RE: AUTHORIZE WELD COUNTY TREASURER TO ESTABLISH VICTIM ASSISTANCE AND
LAW ENFORCEMENT TRUST FUND
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the District Attorney's Office has requested a new fund be established through
the Weld County Treasurer's Office for the administration of the Victim Assistance and Law
Enforcement (VALE) Trust Fund, and
WHEREAS, the Board of County Commissioners has deemed it advisable to establish an
interest bearing fund to be operated under the oversignt of the VALE Board, with the use of funds
restricted to those purposes specified by State statute for VALE funds.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Victim Assistance and Law Enforcement Trust Fund be, and hereby is,
introduced into the Weld County Accounting system, and that the Weld County Treasurer be, and
hereby is authorized to establish said Fund accordingly.
BE IT FURTHER RESOLVED by the Board that all interest accruing to monies in this fund
shall be deposited in this fund; that the fund be operated under the oversight of the VALE Board;
and that the use of said funds be, and hereby are, restricted to those purposes specified by State
statute for VALE funds.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 5th day of May, A.D., 2003.

As we discussed at the budget meeting this morning, the DA's Victim-Witness Program has two separate
administrative funds, one derived through the Crime Victim Compensation (CVC) Fund and another
sustained by the Victim Assistance and Law Enforcement (VALE) Fund, that we would like to move out of
Judicial accounts and into two distinct (i.e., the CVC and VALE dollars cannot be commingle with each
other or any other funds) County accounts. Furthermore, the use of the dollars in these accounts must
remain under the administrative control of each statutorily designated board, CVC and VALE, and other
existing restrictions need to be retained.
Based on our brief discussion, it was my understanding that the County would be willing to establish
separate CVC and VALE administrative accounts and that these accounts can function in essentially the
same manner as they have operated within the Judicial accounts (e.g., Board oversight, restricted use,
etc.). If this understanding is correct, please notify me when I can begin the initial transfer of accrued
balances to these accounts. Also, please inform me concerning any special procedures (e.g., Banner
account codes, etc.)for making the initial and subsequent account deposits and disbursements. Finally,
due to the timing of board meetings and other considerations, I would like to have things in place in order
to complete this transfer soon.
