. The Noncommercial Junkyard shall be removed, restored or screened from all adjacent properties and all public rights-of-ways. The number of dogs shall be reduced to four(4)or a Use by Special Review application shall be completed and submitted to the Department of Planning Services. Lastly, the derelict mobile home shall be removed from the property or to tear down the mobile home a demolition permit shall be obtained from the Department of Building Inspections. VI-0100204, Toby&Jon Foss Trust Chapter 23, Article 111(3), Division 1 of Sections 23-3-20, 23-3-30, 23-3-30.1, 23-3-40, 23-3-40.O and 23-3-40.R of the Weld County Code. The Noncommercial Junkyard shall be restored, removed or screened from all adjacent properties and public rights-of-ways. Additionally, to operate the business on the property a Use by Special Review application shall be completed and submitted to the Department of Planning Services. Weld County Combined Zoning and Building Violation Cases: VI-0300098, Ms. Dorothy D Elia Chapter 23, Article 111(3), Division 2 of Sections 23-3-110, 23-3-110.B, 23-3-110.B.1, 23-3-110.C and 23-3-110.D and Chapter 29, Article 111(3)of Sections 29-3-10 and 29-3-320 of the Weld County Code. The Noncommercial Junkyard shall be removed. Additionally, it was brought to our attention that Ms. D Elia and other individuals are residing in the garage. This is not an allowed use per the R-1 (Residential)Zone District. The garage shall be returned to its original use or a PUD (Planned Unit Development) application shall be completed and submitted to the Department of Planning Services.
