Explain, in detail, the proposed use of the property. 67 acres of the 77 acre parcel will remain in the Conservation Reserve Program (CRP). Except for noxious weed removal and wildlife habitat plantings, this acreage will remain undisturbed. The remaining 10 acres of property would have two buildings. The 5500 square foot building would contain the primary residence of the property owner, Heather Weir, and house greyhound dogs awaiting adoption into homes. The dogs are obtained from the greyhound racing industry when they are not wanted anymore. They are housed long enough to be spayed, neutered, vaccinated, and personality tested. Most dogs would stay approximately two weeks. Dogs needing more extensive medical care or socialization would stay longer. When the dogs are ready to be placed in their adoptive homes, they would be transported to greyhound rescue groups in other states. The number of dogs on the property would generally range from 20 to 30 although the facility would be designed to house up to 60 dogs in case of unusual situations such as breeding farm closures or racetrack closures where a large number of dogs would need to be moved in a short period of time. The majority of the greyhounds would be housed in kennels inside the building with regular supervised turn outs for exercise and elimination throughout the day. A small number of dogs would have access to the outdoors at all times through a dog door. The in-door kennels would house individual greyhounds with bedding and toys. The kennels would be spot-cleaned as necessary with thorough disinfection occurring on a regular basis. The outdoor turn out areas would be sand to allow for adequate drainage and easy clean up. Feces would be picked up at each turnout and disposed of regularly at the landfill. The greyhound rescue operation is a non-profit organization. All labor would be provided by volunteers. The primary caretaker would be the property owner. A secondary caretaker would reside in the modular home on the property. Other volunteers would be involved in short-term projects such as socializing the dogs or helping with veterinary care. These additional volunteers would generally come no more than once or twice a week in groups of 3 or 4 people. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22. In the Weld County Code, Chapter 22, specifically pertaining to agriculture land, there is concern regarding development of prime agriculture land. The proposed use of this land actually continues 67 acres in agricultural use (CRP). The development of the 10 additional acres is in keeping with future agricultural uses. The 5500 square foot building could easily be converted to any number of future agricultural uses. The modular home could be used as a home or easily be removed in the future. The greyhound dogs will not cause any lasting damage to the land which would preclude its future use in agriculture. In relation to Article III of Chapter 22, there will be very little impact on the public facilities and services by the proposed development. There will be minimal people accessing the site even after development so traffic and resulting congestion will not be a problem. In relation to Articles IV and V of Chapter 22, every effort will be made to utilize alternative, environmentally friendly power sources. In addition, landscape materials will be native, drought tolerant, and provide nutritional or habitat value to existing wildlife in the area. Noise from the dogs will be minimal since they will be housed indoors the majority of the time. In summary, the proposed use of the property is in keeping with the intent of Chapter 22 because it does not preclude the future use of this land for production of food and fiber and it will fit well into the agricultural uses surrounding the property. The intent of the land owner is to improve the quality of the land for existing wildlife. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 and the zone district in which it is located. As explained above, the proposed use of the property does not preclude its current or future use as farm land. The value of the land to wildlife will be enhanced through native plantings. The greyhound rescue facility will provide for the greater good of the county by finding appropriate homes for animals which are no longer desired by the greyhound racing industry. The majority of the animals received by the facility will be animals produced by greyhound breeding farms in Weld County. Essentially, the facility will be providing a necessary service to these Weld County breeders so they have a humane option for animals they no longer want. The facility will have minimal impact on the quality of life or agricultural uses of the surrounding properties. As indicated above, the dogs will be indoors most of the time, and there is a significant land buffer between the facility building and the adjacent properties. The facility will have minimal impact on the roads or public services since there will be very few people accessing or residing on the site. 4. What type of uses surround the site? Explain how the proposed use is consistent and compatible with surrounding land uses. The surrounding properties are agricultural. The proposed use of this property is compatible with its agricultural setting in that there will be very little in the way of site development. The vast majority of the parcel will still be agricultural land. The presence of the two buildings and the dogs should not impact the agricultural uses of the adjacent properties. As stated above, the noise generated by the dogs will be minimal since they will be indoors the majority of the time; the traffic will not be significantly increased, and any waste generated by the dogs will be removed regularly to prevent odor problems. 5. Describe, in detail, the following: a. How many people will use the site? The majority of the time, two people will reside on the property to care for the dogs. They will access the site regularly. In addition, other volunteers may access the site sporadically to assist in the care of the dogs. These volunteers would likely come no more than once or twice a week and be 3 or 4 people at a time. b. How many employees are proposed to be employed at this site? None. All work is done by volunteers. c. What are the hours of operation? The dogs will be cared for 24 hours/day, but there will be no interaction with the public, so essentially no "hours of operation". Adoptions of dogs will NOT be performed at the site. d. What type and how many structures will be erected (built) on this site? A 5500 square foot steel building will house the property owner and the greyhound dogs. A 1600 square foot modular home will house an additional volunteer. e. What type and how many animals, if any, will be on this site? There would be approximately 20 to 30 dogs under normal circumstances although this number could range as high as 60. There would be 5 to 10 cats. f. What kind (type, size, weight) of vehicles will access this site and how often? There would be normal passenger car traffic by the property owner and additional volunteer on a daily basis. Additional volunteers would access the site once or twice per week in normal passenger cars. A full size Ford van (approximately 12,0001bs) would access the site regularly for transport of the dogs. There would be limited access (approximately once per month)by a passenger bus of approximately 20,000 lbs. This would be used to transport the dogs out of state. g. Who will provide fire protection to the site? Nunn fire. h. What is the water source on the property? (Both domestic and irrigation). A domestic well permit has been obtained. In discussions with water resources in Greeley, it was determined that this would be appropriate for the proposed use. (Existing and proposed). A permit for the septic system has been submitted to the Department of Health and Environment. An engineered septic tank and leach field has been proposed. There is no existing sewage disposal system. j. If storage or warehousing is proposed,what type of items will be stored? No storage or warehousing is proposed. 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal. A three or four row windbreak will be planted to the west of the access road and wrap around the north side of the modular home. Native, drought-tolerant trees and shrubs will comprise the windbreak. A planting of native shrubs will be placed to the west of the steel building. A small amount of grass will be planted as a lawn just north of the modular home and at the southeast corner of the steel building. Other small plantings of native shrubs and trees will be placed throughout the 77 acres for wildlife habitat. 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. Not applicable. The site will not be polluted or damaged in such a way as to require reclamation procedures. 8. Explain how the storm water drainage will be handled on the site. The rain water from the roofs will be collected into gutters and piped away from the buildings for collection as irrigation water or allowed to drain into the soil. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. Construction will commence as soon as approval is received regarding this Use by Special Review Application. Construction should be completed within 6 months. 10. Explain where storage and/or stockpile of wastes will occur on this site. Not applicable. There will be no storage or stockpile of wastes on the site. I am sending copies of the letters I sent to the mineral owners. I have since spoken with Chris Greneaux of Kerr-McGee and he said his company no longer has a lease on the land I own. I have also spoken with Molly Summerville of Anadarko and she said they have no objections to the USR. I have spoken with Diane in the Farm Services Bureau (CRP office) and she said that the driveway can be moved 300 feet to the east as it is indicated on the USR as long as no construction had been started. No construction has started at this point. The driveway has been staked approximately 300 feet from the west property line and the CRP office will re-map it to correct their records. 1 have left a message for Nunn Fire regarding the width of the driveway, but have not received a response.
