RE: EXPRESSION OF SUPPORT FOR A "NO-OPT-OUT PROVISION" WITHIN THE
INTERGOVERNMENTAL AGREEMENT FOR THE FORMATION OF THE NORTH
FRONT RANGE TRANSPORTATION AUTHORITY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Sections 43-4-601 to 621, C.R.S., and Colorado Constitution Article XIV, Section 18(2)(a), may
enter into an intergovernmental agreement with a combination of other municipalities and
counties to form a transportation authority, and
WHEREAS, by Resolution dated July 8, 2002, the Board affirmed its commitment to
participate in negotiations of an intergovernmental agreement to create the North Front Range
Transportation Authority ("the Authority"), and
WHEREAS, one of the issues presented in such negotiations is a "no-opt-out provision,"
which means that if the registered electors within the proposed boundaries of the Authority vote
to create the Authority, no participating governmental entity may withdraw from such
participation if its registered electors fail to likewise approve the creation, and
WHEREAS, the Board of County Commissioners of Weld County wishes to express its
commitment to the "no-opt-out provision," and encourages the other participating governmental
entities to support the same.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that it expresses its commitment to the inclusion of a "no-opt-out
provision" within the intergovernmental agreement for the formation of the North Front Range
Transportation Authority, with the contents of the "no-opt-out provision" being described above,
and encourages the other participating governmental entities to support the same.
