HomeMy WebLinkAbout20031578.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT #1427 FOR A USE PERMITTED AS A USE BY RIGHT, AN ACCESSORY USE, OR A USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (WOOD PALLET BUSINESS) IN THE A (AGRICULTURAL) ZONE DISTRICT - MANUEL AND ANITA SANCHEZ AND MAURILIO NAVARRO, C/O RITO GALLARDO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board of County Commissioners held a public hearing on the 16th day of July, 2003, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Manuel and Anita Sanchez, 19920 Weld County Road 52,LaSalle,Colorado 80645, and Maurilio Navarro,3024 11th Avenue, Evans,Colorado 80620,for a Site Specific Development Plan and Use by Special Review Permit#1427 fora Use Permitted as a Use by Right,an Accessory Use, or a Use by Special Review in the Commercial or Industrial Zone Districts (wood pallet business) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the N1/2 NE1/4 of Section 32, Township 5 North, Range 65 West of the 6th P.M.,Weld County, Colorado WHEREAS,said applicant was represented byRito Gallardo,527 East 24th Street,Greeley, Colorado 80631, at said hearing, and WHEREAS, Section 23-2-230 of the Weld County Code provides standards for review of said Use by Special Review Permit, and WHEREAS, pursuant to the Weld County Home Rule Charter,Article 3, Section 3-13, the concurrence of three of the members of the Board is required to approve a Resolution, and WHEREAS,the motion to approve said application received only two votes and therefore failed; the effect of the failure to obtain a majority vote is a denial of the motion. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that the application of Manuel and Anita Sanchez and Maurilio Navarro for a Site Specific Development Plan and Use by Special Review Permit#1427 fora Use Permitted as a Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or Industrial Zone Districts(wood pallet business)in the A(Agricultural)Zone District on the parcel of land described above be, and hereby is, deemed denied for the following reasons: 1. It is the opinion of the Board of County Commissioners that the applicant has not shown compliance with Section 23-2-230.B of the Weld County Code as follows: 2003-1578 PL0488 SPECIAL REVIEW PERMIT#1427 - MANUEL AND ANITA SANCHEZ AND MARUILIO NAVARRO PAGE 2 A. Section 23-2-230.6.3 -- The uses which will be permitted will not be compatible with the existing surrounding land uses. The surrounding area includes one residence within 30 yards of the proposed permit area. Some of the lots in the Scotch Pine Estate Subdivision are within 500 feet of the proposal and predate the use for pallet manufacturing. The noise and possibility of projectiles from air power nailing guns make this incompatible with the existing neighborhood even with the porposed conditions and development statndards.
