RE: APPROVE AGREEMENT FOR PRODUCTION OF PHOTO-IDENTIFICATION CARDS
AND AUTHORIZE CHAIR TO SIGN -WELD COUNTY FIRE CHIEFS ASSOCIATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for the Production of
Photo-Identification Cards between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, and the Weld County Fire Chiefs Association,
commencing April 30, 2003, and ending December 31, 2003, with further terms and conditions
being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Agreement for the Production of Photo-Identification Cards
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, and Weld County Fire Chiefs Association be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 30th day of April, A.D., 2003.

AGREEMENT FOR PRODUCTION OF PHOTO-IDENTIFICATION CARDS
THIS AGREEMENT is made and entered into effective as of the.30-4-day of April, 2003,
A.D. between the COUNTY OF WELD, a political subdivision of the STATE OF COLORADO,
whose address is 915 10th Street, P. O. Box 758, Greeley, CO 80632, hereinafter referred to as
"Weld County," and the WELD COUNTY FIRE CHIEFS ASSOCIATION, whose address is 919
7th Street, Greeley, CO 80631, hereinafter referred to as "the Association."
WITNESSETH:
WHEREAS, the Association desires to obtain for its member organizations standardized
photo-identification cards ("photoID's"), and
WHEREAS, Weld County, through its Information Services Department ("IS"), has the
ability to produce such photoID's, for which the Association is willing to pay the entire costs
associated therewith, and
WHEREAS, the parties now desire to enter into this Agreement for the purpose of setting
forth the requirements and duties of each party with respect to the production of the photoID's.
NOW, THEREFORE, in consideration of the mutual promises and covenants contained
herein, the parties hereto agree as follows:
1. PRODUCTION OF PHOTO-IDENTIFICATIONCARDS:Upon the signing of this
Agreement by both parties and the payment of the total project cost of$9,699.80 by
the Association to Weld County as detailed in Paragraph 2,below,Weld County shall
direct IS to produce up to 3,000 photoID's for the Association's member
organizations, in accordance with the requirements set forth in Paragraph 3,below.
The estimated number of 3,000 is based upon having two (2)photoID's per person.
2. PAYMENT OF ESTIMATED TOTAL PROJECT COST: The Association agrees
to pay the estimated total project cost of $9,699.80 to Weld County by May 1,2003,
to pay for the production of up to 3,000 photoID's. The parties agree to review the
number of photoID's actually produced as of December 31, 2003, to determine the
remaining number of the 3,000 photoID's available. The Association may then
determine what portion of the remaining photolD's it desires to have be produced,
and,if any portion of the total estimated project cost amount is unused,what portion
thereof it desires to have returned to the Association. The estimated total project cost
is calculated as follows:
a. Time to create database, templates and card design $1,800.00
(24 hours x $75/hour= $1,800)

b. Time to insert data, photos and print 2 photoID's 6,000.00
per person for 1,200 fire fighters
(80 hours x $75 per hour)
c. Consumable products for 3,000 cards 1,899.80
Box of 500 cards 6 x $36 = $216.00
Ribbons yields 95 cards/roll 33 x $48 = $1,584.00
Printer cleaning kits 4 x $24.95 = $99.80
TOTAL $9,699.80
3. REOUESTS FOR IDENTIFICATION CARDS AND SUPPLYING OF
NECESSARY INFORMATION: The Association will provide to IS, through Mr.
Ripley Casdorph (rCasdorph@co.weld.co.us) a single standardized logo and
standarized text to include on all of the photoID's produced by Weld County.
Member organizations shall not be able to substitute or add their own logos and/or
test to the photoID's. The Association shall also inform its member organizations
that, in order for their personnel to get their photoID's, they will need to provide to
Mr. Casdorph the following information:
a. Name.
b. Position in the member organization.
c. Photo
d. Any other information to complete the text submitted by the Association.
4. TERM: The term of this Agreement shall be from the date of signature hereunder to
and until December 31, 2003, and shall be continued at the desire of the parties for
the term so desired, but may be terminated at anytime by either party upon ten (10)
days written notice. The Association shall be reimbursed any amount of the
estimated total cost left unused, as provided for in Paragraph 2, above.
5. ENTIRE AGREEMENT: This writing constitutes the entire Agreement between the
parties hereto with respect to the subject matter herein, and shall be binding upon
said parties, their officers, employees, agents and assigns and shall inure to the
benefit of the respective survivors, heirs, personal representatives, successors and
assigns of said parties.
6. NO WAIVER OF IMMUNITY: No portion of this Agreement shall be deemed to
constitute a waiver of any immunities the parties or their officers or employees may
possess,nor shall any portion of this Agreement be deemed to have created a duty of

care which did not previously exist with respect to any person not a party to this
Agreement.
7. NO THIRD PARTY BENEFICIARY ENFORCEMENT: It is expressly understood
and agreed that the enforcement of the terms and conditions of this Agreement, and
all rights of action relating to such enforcement, shall be strictly reserved to the
undersigned parties and nothing in this Agreement shall give or allow any claim or
right of action whatsoever by any other person not included in this Agreement. It is
the express intention of the undersigned parties that any entity other than the
undersigned parties receiving services or benefits under this Agreement shall be an
incidental beneficiary only.
8. NOTICE: Any notice to be sent to either party pursuant to this Agreement shall be
sent via First-Class Mail to the following addresses:
