} 383 RESOLUTION RE: ACTION OF THE BOARD CONCERNING PETITION TO VACATE A PORTION OF RIGHT-OF-WAY ON WELD COUNTY ROAD 16 -SPARBOE HORIZON CORPORATION AND MARGARET RILEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Road Petition from Sparboe Horizon Corporation, 6339 Weld County Road 47, Hudson, Colorado 80642 and Margaret Riley, 19462 Weld County Road 16, Fort Lupton, Colorado 80621, a copy of which is attached hereto and included by reference, requesting vacation of a portion of right-of-way on Weld County Road 6, being more fully described as follows: The public road right-of-way lying 30 feet on either side of the section line between SW 1/4 of Section 29 and the NW1/4 of 32, Township 2 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, the County Attorney's Office indicated that portion of Weld County road right-of-way is not currently needed for the safety and welfare of the traveling public; however, the Department of Public Works recommends retaining the right-of-way to provide options for connectivity in the future, and WHEREAS, the adjoining landowners were mailed ten days notice by the Clerk to the Board of a public hearing set for March 10, 2003, to consider the vacation of that portion of Weld County road right-of-way which is described above, and WHEREAS, the Board of County Commissioners heard testimony, reviewed all other evidence presented therein by staff and the public, and deems it advisable to deny said petition to vacate said portion of Weld County road right-of-way based on the recommendation of Public Works staff. The subject right-of-way is between the SW''A of Section 29 and the NW'/ of Section 32, Township 2 North, Range 65 West of the 6th P.M. It is my understanding that Don Carroll's research indicates there is only 30 feet of right-of-way on the south side of the sectionline. C.R.S. § 43-2-303(2)(a) states the following: "(2)(a)No platted or deeded roadway or part thereof or unplatted or undefined roadway which exists by right of usage shall be vacated so as to leave any land adjoining said roadway without an established public road or private-access easement connecting said land with another established public road." From my review of the Assessor's records, the vacation of this portion of WCR 16 will not "leave any land adjoining said roadway without an established public road or private-access easement connecting said land with another established public road." The only properties that could use this right-of-way for access would be the Sparboe Horizon Corporation properties (130729000035 and 130729000036), the Margaret Riley property (130732000011), and the Red Baron Development LLC property (130730000024). The Riley and Sparboe properties are adjacent to the maintained remaining portion of WCR 16. The Red Baron Development property appears to access WCR 18 via an extension of WCR 397 uce T.
