RESOLUTION
A RESOLUTION CREATING WELD COUNTY LOCAL IMPROVEMENT
DISTRICT 1984-1, IN THE COUNTY OF WELD, COLORADO,
ORDERING THE CONSTRUCTION AND INSTALLATION THEREIN OF
STREET IMPROVEMENTS TO INCLUDE COMPACTION, GRADING,
GRAVEL, CULVERTS, GUARD RAILS, SIGNS AND DELINEATORS,
TOGETHER WITH ANY NECESSARY INCIDENTALS, ON CERTAIN
STREETS THEREIN; PROVIDING FOR THE ISSUANCE OF BONDS IN
PAYMENT FOR SAID IMPROVEMENTS; AND PROVIDING FOR OTHER
DETAILS IN CONNECTION WITH THE DISTRICT.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to the Laws of the State of Colorado, hereby
finds and determines that there exists a necessity for the
creation of a Local Improvement District within Weld County, to
be designated as Weld County Local Improvement District No.
1984-1, and the construction and installation therein of certain
improvements; and
WHEREAS, Notice of a public hearing concerning the creation
of the District and the construction and installation of the
improvements therein has been given by publication in one issue
of the La Salle Leader, a newspaper of general circulation in the
County, not less than 30 days prior to the date of hearing, and
in addition, notice was delivered or mailed by first-class mail
to each property owner within the proposed district not less than
10 days prior to the hearing; and
WHEREAS, at the time and place set forth in the notice, the
Board of County Commissioners met in open session for the purpose
of hearing and considering the objections or protests that might
be made against the proposed district or the improvements to be
constructed or installed; and
WHEREAS, the Board of County Commissioners considered the
protests and objections as presented;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado:

Section 1. Creation of District. That a local improvement
district for the construction and installation of street
improvements to include compaction, grading, gravel, culverts,
guard rails, signs and delineators, together with any necessary
incidentals on certain streets as hereinafter described, is
hereby created and established in accordance with the Laws of the
State of Colorado, and shall be known and designated as "Weld
County Local Improvement District No. 1984-1. " All proceedings
heretofore taken by the Board of County Commissioners and the
County staff, and adopted in connection with the District are
hereby ratified, approved and confirmed. The proposal to create
said District was properly initiated by the Board of County
Commissioners by Resolution adopted January 25, 1984, and Notice
duly given as heretofore stated.
Section 2 . Approval of Engineering Plans . That the
engineer ' s reports , together with all of the details,
specifications, estimates, maps and schedules thereto attached or
appended, are hereby approved and adopted.
Section 3 . Boundary of District. The area to be included
within the District is indicated on Exhibit A attached hereto and
made a part hereof . The area to be assessed with the cost of
improvements consists of property owned by Colorado Landfill,
Inc . (the Company) described and indicated on Exhibit B attached
hereto and made a part hereof; said property of the Company is a
portion of the total area to be included within the District, but
will be specially benefitted and, therefore, assessed the total
cost of the improvements as set forth in the findings and
determinations of the Board of County Commissioners in Section 9
hereof .
Section 4 . Description of Improvements . The improvements
to be constructed in the District as as follows :

The construction of two miles of paved highway on
Weld County Road No. 5 between Colorado State Highway
No. 7 and Weld County Road No. 6. The improvements
include grading, drainage, paving and other
appurtenances .
Included in this project is the widening and
paving of approximately one-half mile of Colorado State
Highway No. 7 at the south terminus of Weld County Road
No. 5 mentioned above . At the north terminus of the
above mentioned Weld County Road No. 5, Weld County
Road No. 6 will be reshaped and paved for approximately
0 . 3 miles in length.
The major construction quantities include
approximately 55, 000 cubic yards of earthwork, 29, 000
tons of crushed rock base, 59, 000 tons of pit run
gravel, 8, 350 tons of hot bituminous pavement and
miscellaneous drainage structures and fencing.
Section 5. Improvements Authorized. The construction and
installation of the improvements in and for the District, as
shown by the plans, specifications and maps thereof, prepared by
the engineer and approved by the Board of County Commissioners of
Weld County and now on file in the office of the County Clerk and
Recorder, be and the same is hereby authorized and ordered, the
materials to be used in the construction of said improvements to
be in accordance with such maps, plans and specifications .
Section 6. Cost of Improvements . The probable total cost
of the improvements is approximately $1, 100, 000 excluding 6%
additional for the costs of inspection, collection and other
incidentals and also excluding interest on any bonds to the time
of the first installment made payable. The method of assessment
of cost shall be in accordance with the Resolution passed by the
Board of County Commissioners on January 25, 1984 .
Section 7 . Payment of Assessments . The assessments will be
due and payable without demand within thirty (30) days from and
after the publication of the resolution or ordinance assessing
the whole cost of said improvements, in excess of the County
contribution, against the real property described in Exhibit B
attached hereto. In the event any owner of real estate shall
fail to pay the whole of such assessment against his or her
property within said 30 days, then the whole cost of the

