RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
VI#0300052 AGAINST COUNTRY ESTATES, LLC, AND CLAYTON HOMES FOR
VIOLATIONS OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Country Estates, LLC, and Clayton Homes, VI #0300052, are allegedly in
violation of the Weld County Code, and
WHEREAS, on the 12th day of August, 2003, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Country Estates, LLC, and Clayton Homes were not represented at said
hearing, although all parties were notified of said hearing by the Department of Planning
Services staff, and
WHEREAS, the Board of County Commissioners deems it advisable to continue said
matter until September 9, 2003, to allow adequate time for the Department of Planning Services
to notify all parties involved of violations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0300052 be, and hereby is, continued to September 9, 2003, to
allow adequate time for the Department of Planning Services to notify all parties of the
violations.

Currently the property is in violation of Chapter 29, Article VIII (8), Section 29-8-40 of the Weld County

REMEDY

RECOMMENDATION

Subject: Outstanding Permits
Weld County Building Department is in the process of reviewing all open manufactured home permits in an
attempt to close all those that are expired. Below is a list of the open permits under Clayton Homes and the
status of each:
PR-9930121 -3500 35th Avenue, #8, issued May 10, 1999, has been referred to the County Attorney. A
correction notice was left for final electric on December 19, 2002. A Certificate of Occupancy was never
issued.
PR-0030241 -101 East 20th Street,#48 was issued on August 8,2000. Final inspections were scheduled on
March 18, 2003, and then cancelled. To date, they have not been rescheduled. This case was presented to
the Board of County Commissioners on June 3, 2003, and referred to the County Attorney for action.
PR-0030303-3500 35 Avenue,#68 was issued on October 3,2000. Final electric inspection was approved
on March 22, 2001. A correction notice was left for the other final inspections and they have not been
rescheduled. This case is scheduled with the Board of County Commissioners on August 12, 2003. if final
inspections are approved prior to that date, this meeting may be cancelled.
PR-0130093 — 15724 Mary Avenue was issued on June 12, 2002, for a temporary dwelling during
construction. Corrections were left on March 5,2003, and inspections have not been rescheduled. This home
is to be removed upon completion of permit number PRS-033031 which had corrections left for the final
approval and Certificate of Occupancy on July 2, 2003. Only a temporary Certificate of Occupancy will be
issued until the temporary home is removed.
PR-0130313- 10959 County Road 28 was issued on December 20. 2001. No final inspections have been
scheduled.
PRS-023107 — 15857 Coleman Avenue was issued on October 29, 2002: On December 12, 2002, a
correction notice was left on the final plumbing and no Certificate of Occupancy has been issued

PRS-033032 — 15725 Mary Avenue was issued on June 9, 2003. This permit is current and expires in
December, 2003.
PRS-033040—4925 County Road 83 was issued on July 16, 2003. Setbacks and footings inspections were
approved on July 21, 2003. This permit is current and expires in January 2004.
PRN-033060 — This property is in the flood plain and is on hold pending approval of a Flood Hazard
Development Permit.
PRN-033062—24631 Railroad Street. This permit has been approved but has not been issued. The balance
due is $2,227.00.
To avoid any further violation action, please complete all permits-that are not current in the next 30 days.As
you are well aware, according to the Weld County Code, manufactured home permits expire in 180 days. In
the future, I would appreciate communication from your office, prior to the expiration date, if this cannot be

It has been determined that the property located at 3500 35 Ave,#68 is currently in violation of the following
Section(s) of the Weld County Code:
Section 29-8-40 of the Weld County Code states that all permits need to be finaled within 180 days.
To bring your property into compliance with the Weld County Code, final inspections must be completed.
There has been no inspection since March 22, 2001.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;however,
we have no discretion in this matter if you fail to correct this violation. You have 30(thirty)days from March

NOTICE
The applicant,agents and employees shall comply with all the rules,restrictions and requirements of Weld County Zoning and Building Code Ordinances governing
location,construction,demolition and erection of the above proposed work for which this permit is granted.The building Official is authorized to order the immediate
cessation of work at any time a violation of the adopted codes or regulations appears to have occured. Violations of any codes or regulations may result in the revocation
of this permit.
Buildings must conform with the plans as submitted to the Building Inspection Department. Any changes to the plans or lay-out must be approved prior to construction.
Any changes in the use or occupancy of the building must be approved.
It shall be the duty of the property owner or the person doing the work authorized by this permit to notify the Weld County Building Inspection Department that such
work is ready for inspection.
This permit shall expire by limitation and become null and void if the building or work authorized by this permit is not commenced within 180 days from the date this
permit is issued,or if the building or work authorized by this permit is suspended or abandoned at any time after the work is commenced for a period of 180 days. Before
such work can recommence a new permit shall be required and the charge shall be 1/2 the fee under the current Weld County Building Inspection Fee Schedule provided
that such suspension or abandonment has not exceeded five(5)years. When suspension or abandonment has exceeded five(5)years,the permittee shall pay the full
permit fee under the current fee shcedule.
Weld County is not liable for workmanship. Permits are not transferable.
