The Weld County Department of Planning Services has determined through an administrative review that the
standards of Section 24-8-40 of the Weld County Code have been met. This Recorded Exemption is
approved with the following conditions in accordance with information submitted in the application and the
policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:

0. Lot B shall use the existing agricultural /oil and gas / ditch road access points necessary for
agricultural operations as no additional accesses shall be granted.

County Road 7.5 is designated on the Weld County Transportation Plan Map and the 1-25 Mixed
i Use Development area as a four-lane arterial with a raised medium which requires 110 feet of
right-of-way at full build out. A total of 55 feet from the centerline of County Road 7.5 shall be
delineated on the plat as right-of-way reservation for future expansion of County Road 7.5. The
Town of Frederick annexed the west one-half of the mile to County Road 7.5 adjacent to the
property.
F. County Road 20.5 is designated on the Weld County Transportation Plan Map and the 1-25
Mixed Use Development area as a four-lane arterial,undivided,secondary road,which requires
100 feet of right-of-way at full build out. A total of 50 feet from the centerline of County Road
20.5 shall be delineated on the plat as right-of-way reservation for future expansion of County
Road 20.5. This road is maintained by Weld County.
CeThe Weld County Public Works Department shall review the plat prior to recording to verify
future rights-of-way for the existing and proposed access points.
The applicant shall submit to the Weld County Department of Planning Services evidence that
any existing septic system meets all requirements of the Weld County Department of Public
Health and Environment. The Weld County Department of Public Health and Environment was
unable to locate a septic permit for the septic system located on the smaller parcel(Lot A). Any
existing septic system which is currently not permitted through the Weld County Department of
Public Health and Environment will require an I.S.D.S. evaluation prior to the issuance of the
required septic permits. In the event the system is found to be inadequate,the system must be
brought into compliance with current I.S.D.S. regulations.
0 The applicant shall attempt to address the requirements (concerns) of Godding Ditch
Company as stated in referral response received August 8,2003.Evidence of such shall
be submitted in writing to the Weld County Department of Planning Services.
The applicant shall provide the Weld County Department of Planning Services with a Statement
of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original
parcel.
/K. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
* No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code,shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead.
Any construction within a 200-foot radius of any tank battery or 150-foot radius of any
wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld
County Code.
2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.

3) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Amended Recorded Exemption number.
4) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lot B has an adequate water supply of sufficient
quality, quantity and dependability.
5) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
6) Recorded Exemptions on adjacent properties may raise the issue of compliance with the
intent of the Recorded Exemption Process. Approval of this Recorded Exemption does
not guarantee approval of future applications on adjacent properties.
7) Effective January 1,2003, Building Permits issued on the proposed lots will be required
to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11)
8) Prior to the release of building permits on Lot B, the Lot owner shall verify with the
nearest Town/City or Sanitation District to determine the location of the nearest sanitary
sewer line. In accordance with the Weld County Code, if a sewer line exists within four
hundred (400) feet of the property line and the sewer provider is willing to serve the
proposed structure, a septic permit cannot be granted by the Weld County Department
of Public Health and Environment. Evidence of such shall be submitted in writing to the
Weld County Department of Planning Services.
9) Ditch alterations,ditch crossings,encroachments on the easement and discharge
of storm water into the ditch is prohibited unless written permission from the
Godding Ditch Company. As part of the cleaning an maintenance of the ditch,the
ditch company may pile muck and debris from the ditch on the ditch's bank. This
practice is a normal maintenance activity and is included as part of the easement.
10) Potential Purchasers are hereby notified that Idaho Creek Sand and Gravel Operation
(USR-1194) is located within a half mile of the site. Off-site impacts that may be
encountered include noise from trucks and equipment and dust.
11) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive
agricultural counties in the United States,ranking fifth in total market value of agricultural
products sold. The rural areas of Weld County may be open and spacious, but they are
intensively used for agriculture. Persons moving into a rural area must recognize and
accept there are drawbacks, including conflicts with longstanding agricultural practices
and a lower level of services than in town. Along with the drawbacks come the incentives
which attract urban dwellers to relocate to rural area:open views, spaciousness,wildlife,
lack of city noise and congestion, and the rural atmosphere and way of life. Without
neighboring farms, those features which attract urban dwellers to rural Weld County
would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts,including noise from tractors
and equipment; slow-moving farm vehicles on rural roads; dust from animal pens,field
work, harvest, and gravel roads; odor from animal confinement, silage, and manure;
smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers
in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply
•
be moved out of the way of residential development without threatening the efficient
delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and County roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads,no matter how often they are bladed,will not provide
the same kind of surface expected from a paved road. Snow removal priorities mean
that roads from subdivisions to arterials may not be cleared for several days after a major
snowstorm. Snow removal for roads within subdivisions are of the lowest priority for
public works or may be the private responsibility of the homeowners. Services in rural
areas, in many cases,will not be equivalent to municipal services. Rural dwellers must,
by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important,not only for their safety, but also for the protection of the
farmer's livelihood. Parents are responsible for their children.
3. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County
Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar

recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services'
Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld
County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days from
the date the Administrative Review was signed. The applicant shall be responsible for paying the
recording fee.
4. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00.
The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be
sent to maps(@co.weld.co.us.
5. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to the
Weld County Board of County Commissioners with a staff recommendation for denial.