improvements so assessed against such property shall be payable
in not more than twenty (20) equal annual installments of
principal. The first of said installments of assessments shall
be due and payable at such time as will be indicated in the
assessing resolution or ordinance and the remainder of the annual
installments of assessments and semiannual payments of interest
shall be due and payable successively on the same day in each
year thereafter until all are paid in full . The rate of interest
to be paid on unpaid and deferred installments will be
established at a rate not to exceed 14 . 00% per annum by
resolution or ordinance to be adopted by the Board of County
Commissioners at a later date.
Section 8. Local Improvement Bonds . By virtue of and
pursuant to the Laws of the State of Colorado, local improvement
bonds of the County shall be issued for the purpose of paying for
the local improvements described in this Resolution, in an amount
not to exceed the cost and expenses of said improvements,
including engineering, legal and incidental expenses, as provided
by law. The bonds shall be issued based upon estimates approved
by the Board of County Commissioners, and as authorized by an
ordinance to be passed by the Board at a later date. The maximum
net effective interest rate of the local improvement bonds for
Weld County Local Improvement District No. 1984-1 shall not
exceed fourteen per centum (14 . 00%) per annum. The bonds and the
interest thereon shall be payable out of special assessments to
be levied against the real property included within the District
and specially benefitted by the improvements to be constructed
and installed. The ordinance authorizing the issuance of the
bonds shall provide that whenever three-fourths of the bonds for
the improvements authorized herein have been paid and cancelled
and for any reason the remaining assessments are not paid in time
to pay the remaining bonds for the District and the interest due
thereon, the County shall pay the bonds when due and the interest
due thereon and shall reimburse itself by collecting the unpaid
assessments due the District.

Section 9 . Special and General Benefits . The Board of
County Commissioners hereby finds and determines that the
improvements proposed to be constructed and installed will confer
general benefit upon the County and the inhabitants and residents
thereof by constructing an improved Weld County Road 5 capable of
handling heavy truck traffic so as to limit traffic on the
southern two (2 ) miles of Weld County Road 7 and reducing traffic
hazard to persons living along Weld County Road 7 and the damage
to the currently improved surface of said road, and, pursuant to
C.R. S. 30-20-606, that the property of Colorado Landfill, Inc.
described in Exhibit B attached hereto, will specially benefit
from the proposed improvements based on the following facts :
a. The market value of the property will
increase; and
b. The proposed improvements will adapt the
property to a more profitable use; and
c . The proposed improvements will facilitate
access to the property of the Company described in
Exhibit B attached hereto and thereby increase the
convenience of use of said property.
Section 10. Repealer. All resolutions, ordinances or parts
thereof in conflict herewith are hereby repealed.
Section 11. Recording. That this Resolution, immediately
upon its passage, shall be recorded in the Book of Resolutions of
the County kept for that purpose and shall be authenticated by
the signatures of the Chairman of the Board of County
Commissioners and the County Clerk and Recorder.

