RE: ACTION OF BOARD CONCERNING MOBILE HOME PERMIT, ZPMH #2354 -GARY
AND JOYCE KNIGHT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 24th
day of February, 2003, considered the request of Gary and Joyce Knight, and Bruce Knight,
42278 Weld County Road 37, Ault, Colorado 80610, for a mobile home to be used as a
Temporary Use During a Medical Hardship, and
WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
Lot B of Recorded Exemption #2635; being part of
the SW1/4 of Section 31, Township 8 North, Range
65 West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board of County Commissioners, having heard all of the testimony,
finds that said request should be denied for the following reasons:
1. It is the opinion of the Board of County Commissioners that the applicant has not
shown compliance with Section 23-4-180 of the Weld County Code, as follows:
A. Section 23-4-180.A.1 states, "A medical hardship exists in which the
person to be living in the mobile home requires the supervision and care
of those persons residing in the principal dwelling unit on the property (or
the reverse). Documentation of the medical hardship shall be established
in a letter from the subject's medical doctor or other evidence deemed
suitable by the Department of Planning Services. The letter shall be
submitted as a part of the zoning permit application and shall verify that
the subject is physically impaired and requires full-time care." The Board
of County Commissioners finds that the applicant failed to prove full-time
care at the residence is necessary.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Gary and Joyce Knight and Bruce Knight for
permission to place a mobile home to be used as a Temporary Use During a Medical Hardship
on the above described parcel of land, be, and hereby is, denied.

The Department of Planning Services' staff has reviewed this request and recommends that this
request be denied for the following reasons:
1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown
compliance with Section 23-4-180 of the Weld County Code, as follows:
a. A medical hardship exists in which the person to be living in the mobile home requires the
supervision and care of those persons residing in the principal dwelling unit on the property
(or the reverse). Documentation of the medical hardship shall be established in a letter
from the subject's medical doctor or other evidence deemed suitable by the Department of
Planning Services. The letter shall be submitted as a part of the zoning permit application
and shall verify that the subject is physically impaired and requires full-time care.
The Department of Planning Staff reviewed the information provided by the applicant, and
concurred that an additional home is not justified as full time care in not required.

Should the Board of County Commissioners approve this request,the Department of Planning Services'staff
recommends the following conditions be attached:
1. A deed describing Lot B of RE-2635 shall be submitted to the Department of Planning Services with
the submittal of the building permits.
2. An existing septic system is to be used for the proposed second home. The Weld County
Department of Public Health & Environment will require an I.S.D.S. Evaluation. In the event the
system(s) is found to be inadequate, the system(s) must be brought into compliance with current
I.S.D.S. regulations.
3. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home
on the property.
4. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved
sewer system and a legal water supply.
5. The mobile home shall not be occupied until such time that the applicant has complied with
Conditions 2 and 3 stated above.
6. All zoning permits for mobile homes during a medical hardship are temporary. Such permits shall
be subject to review annually on the anniversary of the original permit's issuance. Such permits
shall be extended only if the use continues to be in conformance with the criteria set out in Section
23-4-180. Any permit for a medical hardship use shall automatically expire, and the mobile home
shall be removed upon cessation of the medical hardship or at any such time the mobile home is
used for purposes other than the permitted use.
7. The applicant shall submit documentation to the Department of Planning Services by March 151 of
each year describing the status of the medical hardship. This permit is temporary and shall
terminate once the medical hardship ceases to exist, at which time the applicant shall have thirty
(30) days to remove the mobile home from the property.
8. The applicant must obtain a building permit for a mobile home and must comply with all installation
standards of Chapter 29 of the Weld County Code applicable to mobile homes.
9. All derelict vehicles located on the property must be operational with current license plates, be
screened from all adjacent properties and public rights of way,or be removed from the property.All
other items considered to be part of a noncommercial junkyard must also be removed from the
property or screened from adjacent properties and public rights-of-way.
10. All proposed or existing structures will or do meet the minimum setback and offset requirements for
the zone district in which the property is located. Pursuant to the definition of setback in the Weld
County Code, the required setback is measured from the future right-of-way line.
11. Any future structures or uses on site must obtain the appropriate zoning and building permits.
12. Weld County Road 37 is designated on the Weld County Transportation Plan Map as a local gravel
road,which requires 60 feet of right-of-way at full build out.There is presently 60 feet of right-of-way.
This road is maintained by Weld County.
13. The applicant shall use the existing access to this parcel, no additional access shall be granted.
14. Should noxious weeds exist on the property or become established as a result of the proposed
development the applicant/landowner shall be responsible for controlling the noxious weeds,pursuant
to Section 15-1-10 of the Weld County Code.
15. The applicant shall maintain compliance with Section 23-4-180 of the Weld County Code at all
times.

Your zoning permit for a mobile home application is being processed by our office. If it is determined that
the application meets the approval criteria of Chapter 23, Article IV, Division 3, of the Weld County Code,
you will be notified that the zoning permit is approved. If the staff determines that the application does not
meet the approval criteria, you will be notified and asked to appear before the Board of County
Commissioners at a public hearing. You will be informed of the hearing date at least a week prior to the
hearing. The Board of County Commissioners will then consider your application and make a final decision
on the zoning permit for the mobile home.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within
three miles of the property in question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the
submitted materials to the Nunn Planning Commission for their review and comments. It is recommended
that you and/or a representative be in attendance at the Nunn Planning Commission meeting to answer any
questions the Commission members may have with respect to your application. Please call Nunn at(970)

The Weld County Public Works Department has reviewed this proposal. Our comments and
requirements are as follows:
COMMENTS:
WCR 37 is designated on the Transportation Plan Map as a local gravel road, which requires a
60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code,
Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-
of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The applicant shall utilize the existing residential access to this parcel, and no additional
accesses shall be granted.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds.
