SANDRA HOLTER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 3rd day of June, 1981, in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
the division into two parcels of land as shown on the plat
known as Recorded Exemption No. 504, being the property of
Dwight and Sandra Holter, described as part of the Southwest
Quarter of Section 5, Township 6 North, Range 67 West of the
6th P.M. , Weld County, Colorado, being more particularly
described as follows:

of the 6th Principal Meridian, Weld County,
Colorado, being more particularly described

Beginning at the Southwest Corner of the

"subdivision" and "sub-divided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of
land from the definitions of "subdivision" and "sub-divided
Land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973, as amended, and Section 2-lA (3) of the Weld County
Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that the hereinabove
described parcel of land owned by Dwight and Sandra Bolter
be, and hereby is, exempt from the definition of the terms
"subdivision" and "sub-divided land" pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 3rd
day of June, A.D. , 1981.

Re: Recorded Exemption #504
Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Dwight and Sandra Holter for a recorded exemption. The
parcel of land on which this request has been made is described as
part of the SW1, Section 5, T6N, R67W of the 6th P.M. , Weld County,
Colorado. This property is located approximately 11 miles northwest
of Windsor, Colorado. The property contains approximately 28 acres
of Class II, IV, VI and VII irrigated and nonirriaged soils. The
request is to split the property into parcels of 20.06 acres and 8.12
acres.
On April 8, 1981, the Board of County Commissioners approved a request
by Mr. and Mrs. Dwight Holter for a lot size variance so that they
could make application for this recorded exemption. At the time they
made the decision on that request, the Department of Planning Services
staff submitted a letter of recommendation for denial to the Board. A
copy of the letter for denial is included in the attached packet.
Nothing has been received by our office that would change our recommenda-
tion for denial for this request as outlined in the letter to the Board
of County Commissioners dated April 6, 98 . .

The above referenced parcel comprises 28.18 acres. This is separated from
adjacent farmland by County Road No. 15 on the East, County Road No. 72 on
the South and the Lake Canal Ditch along the North.
As indicated at the public hearing on April 8, 1981, when the Lot Size Variance
was granted, the owners wish to divide the parcel into two (2) individual
lots for residential use. Lot 'A' would be retained by the current owners.
Lot 'B' would be sold as a residential site. The proposed lot would be
served by the North Weld County Water District, with an on-site septic
system similar to the existing system on Lot 'A' .

WHEREAS, the Board of County Commissioners of Weld County,
Colorado feels that the applicants have shown good cause for
granting a lot size variance under Section 9-4 .A. (6) of the Weld
County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that a variance from lot size

T6N, R67W of the 6th. PM, Weld County, Colorado. This property is
located li miles north and z mile west of Windsor.
The property under consideration contains approximately 28.1.8 acres of
Class II and IV irrigated soils. The request is to obtain a variance
from the minimum lot size requirement, Section 9-4. A. (6) of the Weld
County Subdivision Regulations, so that they may make application for
a recorded exemption.
The Holters desire to divide their property into two parcels of 8.12
acres and 20.06 acres so that they may sell the smaller parcel .
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services staff recommends the
request be denied for the following reasons :
1. The proposed request does not comply with the Weld County
Comprehensive Plan because it would promote non-agricultural
use of agricultural land and it would encourage urban encroach-
ment on rural land uses. The Plan urges residential development
to be closely connected to and served by municipal utilities
with towns being encouraged to service new developments
within a reasonable service area from its incorporated boundaries.
The plan further indicates subdivision of land should conform to
the overall development goals and policies of the Comprehensive Plan.

2. This request is not in conformance with the intent clause of the
Agricultural Zone District, Section 3. 3A. of the Weld County Zoning
Resolution.— This request would not be encouraging agricultural uses
as the highest and best uses, it would not be providing for the
orderly expansion of urban growth, it would be promoting the divi-
sion of agricultural land into smaller, less economic parcel sizes,
and increasing the residential density on the property.
The approval of this request would allow another residence to be
built on the 8 acre parcel . While the addition of one residence
does not in itself create an urban encroachment, the cumulative
effect of land divisions on the surrounding area may have future
negative impacts on the agricultural economy. Increased residential
density results in greater demands on the services which residential
development requires and theefore higher costs of thoservices to the
residents of the County.
3. This request is not in compliance with the intent clause of the
recorded exemption procedure, Section 9-2 of the Weld County Sub-
division Regulations . The parcel is not prime agricultural land
because of the location of the parcel with respect to Lake Canal Ditch.
The nature of this request is not, however, providing for the orderly
expansion of urban growth in accordance with the Comprehensive Plan.
The Department of Planning Services staff feels that if residential
development increases in the area, inefficient residential development
will result.
4. The minimum lot size in the Agriculutral Zone District for irrigated
parcels is 80 acres and for non-irrigated parcels is 160 acres.
The intent is to maintain tracts which are large enough for farm
purposes, and to assist in the encouragement of agricultural uses
as the highest and best use of the land. This request is in conflict
with that intent.