HEARING CERTIFICATION DOCKET NO. 84-4
RE: LOCAL IMPROVEMENT DISTRICT 1984-1, STREET IMPROVEMENTS
A public hearing was conducted on February 29 , 1984, at 2:00 P.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 25, 1984, and duly
published in the La Salle Leader on January 26, 1984, a public hearing was
held to consider the creation of Local Improvement District 1984-1. Lee
Morrison, Assistant County Attorney, made this of record. He said that notice
of this matter was previously made, for courtesy purposes, in the Longmont
Tines Call on February 2, 1984. Mr. Morrison said that the purpose of the
Tonal Improvement District is the construction of two miles of paved highway
on Weld County Road #5, between. Colorado State Highway 7 and Weld County Road
#6. The improvements would include grading, drainage,. paving and other appur-
tenances. The widening and paving of approximately one-half mile of Colorado
State Highway 7at the south terminus of Weld County Road #5, at the north terminus
of Weld County Road #5, reshaping and paving of Weld County Road 06 for
approximately 0.3 miles in length, are to be included in this project. Mr.
Morrison said that in addition to the Resolution of the Board which initiated
this project on January 25, 1984, the other available information is_ the
engineering plans which were filed on that date with the office of the Clerk
to the Board. Mr. Morrison said that there are various aspects concerning
this matter, including engineering and financing. He said the landowner would
be assessed the entire cost as being specially benefitted. Brad Keirnes,
applicant, came forward and explained why he feels the District should be created.
Mr. Keirnes, who is president of Colorado Landfill, Inc. , said one of the major
considerations for a sanitary landfill is that efficient access must be pro-
vided. Mr. Keirnes listed several reasons which he felt supported the creation
of this District. Included in those reasons were: need for better access,
removing traffic from Weld County Road #5, beneficial to area residents in
reaching other roads and entire access will be paved. Jeff LeDoux, Engineer
with Nelson Engineers, came forward to explain the proposed improvements.
Mr. LeDoux said that there is a gun club located in this area. He said
improvements are being made on that property for safety purposes. Mr. LeDoux
said the shooting range will be placed so that it will he below the level
of the road so that it will be almost impossible for a shot to hit the traffic.
He said the design of the road will be four inches of asphalt, eight inches
base course and sixteen inches of pit-run. He said this heavy duty road is
due to the size of the trucks using this road and the soil conditions in this
area. Mr. Morrison asked if the applicants objected to paying the special
assessment. Brad Kiernes answered in the negative, saying they agree to the
assessment 100%. Don Warden, Director of Finance and Administration, said
that on the financing of this project, there will be a contribution from the
Solid Waste Fund, which gains its resources from a 5% surcharge to the land-
fills within Weld County, to contribute to the degree of approximately
$175,000. This is equivalent to putting in a base County road, without the
upgrades that are of special benefit. Mr. Warden commented on the bonding
requirement and said it would not be an obligation of Weld County in any way,
but would be a Revenue type bond to be paid by the landowner. Erick Stowe,
Bond Counsel, cane forward and said it is felt that this project is very
feasible. Brad:Keirnes again came forward to offer additional comments.