Dear Ms. Hatch:
Our firm represents the Godding Ditch Company ("Ditch Company"). The Ditch Company
recently received a referral for the Hopper application, which requests Weld County's permission
to increase the size of Lot A. The Ditch Company owns the Godding Ditch ("Ditch"), which
runs diagonally across the Hopper property and defines the eastern boundary of Lot A. The Ditch
Company also owns a 120 foot-wide easement being 60 feet-wide on either side of the Ditch's
center line for the operation, maintenance, repair and replacement of the Ditch.
Please ensure that any approval granted by Weld County to the Hoppers notes that ditch
alterations (relocating, sloping or piping), ditch crossings (over, under, or through the ditch),
encroachments on the easement (trees, structures, fences, etc.) and discharge of storm water into
the Ditch is prohibited unless the Hoppers receive written permission from the Ditch Company.
As part of the cleaning and maintenance of the Ditch, the Ditch Company may pile muck and
debris from the Ditch on the Ditch's banks. This practice is a normal maintenance activity and is
included as part of the easement.

The Weld County Public Works Department has reviewed this proposal. Our comments and requirements are as follows:
COMMENTS:
WCR 20.5 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code Ordinance, Section 20-1-30,
and the 1-25 Mixed Use Development area as a four-lane, undivided, secondary road, which requires a 100-foot right-of-way for WCR
20.5. WCR 7.5 is identified as a four-lane arterial with raised medium which requires a 110-foot of right-of-way at future build out.
WCR 20.5 is maintained by Weld County adjacent to the Recorded Exemption property at this location. The Town of Frederick
annexed the west one-half of the mile to WCR 7 adjacent to the property. Pursuant to the definition of SETBACK in the Weld
County Code, Chapter 23,Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
Please refer to the I-25 Mixed Use Development area structural plan map 2.2, Structural Transportation Network, for verification of
both WCR 20.5 and the proposed WCR 7.5 at this location.
Both recorded exemptions abut the section line, which is identified for a future four-lane arterial with a raised medium. I have
reserved additional right-of-way directly north of the proposed Recorded Exemption through the Koboble gravel pit operation and
have constructed one-half of the road section of the Idaho Creek Development adjacent to State Highway 119. The Rim Valley Ranch
has set aside additional right-of-way to accommodate this expansion.
REQUIREMENTS:
The applicant shall reserve additional future right-of-way, specifically an additional 20 feet for a total of 50 feet from the center line of
WCR 20.5 and 55 feet from the half section line for the expansion of WCR 7.5 on the Hopper property.
Both future reserved rights-of-way shall be shown on the plat prior to recording.
Access: The Weld County Public Works Department will work with the applicant on accessing the proposed Lot A(14 acres 1) from
either WCR 20.5 or the extension of WCR 7.5 through this location.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a
result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds.
For the AmRE-426, the applicant shall utilize the existing residential access to this parcel. For Lot B,utilize the existing agricultural,
oil and gas,and ditch roads that are necessary for your agricultural operation.
RE-3599, Lot A, is identifying access from WCR 20.5 adjacent to the half section line, which is the same location as the future
expansion of WCR 7.5. The applicant may use this temporary access until the expansion of WCR 7.5 extends through the recorded
exemption. At that time, the Public Works will work with you on a reasonable access to Lot A. Remember setbacks for structures are
measured from future right-of-way lines.
Both plat drawings for AmRE-426 and RE3599 need to be reviewed prior to recording by the Weld County Public Works Department
to verify future rights-of-way for the existing and proposed access points to both recorded exemptions.

not currently permitted through the Weld County Department of Public Health &
Environment will require an I.S.D.S. Evaluation prior to the issuance of the
required septic permit(s). In the event the system(s) is found to be inadequate,
the system(s) must be brought into compliance with current I.S.D.S. regulations.

If these documents exist, they were not included in the file I received for review. This tends to happen
quite often. When Sylvia does a permit search when a file comes in, she is often unable to locate a septic
document on a property as it may have been pulled under another name, associated with another address
or parcel number, or mis-entered.
That's why it is so important to include any of these documents in the file that comes to us, but when the
applicant does not submit them, I am stuck with making the comment that I made. If they are then able to
produce a document, as in this case, that will suffice.
If you would like me to re-submit my comments, let me know.

In your comments for AMRE-426 (Hopper) you mentioned that you could not find a Septic Permit for the
smaller lot. I have a letter dated May 8, 1978 from John Hall with the Health Dept. saying that the system
is adequate for a three bedroom home. Mr. Hopper has hand written on the letter that he had a phone
conversation with Dennis Carter from the Health Dept. on March 4, 2003 and it was still determined okay.
So I guess my question is... is this okay or do we need a copy of the permit?

1807124 public records of Weld County, Colorado, said parcel also being in the SE 1/4 of
Section 15, Township 2 North, Range 68 West, of the Sixth Principal Meridian, in Weld
County,Colorado,said tract or parcel of land being more particularly described as follows:
Commencing at the East 'A corner of said Section; Thence 500°24'14"E along the East line of
said Section,a distance of 1328.99 feet; Thence 589°35'46"W at a right angle to the last course,
a distance of 450.38 feet to a point on the south property line, said point being the TRUE POINT
OF BEGINNING;
