HomeMy WebLinkAbout20030934.tiff 143 RESOLUTION RE: ACCEPT PETITION AND AUTHORIZE VACATION OF AN IRREGULAR PORTION OF RIGHT-OF-WAY ON JOHNSON STREET, EVANS ADDITION, WELD COUNTY, COLORADO - HUPP/DEATH/MARTINEZ WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Road Petition from Daniel and Mary Hupp, Gary and Cynthia Death, and the Manuelita Martinez Estate, do Felix Martinez, 2111 Blue Mountain Road, Longmont, Colorado 80504, a copy of which is attached hereto and included by reference, requesting vacation of an irregular portion of right-of-way on Johnson Street, being more fully described as follows: The public road right-of-way described as the irregular piece of land bounded on the north by lots 13 and a portion of 14, Block S, Evans Addition; on the south by portions of lots 18 and 19 of Block P, Evans Addition; on the west by the westerly line of Block S and P extended; and on the east by Lots 13, 14, 15, 16, and 17, Evans Addition, Weld County, Colorado WHEREAS, the County Attorney's Office and Departments of Public Works and Planning Services have recommended approval of said request since that portion of Weld County road right- of-way is not needed for the safety and welfare of the traveling public, and WHEREAS,the adjoining landowners were mailed ten days notice by the Clerk to the Board of a public hearing set for April 9, 2003, to consider the vacation of that portion of road right-of-way which is described above, and WHEREAS, any persons owning dedicated and recorded easements and rights-of-way for the use of the right-of-way to be vacated, if any, may continue such use after formal vacation by Weld County, and WHEREAS, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the evidence showed that the vacation of that portion of Weld County road right-of-way which is described above will not leave any land adjoining the roadway without an established public road or private access easement connecting the land with another established public road, and WHEREAS,the Board of County Commissioners deems it advisable to vacate said portion of road right-of-way, with said vacation to become effective upon recording as required below. 1HI11111111111 III 111111III11111111IIIDIIIIIII1111 2003-0934 1 of 2 R 0.00 D 0.00 Steve Moreno Clerk& Recorder EG0047 acs % Pa) /9-771 RE: VACATION OF AN IRREGULAR PORTION OF JOHNSON STREET - HUPP/DEATH/MARTINEZ PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado,that the Road Petition from Daniel and Mary Hupp, Gary and Cynthia Death, and the Manuelita Martinez Estate, do Felix Martinez, be, and hereby is, accepted.