Mr. Keirnes said Weld County will benefit by gaining two miles of heavy duty
road at no cost. Chairman N. Carlson said he felt the biggest gain is getting
the heavy traffic off of Weld County Road #7 and `onto County Road #5. The
Chairman then read the title of the Resolution'as' follows: "A-Resolution
Creating Weld County Local Improvement District 19;84-1, in the County of Weld,
Colorado, Ordering the Construction and Installation: therein of Street Improve-
ments to Include Compaction, Grading, Gravel, Culverts, Guard Rails, Signs
and Delineators, Together With Any Necessary Incidentals, on Certain Streets
Therein; Providing for the Issuance of Bonds in Payment for Said Improvements;
and Providing for Other Details in Connection With the District." Blanche
Dietz, surrounding property owner, cane forward to offer comments to the
Board. She said the eighty foot right-of-way will be'`taken from her.property.
She questioned Why-forty feet were not being taken` froth the gun club. She
said her property is very good wheat land. She said she feels she should be
offered rrore for her property. Ms. Dietz said her main objection to this
proposal is that the entire eighty feet are being taken from her property.
She asked questions of Mt. Warden regarding the Revenue Bonds. She asked
whether these ironies were 'County ironies. Mr.HWarden ecplained that this is
County money that is paid' into a special'reven'ue fund as per State statute
and an Ordinance passed by the Board in 1981. 'He sai'dithis 'fund had to be
used solely for the mitigation of problems created"by landfills, such as
access and environmental problems. He said this'project does meet that
qualification. This is not taxpayer money, this money actually comes from
landfill operations: Ms. Dietz again voiced cor`icerns regarding the eighty
feet coming from her property'and' the amount she is being-tottered. Mr. Morrison
said that Ms Dietz 'is now represented by Counsel 'and 'negotiations are being
ubtked' on at this point: `Brad' Keirnes responded to MS: Dietz' concerns. He
said that it had been determined that the property owned by the gun club was
a higher use than on her` property. He said that the gun club had agrccd to
move the rifle range further from the road and lowerit'below the existing
grade of the ground. Brad Keirnes also said' he felt the advantage to
surrounding property owners is that they'will be gaining frontage. Mr. Keirnes
commented further on the gun club. Mr. LeDoux said that the gun club had
agreed to eliminate their trap shooting facility for the safety of the traffic.
Mr. Morrison said the proposed Resolution, Which the Chairman had introduced,
by title earlier, is consistent with the initiating Resolution. He said this
Resolution would create the Weld County Local: LmprOveMent District #1984-1 and
find that the proceedings were properly initiated and'barried out in accordance
with statute, that the engineering plans would be approved and adopted, in-
cluding the alignment as proposed, that the boundary of'the District would
be as proposed in the initiating Resolution, that being the eighty foot right-
of-way, and an additi.onal' area on County Road 46 headed west and the entire
area of the landfill, so that when the County acgUires the property there
would be only two property owners within this Local Improvement District,
Weld County and the Colorado Landfill, Inc. Mr: Morrison said the Resolution would
authorize that the aiiprovements, which were listed by Mr: LeDoux, take place, •
that they be financed out of the Special'Assessment and that the cost would
be 1.1 million dollars; excluding additional costs' for inspection, collection
and other incidentals. He said the 1.1 million dollars is an absolute cap,
hopefully it 'will be less. He said this Resolution' would provide for financing
by Local :Improvement Bonds and provide for the recording and repeal of any-
thing in conflict with this Resolution. The Chairman asked if this 1.1 million
dollars includes the acquisition of the propety 'and 'the construction of the
roads. Mr. Morrison answered in the affirmative."Coiccnissioner C. Carlson

d on this proposal and said that he feels these improvements will be
an asset to the County. Commissioner C. Carlson then moved to accept Docket
#84-4, Local 'Improvement District 1984-1. Comnissioner'Johnson seconded the
motion which carried.unanimously.
Mr: Warden said that in'conjunction with this matter the Board must create
County Road #5 Special Assessment and Debt Service Fund to handle the
bonding'which is required for the Treasurer. Commissioner C. Carlson moved

OF A PROPOSITION TO CREATE A LOCAL IMPROVE-
MENT DISTRICT IN WELD COUNTY, COLORADO, TO BE
KNOWN AS WELD COUNTY LOCAL IMPROVEMENT
DISTRICT NO. 1984-1 , FOR THE PURPOSE OF
CONSTRUCTING AND INSTALLING STREET IMPROVE-
MENTS TO INCLUDE COMPACTION, GRADING, PAVING,
CULVERTS, GUARD RAILS , SIGNS AND DELINEATORS ,
TOGETHER WITH ANY NECESSARY INCIDENTALS, IN
CERTAIN ROADS THEREIN, AND OF A PUBLIC
HEARING THEREON.
All owners of real estate and property hereinafter
described, and all persons generally, are hereby notified that
the Board of County Commissioners of Weld County, Colorado, has
adopted a Resolution declaring its intention to create a local
improvement district within an unincorporated area of Weld
County, Colorado, to be designated as Local Improvement District
No. 1984-1 , for the purpose of constructing and installing street
improvements to include compaction, grading, paving, culverts ,
guard rails , signs and delineators, together with any necessary
incidentals , and to assess the cost of the improvements, in
excess of the County contribution, against the property specifi-
cally benefited by the improvements, all in accordance with the
laws of the State of Colorado.
1 . All persons are further notified that the kind of
improvements proposed and the streets to be improved are as
follows:
Weld County, Colorado, plans to con-
struct two miles of paved highway on Weld
County Road No. 5 between Colorado State
Highway No. 7 and Weld County Road No. 6 .
The improvements include grading, drainage,
paving and other appurtenances.
Included in this project is the widening
and paving of approximately one-half mile of
Colorado State Highway No. 7 at the south
terminus of Weld County Road No. 5 mentioned
above. At the north terminus of the above
mentioned Weld County Road No. 5 , Weld County
Road No. 6 will be reshaped and paved for
approximately 0 . 3 miles in length.
The major construction quantities
include approximately 55,000 cubic yards of
earthwork, 29 ,000 tons of crushed rock base,
59 ,000 tons of pit run gravel, 8 ,350 tons of
hot bituminous pavement and miscellaneous
drainage structures and fencing.

