RE: GRANT REQUEST FROM STEVEN KLEN AND LORI GUTTENSTEIN TO
PRE-ADVERTISE MINOR SUBDIVISION FINAL PLAN, MF #609 - MOOREA MANOR
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has received a request from Steven Klen and Lori Guttenstein, 6909
Shannon Court, Loveland, Colorado 80538, for pre-advertisement of an application for Minor
Subdivision Final Plan, MF #609, for six (6) lots in Moorea Manor, and
WHEREAS, said property is described as Lot A of Recorded Exemption#2812; being part
of the W1/2 of Section 2, Township 2 North, Range 67 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS,after study and review the Board deems it advisable to grant said request, with
the hearing date to be set as April 30, 2003, at 10:00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request from Steven Klen and Lori Guttenstein for pre-advertisement
of Minor Subdivision Final Plan, MF #609, for six (6) lots in Moorea Manor be, and hereby is,
granted.
BE IT FURTHER RESOLVED by the Board that the hearing date to consider said request
be, and hereby is, set as April 30, 2003, at 10:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 7th day of April, A.D., 2003.

COLORADO SUBJECT: Request for Pre-advertisement
Steven Klen and Lori Guttenstein have submitted a request that the application for Minor
Subdivision Final Plan, MF #609, which will be heard by the Planning Commission on April 15,
2003, be pre-advertised. If you wish to approve this request, a hearing before the Board on
April 30, 2003, will allow adequate time for advertising.

SUBJECT: Pre-advertisement for MF-609, Moorea Manor
Mr. Steve Klen is requesting a pre-advertisement for MF-609. Mr. Klen has submitted a letter
outlining delays which they have incurred. Planning Services is recommending approval of this
request.

To Whom It May Concern:
My name is Steve Klen. My wife Lori and I are working on a minor subdivision known as
Moorea Manor, Case#MF609, located in Weld County. We plan to build our home on one of
these lots.
I am writing this letter to request permission for pre-advertisement and to request that the Board
of County Commissioners holds a meeting immediately after or very soon after my April 15, 2003
Planning Commission meeting. I am listing below some of the specific delays I have incurred
through the Weld County process. These delays have caused and continue to cause considerable
hardships on my wife and I. Your approval for these requests will help me finalize my project in a
more timely manner and would be greatly appreciated. I will be attending the meeting requesting
these items to answer or clarify any questions you may have on the reasons I will list.
My initial submittal was approximately 19 months ago. Public Works took approximately five
months to get initial comments back. As I called on a regular basis, I was told by Public Works
that the only way to get something done on this portion of my project was to complain to the
County Commissioners enough so as they would direct Public Works to get this portion finished.
I did not feel that this was an appropriate avenue to take;therefore, I continued calling and
eventually got comments back. My engineer, Jeff Couch of Team Engineering and I promptly
made the changes and got them re-submitted.
Both of our prior Planning Commission and County Commissioner meetings have gone very well.
We met all the criteria for Weld County minor sub-process and were granted a change of zone.
Our last commission meeting was on September 18, 2002. At that time, I, my brother, and Jeff
Couch met with my Planner, Robert Anderson, to go over the process of finalizing our project
and be able to have legally platted lots for sale. At this meeting we were told explicitly three
times that the rest of the process was finished administratively and would be finished
approximately 30 days from our September 18, 2002 approval for zone change.
On this assurance given to me, I borrowed a substantial amount of money to get the process
started on a water line extension to service my future subdivision. I also changed lenders on this
assurance and paid a substancial pre-payment penalty. This is causing a very large hardship for
myself and my wife.
On January 7, 2003 we resubmitted for our final approval. Several weeks later, we were
informed that our meetings would now be held in Longmont instead of Greeley. This would have
changed our dates only by a couple of weeks and our hearing would have been March 4, 2003.
Instead, we were told that because of a large project named Lifebridge, we would be bumped 5
weeks and put on the schedule for April 15, 2003. Once again, the combination of these major
delays is the reason I am asking for your permission for pre-advertisement. Your help will also
help me finalize this project in a more timely manner. Again, it would be greatly appreciated.
