Off-site impacts that may be encountered include noise from trucks, tractors and equipment;dust from animal pens and odors from animal confinement, silage, and manure. 8) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural counties in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long- established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment;slow-moving farm vehicles on rural roads;dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure;smoke from ditch burning;flies and mosquitoes; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. • • Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 3. The Windsor Comprehensive Plan High Density Estate Single Family Residential land use depiction is intended to provide for clustered single family residential subdivision development while preserving open space. The application appears to be consistent with the Town's land use depiction as it simply proposes to adjust two property lines between existing lots and does not propose to create any additional new lots. The subject property is also located within the Town's Growth Management Area (GMA), and the Town of Windsor Comprehensive Plan states "The GMA is intended to define those specific areas within the planning area where it is most logical to extend urban services in the near term, that is, within the next five to ten years." Although the subject property is located within die GMA, due to the fact that no new lots are proposed and the existing properties arc low density in nature, the Planning Commission does not recommend that annexation be required at this time. However, an agreement requiring future annexation is recommended as the subject properly is located within the Town's GMA boundary and is in close proximity to the Town's corporate limits. It is probable that the site will become encompassed by the Town in the future. The Town and County should make every attempt to avoid future enclaves of unincorporated county within the corporate limits of the Town. Such enclaves lead to confusion over jurisdictional authority, potential maintenance problems should streets ever be publicly maintained and other general inefficiencies. Therefore, based upon the aforementioned information, the Town of Windsor Planning Commission recommends approval of these amended recorded exemptions subject to the following conditions: 1. The applicant shall dedicate additional right-of-way along the entire length of the south property boundary to bring the north half of WCR 76 up to the Town's Rural Collector standard of sixty feet(60') from centerline (one hundred twenty feet(120') total). raD-cu-cuuo inu uo.cU mu !UWN Ut WINUbUK ?EX NU, y/Ub85Jl8U P. 02 • ' 2. The applicant shall dedicate additional right-of-way along the entire length of the east property boundary to bring the west half of S1 257 up to CDOT's required right-of-way standards, 3. All requirements of the Windsor-Severance Fire Protection District shall be addressed to the District's satisfaction, 4. The applicant shall enter into an annexation agreement with the Town of Windsor prior to recording the recorded exemption plats. Such annexation agreement shall require the subject properties to annex to the Town at such time in the future that the properties become an enclaves as defined by State Statute, with such annexation agreement being recorded with the Weld County Clerk and Recorder. Dear Applicant: Your recorded exemption application is being processed. If the staff determines that the application does not meet the approval criteria or if staff has concerns with the application, staff may elect to forward the application for review to the Board of County Commissioners. You will be notified and asked to appear before the Board of County Commissioners at a public hearing. You will be informed of the hearing date prior to the hearing. The Board of County Commissioners will then consider your application and make a final decision on the recorded exemption. It is the policy of Weld County to refer an application of this nature to any town or municipality lying within three miles of the property in question or if the property under consideration is located within the comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the submitted materials to the Windsor and Severance Planning Commission for their review and comments. It is recommended that you and/or a representative be in attendance at the Windsor and Severance Planning Commission meetings to answer any questions the Commission members may have with respect to your application. Weld County Department of Planning Services Redline Comments Dated: April 7, 2003 From: Kim Ogle, Planner II 1) The notes on all of the Amended Recorded Exemptions have been revised as requested on redlines. 2) The title of all the Amended Recorded Exemptions have been revised as requested on the redlines. 3) The recording information of RE-3251 has been added to the legal descriptions of all the Amended Recorded Exemptions as requested on the redlines. New copies of these Statement of Taxes are attached to this letter. 5) For Amended RE-639 you have a question about the acreage. The acreage on the plat is the acreage as would exist upon the approval of the Amended Recorded Exemption. The acreage shown on the application is the acreage of the existing Lot A of RE-639. 6) For Amended RE-1356 you asked where Lot B of 1356 is located. The land that was originally Lot B of RE-1356 was then divided with Recorded Exemption 3251. I have included a map indicating the location of the original Lot B of 1356. If you have further questions I assume Weld County would have more information regarding the original Lot B of RE-1356. 7) Your final redline comments are to request us to address the Town of Windsor comments dated February 20, 2003. We have already addressed these comments in our response letter dated April 1, 2003. I have included a copy of this letter. As Weld County does not have an Intergovernmental Agreement with Windsor there is no authority for Weld County to enforce Windsor's request for additional Right-of-Way. If, at some time in the future, Windsor or some other jurisdiction needs additional Right-of- Way they can approach the owners of the property to secure additonal Right-of-Way at that time. Also Windsor's request for an annexation agreement is not enforceable by Weld County. State statutes address enclave annexations so there is no need for an annexation agreement. The last round of redline comments from you were sent to King Surveyors, our consulting surveyor, and we had to get them forwarded to us causing us a delay in our project. I would request that all future correspondence relating to these projects be directly to me at the Everitt Companies, as we have been the applicant from the initial submittal. Kim, I sincerely hope you can work it into your schedule to review these mylars and send them to the Clerk and Recorder for recording immediately.
