RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 485 - TIMOTHY AND MARILYN THISSEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public meeting held on the 4th day of March, 1981 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 485 , being the property of Timothy and Marilyn Thissen, described as part of Section 36 , Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more parti- cularly described as follows , does not come within the purview of the definition of the terms, "subdivision" and "subdivided land, " pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended: The Northwest Quarter of the Southeast Quar- ter of Section 36, Township 6 North, Range 66 West of the Sixth Principal Meridian, Weld County, Colorado, excepting therefrom those portions platted as Pulliam Subdivision and Pulliam Subdivision, Second Filing, also except parcel as conveyed by deed recorded in Book 1564 at Page 173 , Reception Number 1335774 , Weld County records. WHEREAS, the Board of County Commissioners of Weld County, Colorado finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definitions of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-1A(3) of the Weld County Subdivision Regulations . NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove described parcel of land owned by Timothy and Marilyn Thissen be, and hereby is, exempt from the definition of the terms "subdivision" and "sub- /, 810560 divided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended subject to the following: 1. The applicant working with the Department of Plan- ning Services Staff to locate the house such that it would not interfere with efficient residential development in the future. 2 . The applicant amending the plat to show the following: a. A note shall be placed on the plat to read "there shall be no additional accesses to North 25th Avenue of 'F ' Street for the new residence. " b. A total of 50 feet of right-of-way shall be reserved along the north side of "F" Street and 50 feet of right-of-way shall be reserved along the west side of North 25th Avenue. COLORADO Board of County Commissioners Weld County, Colorado 915 10th Street Greeley, Colorado 80631 Re: Recorded Exemption #392 Dear Commissioners: The attached application, plat, and related items are in reference to a request from Timothy and Marilyn Thissen for a recorded exemption. The parcel of land on which this request has been made is described as part of the NWT SE4, Section 36, T6N, R66W of the 6th P.M. , Weld County, Colorado. This property is located at 715 North 25th Avenue, Greeley, Colorado. The property contains approximately 11.781 acres of nonirrigated soils. The request is to split the property into parcels of 7.594 acres and 4.187 acres. Mr. and Mrs. Thissen wish to sell the improvements area of the property. They will retain own- ership of the 7.594 acre parcel in order to build a new house on the property. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the re- quest be approved for the following reasons: 1. The request is in compliance with the policies of the Weld County Comprehensive Plan in that to minimize conflicting land uses, residential development will be encouraged to locate adjacent to existing towns. This parcel of land is located within the comprehensive plan area of the City of Greeley. The City of Greeley, however, recommended denial on this request. The City of Greeley feels that this re- quest would result in inefficient urban development. Develop- ment on a large lot basis inhibits integration of the lots into an urban area because of the difficulty of extending water and sewer services into those areas. 810568 Board of County Commissioners March 4, 1981 Page 2 With regard to the above comments, the Department of Planning Services Staff feels that the larger lot is not inconsistent with existing residential development in the area. Further- more, an additional residence does not necessarily preclude further conventional residential development of Lot A in the future. The Department of Planning Services Staff has in- cluded in the packet two approaches to future development which would also allow a new residence to be built on the parcel at this time. 2. For the reasons discussed above, the request is in compliance with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regulations) . Said clause states: "The intent in establishing the recorded exemption procedure is to provide, in accordance with the Weld County Comprehensive Plan, a means whereby nonproductive agricultural lands may be developed for higher and more productive uses insofar as such uses are compatible with surrounding agricultural uses in areas where land divisions are proposed (Rev. 4-17-74) ." The residential use of this parcel is in compliance with the in- tent clause of the recorded exemption procedure because said parcel does not contain prime agricultural land and is located within the comprehensive plan area of the City of Greeley. The residential use would appear to be compatible with surrounding agricultural uses. 3. The request complies with Section 9.4.A of the Weld County Sub- division Regulations. The Department of Planning Services Staff recommendation for approval is conditional upon the following: 1. The current economic situation has encouraged me to request this exemption. Upon selling the parcel with the house and buildings I would be able to build my own Arouse, or renovate a house, that would be moved onto this landland be released of a large financial burden. I have been associated with the construction business for the last ten years. With this experience the feasibility of building or renovating an older home would cut costs considerably due to my background. The house we now live in was in terrible shape when we purchased it. There was one window left intact out of eighteen, the walls were falling off, and it was inhabited by every known fur hearing creature that exists. With a lot of work and patience my wife and I have a nice, livable home, in which the bank is the major stockholder. My point is to show that we have built up considerable equity inabling us to sell this home and create a new home without paying interest with my hard earned money. After talking to the city commission, they disclosed their ideas about future city plans. The views I received presented one major concern, that the parcel would be split in such a way that future development might be hindered. Therefore, my plans would be to divide the parcel between already developed land, (house, barn, buildings, etc. ), and the largest parcel left as undeveloped raw land, with the homesite planned in such a way as not to inhibit future development. The access road from my homesite would lead onto 28th. Ave. , eliminating direct traffic onto the proposed arterial road, F St. , and future developers also could direct traffic onto avenues and not create many singular approaches onto the arterial. Throughout this explanation, from information I have gathered, I've tried to co-operate fully with the ideas and plans received from both the city and county. If I have assumed or not understood the wishes of either commission, I would welcome suggestions and plans not accounted for here. This whole idea of a recorded exemption is based on a financial need. My wife and I see a way of becoming financially solvent in the furure, and would sincerely appreciate your help.
