Comments made during this phase of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. COMMENTS: ❑ The applicant shall submit to Public Works stamped, signed and dated final plat drawings and construction plan drawings for review and approval with the final plat application materials. This is consistent with County Code: Sec. 24-3-50, "The minor subdivision final plat submitted shall contain the original signatures and seals of all parties required." External Roadways: ❑ WCR 100 is classified by the County as a collector road and requires an 80-foot right-of- way. The applicant shall dedicate 40-feet of right-of-way on the final plat. ❑ CR 17 does not exist adjacent to this development along the section line. The applicant shall dedicate 30-feet of right-of-way, along the entire property frontage, measured from the section line for CR 17 on the final plat. ❑ WCR 100 serving this PUD is paved. This development will introduce approximately 70 additional vehicle trips per day to the roadway system. A County traffic count taken May 23, 2002, yielded 673 AADT. The residential traffic added to the roadway system will not have enough impact to require off-site roadway improvements. A traffic study is not required, based on the proposal of limited development and anticipated low traffic impact on surrounding roads. ❑ Additional right-of-way shall be required adjacent to the bus pullout area equivalent to the width of the pullout lane. The Sheriff's Office requests that builders and developers designate an area by the entrance of the sub-division in which to place a shelter for school children awaiting the school bus. This area should also include a pull off for the school bus which enables it to safely load and unload children out of the roadway. This does not appear in the plan map most recently received. The Sheriff's Office also does not find it acceptable to leave the construction of a shelter to a currently non- existent home owners association. 2. The developers have proposes a mail box be placed on each home owner's property. If the post office will approve this, the Sheriff's Office would not object to that plan. 3. The name of the street, "Shire Rd"is approved by the Sheriffs Office. 4. A permanent sign should be placed at the entrances to the sub-division detailing the name of the sub-division and address. It will not be necessary for a graphical presentation of the roadways within the subdivision. The name of the subdivision is still recommended by the sheriffs office regardless of the number of home sites in this development. There should be a plan developed to maintain this sign. Any other recommendations of the Sheriff's Office that were addressed at the change of zone and not currently implemented by the developers should be addressed. The Sheriff s Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. A separate permit will be required for each structure. Permits are required for structures such as bus shelters or entrance gates if provided. 2. A plan review will be required for each building. Two complete sets of plans are required when applying for the permit. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 1997 Uniform Building Code; 1998 International Mechanical Code; 1997 International Plumbing Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Water Division 1,Water District 3 Dear Ms. Lockman: As you may know, the State Engineer's office through a Memorandum dated August 7, 1995 inform the counties that effective August 31, 1995, this office will no longer respond to land use actions that do not involve the subdivision of land as defined in Section 30-28-101(10)(a) C.R.S. (see attached memorandum). These actions include but are not limited to lot line adjustments, zone change request, special use land and division by exemption. This referral does not appear to qualify as a "subdivision". However, review of the submitted material revealed that The Shire proposed PUD appears to qualify as a cluster development. According to Section 30-28-402 C.R.S., a cluster development is a planning process adopted by the county which requires at least two-thirds of the total area of the subject tract to be reserved as open space. For this development, 90 contiguous acres of the 135 acres would be required to be reserved as open space. According to this legislation, if this requirement is met, 6 lots (3 lots plus 3 bonus lots) could be developed on the remaining acreage, with, in accordance with C.R.S. 30-28-404, water supplied by individual on-lot wells which would be permitted to withdraw 1/2 acre-foot annually to serve one single-family dwelling per lot plus outside uses consistent with the amount of water approved. However, please be advised that according to our records approximately 39 acres of the 135-acre parcel are encumbered by the land described in two existing well permits nos. 245975 and 245951. Therefore, the applicants may not use that portion for this development. For the remaining 96 acres, 64 contiguous acres would be required to be reserved as open space and in accordance with C.R.S. 30-28-404, the maximum number of residential lots that could be developed is five. Pursuant to 37-92-602(3)(b)(II)(A) each lot could be supplied by an individual on-lot well which would be permitted to withdraw 0.4 acre-feet annually. If the proposed plan is not modified accordingly this office will not be able to issue well permit for the proposed lots. Department of Public , COLORADO Health and Environment CASE NO.: PZ-1007 NAME: Lance & Julee Meiners/The Shire The Weld County Health Department has reviewed this proposal. The sketch plan submitted was for an8 lot cluster PUD subdivision on 135 acres. For the change of zone application the applicant proposes a 6 lot PUD with 1 non-buildable (40 year) agricultural lot. The Department understands that the proposed PUD was re-configured largely in part to comments from the Division of Water Resources. The six residential lots will range in size from 4 to 6.4 acres and each will be served by an individual well and septic system. The minimum lot size is 4.0 acres with an overall density of one septic system per 22.5 acres does meet current Department policy. The application has satisfied Chapter 27 of the Weld County Code in regard to water and sewer service. The application states the water will be supplied individual wells for Lots 1-6. Based on a referral letter from the Division of Water Resources it appears that the applicant still has some issues to address regarding the number of wells that will be allowable on the property. The application has satisfied Chapter 27 of the Weld County Code in regard to sewer service. Sewer will be provided by individual sewage disposal systems. As stated above, the minimum lot size is 4.0 acres with an overall density of one septic system per 22.5 acres does meet current Department policy. Preliminary information in the geotechnical report was conducted by Earth Engineering (dated December 10, 2001) and submitted in the sketch plan application. This preliminary report indicates that most lots will be suitable for conventional septic systems, with perc rates ranging from 21.1 to 24.7 minutes per inch. Septic systems in some areas may require shallow or engineered systems due to shallow bedrock, identified in boring logs from 4.5 to 7 feet. The Department recommends approval with the following conditions: 1. Water service shall be obtained from individual wells. 2. A Weld County septic permit is required for each proposed septic system, which shall be installed in according to the Weld County individual sewage disposal system regulations. Each septic system shall be designed for site-specific conditions, including, but not limited to: maximum seasonal high groundwater, poor soils, and shallow bedrock. If required, the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 4. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions,at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 5. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. 6. If land development creates more than a 25-acre contiguous disturbance,or exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 7. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat.
