HomeMy WebLinkAbout20030632.tiff RESOLUTION RE: APPROVE APPLICATION TO CONSTRUCT CROSSING SIGNALS AND GATES AT EXISTING GRADE CROSSING OF WELD COUNTY ROAD 13 AND THE GREAT WESTERN RAILWAY COMPANY AND AUTHORIZE CHAIR TO SIGN - PUBLIC UTILITIES COMMISSION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Application to Construct Crossing Signals and Gates at the Existing Grade Crossing of Weld County Road 13 and the Great Western Railway Company between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Public Works Department, and the Public Utilities Commission of the State of Colorado, with terms and conditions being as stated in said application, and WHEREAS, after review, the Board deems it advisable to approve said application, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Application to Construct Crossing Signals and Gates at the Existing Grade Crossing of Weld County Road 13 and the Great Western Railway Company between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Public Works Department, and the Public Utilities Commission of the State of Colorado be, and hereby is, approved. The County presents the following information in support of its application: 1. Weld County is duly established under the laws of the State of Colorado and through its Public Works Department is duly authorized to construct, maintain, and operate roadways in Weld County, Colorado. 2. The address of Weld County Public works Department is 1111 H Street, Greeley, Colorado 80632. The County representative is Frank B. Hempen, Jr., P.E. 3. The requested Project is necessitated: a. because of improvements to Weld County Road 13 which is designated as a major arterial highway. Design speeds along this stretch of roadway are 60 mph and currently the roadway is has a stopped condition at the tracks due to sight restrictions at the railroad; and b. by the continuing development of commercial and residential areas in the vicinity of the Project. 4. Present average daily traffic (ADT) total 1000 vehicles crossing the railroad tracks and l0yr projected traffic volumes exceed 2400 vehicles per day and 20yr projected traffic volumes exceed 4000 vehicles per day. The Railroad has 6-12 trains that cross WCR 13 per week. 5. Said improvements are necessary and proper at this crossing for the service, accommodation, convenience, and safety of the traveling public 6. The scope of the project is to construct flashing light signals and gates, in accordance with the requirements of the Rail/Highway Grade Crossings Protection Specifications of the Association of American Railroads, the specifications of the PUC and the Manual of Uniform Traffic Control Devices, at the existing at-grade crossing. Current protection of the existing crossing is by cross bucks and stop signs. 7. The Railroad is agreeable to the signal installation at the crossing and will furnish and install the automatic flashing light signals, gates, and warning devices by force account. 8. Weld County will pay such costs as to satisfy the County's obligation set forth in paragraph 14 below. 9. Construction commencement of the Project is anticipated to occur in August, 2003. Applicants will be responsible for coordinating with affected utility companies to avoid or resolve any conflicts or concerns they may have. 11. Applicants will be responsible for acquiring all necessary rights of way, licenses or easements. 12. This application is filed under the funding source of Section 130 of Title 23 of the United States Code, the Surface Transportation and Uniform Assistance Act of 1987, and the regulations promulgated thereunder. Weld County has agreed to enter into a contract with the State of Colorado, for the use and benefit of the State Department of Transportation, and the Great Western Railway Company. The contract is pending and when executed will be submitted to the Commission as a late filed exhibit. 14. The costs of the Project will be borne by the Federal Highway Administration at the rate of one hundred percent (100%) and by the County of Weld at the rate of zero percent (0%), up to the allocated Federal Highway Administration's share, all without costs to the State of Colorado. The estimated costs of the Project complied by the Railroad is $163.935.95,which shall be paid as follows: Federal participation funds(100%) $163,935.95 Weld County's participating funds(0%) $ 0.00 Weld County's non-participating funds(3% indirect cost) $ 4,900.00 Total Budgeted Funds $168,835.95 15. The County waives the time limits set forth in 40-6-109.5, section (1) and (2) for this application.