2 . The area to be included within the district includes
the area indicated in Exhibit "I , " attached hereto and made a
part hereof. Based on findings and determinations of the Board
of County Commissioners, the property described in Exhibit "II, "
attached hereto and made a part hereof, is to be specially
benefitted by and shall be assessed with the entire cost of the
improvements.
3 . The assessments for said improvements may be paid in
annual installments towards principal and semi-annual payments
towards interest in such time and at a rate to be determined by
the Board of County Commissioners in the assessing resolution or
ordinance but not to exceed twenty (20) installments at a maximum
rate not to exceed 14 . 00% per annum.
4 . The assessments will be due and payable without demand
within thirty (30) days from and after the final publication of a
resolution or ordinance assessing the cost of said improvements ,
in excess of the County contribution, against the real property
described in Exhibit "II , " attached hereto. In the event any
owner of real property shall fail to pay the whole of such
assessment against his or her property within said thirty (30)
days, then the whole cost of the improvements so assessed against
such property shall be payable in not more than twenty (20)
equal, annual installments of principal, as aforesaid. The first
of such installments of assessments shall be due and payable at
such time as may be determined in and by the assessing resolution
or ordinance and the remainder of said installments shall be due
and payable successively on the same day in each year thereafter,
unless otherwise determined by the Board of County Commissioners,
until all are paid in full.
5 . As shown by the estimates of the Engineer, the total
cost of the street improvements will not exceed $1 ,100 ,000 . The
Board of County Commissioners, pursuant to CRS , 30-20-606 , has
found and determined that the property of Colorado Landfill ,
Inc. , (the Company) described in Exhibit "II , " attached hereto,

will specially benefit from the proposed improvements based on
the following facts:
a. The market value of the property will increase;
and
b. The proposed improvements will adapt the property
to a more profitable use; and
c. The proposed improvements will facilitate access
to the property of the Company described in Exhibit "II , "
attached hereto and thereby increase the convenience of use
of said property.
Based on the findings and determinations of the Board of
County Commissioners, it is intended that all of the costs of the
street improvements, in excess of the County contribution, will
be assessed against the property of the Company described in
Exhibit "II , " attached hereto.
Property owners are specifically referred to the schedule of
estimated proposed assessments on file in the Office of the
County Clerk from which the approximate amount to be assessed
against any particular lot or parcel of property may be deter-
mined.
6 . It is anticipated that special assessment bonds will be
issued for the purpose of paying the cost of improvements not
being paid by Weld County; the bonds would be payable out of the
monies collected on account of the assessments made for said
improvements.
7 . Upon completion of said improvements, or as soon as the
total cost thereof is definitely ascertained, the cost, in excess
of the County contribution, of the improvements shall be appor-
tioned to the property of the Company in the District. Notice of
such apportionment shall be given and a hearing will be held
prior to the adoption of a resolution or ordinance assessing such
cost, all as provided by law.
8 . Not less than thirty (30) days after the publication of
this Notice, a resolution authorizing said improvements will be
considered by the Board of County Commissioners, to-wit:

February 29 , 1984 , at 2 : 00 p.m. , or at an adjourned meeting
thereafter, in the meeting room of the Weld Centennial Center,
915 Tenth Street, Greeley, Colorado.
9 . A map, estimate, and schedule showing the approximate
amount to be assessed and all resolutions and proceedings are on
file and can be seen and seen and examined by any person at the
office of the Clerk to the Board of County Commissioners at any
time during business hours on or before the date referred to in
paragraph 10 .
10 . All complaints and objections that may be made in
writing concerning the proposed improvements by the owner or
owners of any real property to be assessed will be heard and
determined by the Board of County Commissioners at the meeting
specified above, or at some adjournment thereof, before final
action shall be taken.
11 . It is anticipated that Weld County will pay, from the
Solid Waste Disposal Sites and Facilities Fund, the costs of
condemning or otherwise acquiring rights-of-way for the proposed
street improvements and an additional amount towards the improve-
ments not to exceed $175 , 000 total.
All estimates exclude 6% for inspection, collection and
incidentals and interest as provided by law.
