This Lease/Option to Purchase is made this ;227// day of �ANuanY , 200 3 , between Marcelle L. Geudner, Owner of Land located at 28629 WCR 17 (PT NE 4, SEC 8, Township 5 N, R 67 W of the 6th PM, Weld County, Colorado, Parcel #0957-08000045) and Jess R. Aragon, Lessee. 1 . In consideration of the payment of the lease and the keeping, performing, and observing of the Weld County Zoning Regulations and the Conditions and Agreements by the Lessee, the Owner leases unto the Lessee the Subject Property known as 28629 WCR 17, approximately 4 . 75 acres, more or less, to begin: r on February 1 , 2003, and end on January 31 , 2005. The total amount of the lease for the term shall be $17, 400. 00, with equal monthly payments of $725. 00, payable in advance, for the term of the lease, the first installment being due on February 1 , 2003, and hereafter on the first day of each calendar month of the term to Marcelle L. Geudner, at 7454 So. Depew St. , Littleton, Colorado 80128-7010. If rent is not paid by the 5th of the month, Lessee agrees to pay a late charge of $25. 00 for every 10 days late. Lessee has an Option to Purchase aforementioned property during the term of this lease for $150, 000, with 30% of amount paid on lease to apply toward purchase price. Conditions and Agreements by Lessee 2 . Lessee agrees to comply with Zoning Board regulations required by Weld County for his use of this property, or must resolve any problems 2003-2428 P. 2 that arise with his use of the Property with the Zoning Commission of Weld County. If Lessee does not resolve said problem in a timely fashion set by Weld County, this Lease will be terminated. 3 . Lessee agrees the Owner is allowed to store motor home, boat, trailer, car, and truck on said property during the term of this lease. 4 . Lessee must pay all Utilities. All utilities must be paid up to date by the Lessee and pay all utility transfer fees . Release of Owner Liability THE LESSEE HEREBY RELEASES THE OWNER, HER HEIRS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS AND DAMAGES FOR LOSS OR THEFT OF LESSEE 'S PERSONALTY AND/OR WHICH MAY ARISE OUT OF ANY ACCIDENTS OF INJURIES TO LESSEE, MEMBERS OF HIS FAMILY, OR GUESTS, THAT MAY OCCUR �^ IN CONNECTION WITH THE USE OF THE PREMISES AND LESSEE HEREBY ASSUMES FOR HIMSELF, MEMBERS OF HIS FAMILY AND HIS GUESTS, ANY AND ALL RISKS FROM ANY ACCIDENTS IN CONNECTION WITH THE PREMISES. LESSEE AGREES THAT OWNER SHALL NOT BE LIABLE FOR ANY INJURY SUSTAINED BY LESSEE OR ANY OF SUCH PERSONS IN CONNECTION WITH USE OF ANY OF THE PREMISES. LESSEE WILL ADD OWNER OF LAND AS AN ADDITIONAL NAMED INSURED TO ALL LIABILITY INSURANCE POLICIES FOR HIS ENTERPRISE, PRIOR TO OCCUPYING. INSURANCE MUST BE MAINTAINED FOR AT LEAST $1 , 000, 000 LIABILITY. Subletting 5. No subleasing is allowed, unless a written agreement is made beforehand with the Owner and no assignment of any part of the premises may be done without the Owner 's consent endorsed in writing. Holdover Tenancy 6. If after termination of this Lease, Lessee shall remain on the P. 3 premises without exercising his Option to Purchase, then such holding-over shall be deemed to be a month-to-month tenancy at a monthly rate of $800. 00, or an amount to be determined and agreed upon by the Owner and the Lessee and endorsed in writing. 7 . Should any part of this Lease be found to be illegal or in violation of Public Policy or for any other reason unenforceable by Law, such finding shall in no event invalidate the other Parts of this Lease.
