Dear Mr. Ogle and Associates:
BritTara Land Company, LLC has recently placed under contract approximately 8.5 acres
currently owned by Agland, Inc. The property is located along WCR 38 approximately 1.5 miles
east of I-25. The site is adjacent to the Great Western Railroad and has a rail spur existing along
the western property line. As of recent, the site has been utilized for transloading agricultural
products as defined by the approved USR-935 in 1991 (see attached). This facility was rail
operated until last year, at which time Agland decided to utilize the site for storage and list the
property for sale.
It is the intent of BritTara Land Company, LLC to continue operations as defined by USR-935,
however, it is not clear as to the limitations of operation with respect to a product list. In the
Application for Use by Special Review by Agland Inc., the proposed use for this site is at one
point stated as"to supply and service an agricultural support business" and then goes on to say a
list of products prevalently used within the agricultural industry. The list of products clearly
defined in USR-935 shall continue to be transloaded through this facility, but it is our position that
the aforementioned quote from USR-935 was put in place so as to not limit the use of this site to ,
just those specific products. This is further supported by the use of text which states that the
"operations of these facilities and products will be the same as that which is currently being
carried out at Agland's Eaton and Gilcrest facilities." BritTara Land Company, LLC would ask
the planning committee to consider that the Eaton and Gilcrest facilities have at anytime had
products associated with timber products for trusses, cotton seed, powdered milk, and beets and
beans and allow use to expand our product list without significant changes being considered to
USR-935.

Additional products for which we request approval to transload are attached and include sand, fly
ash, cement, pea gravel, and construction materials of the like. Materials such as sand and ash are
used in the agricultural industry for soil treatments and soil stabilizers on a regular basis. Gravels
are utilized regularly for drains and drainage structure and cement is used in the construction of
irrigation structures. We would like the opportunity to present to you documentation that would
show that BritTara Land Company, LLC (or lease operator) can transload the aforementioned
agricultural construction material products in a manner that complies with all existing parameters
set forth in the USR-935 Development Standards. All necessary permits for air quality shall be
obtained, the noise level shall not be greater than 80 db, as measured according to Section 25-12-
102, C.R.S., fugitive dust and blowing debris shall be controlled, and with respect to drainage and
environmental issues there shall not be any adverse effect due to the distribution of these
products. These are not acid generating materials or toxic dumps with potential to contaminate
soils and groundwater, rather very much the opposite;these are relatively inert materials that shall
be stored in a manner that is pre-approved by the planning department. These products may not
be the first to come to mind when one thinks of the agricultural industry, however they do have
their place and use within the industry and we feel that we can service these products without any
change to the existing Development Standards, let alone a significant change.
