RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR SITE PLAN
REVIEW #341 - RJML, LLC, DBA EL REVENTON NIGHT CLUB, C/O RUBEN
RODRIGUEZ
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated December 19,2001,the Department of Planning Services
approved the application of RJML, LLC, dba El Reventon Night Club, c/o Ruben Rodriguez, 232
Elizabeth Court, Fort Lupton, Colorado 80621, for a Site Plan Review, SPR#341 on the following
described real estate, to wit:
Part of the SW1/2SW1/4 of Section 29, Township 2
North, Range 66 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS, on January 16, 2002, the Board of County Commissioner of Weld County,
Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for
Improvements (Private Road Maintenance), between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, and RJML, LLC, dba El
Reventon Night Club, c/o Ruben Rodriguez with terms and conditions being as stated in said
agreement, and accepted a Personal Check, in the amount of $9,500.00, as collateral, and
WHEREAS, on May 19, 2003, the Board was presented with a request to cancel and
release said collateral for SPR#341, at which time the Board deemed it advisable to continue the
matter to June 4, 2003, to allow staff from the Weld County Department of Public Health and
Environment to be present, and
WHEREAS, on June 4, 2003, the Board determined that said collateral is no longer
necessary to secure said Improvements Agreement According to Policy Regarding Collateral for
Improvements (Private Road Maintenance), and
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the collateral, in the amount of$9,500.00, be, and hereby is, canceled and
released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

On April 19, 2003, the Department of Planning Services performed a site investigation of the
completed improvements for Ruben Rodriguez, dba El Reventon Night Club Facility located at
located at 13015 Weld County Road 16, Fort Lupton, CO, Case number SPR-341.
Don Carroll of Weld County Department of Public Works has inspected the items, and in the
memorandum of April 8, 2003, recommends the release of the transportation collateral for all
transportation related items, pending the re-compacting and re-paving the area where the
ground has sunk between the two structures north side of property.
Don Carroll revisited the property to verify that the re-compacting and re-paving of the area
between the two buildings had been completed to the satisfaction of the Department of Public
Works. The rework was found to be acceptable.
The Department of Planning Services' reviewed the completion of the on-site non-transportation
improvements and found them to be complete.
Lee Morrison, Assistant County Attorney, has advised that the release of funds would be in
accordance with the terms of the Improvements Agreement.
Given that all improvements have been completed to the satisfaction of the Department of
Planning Services' and the Department of Public Works, we recommend that ninety-five
hundred and no/100s ($ 9,500.00) dollars, be released. Staffs recommendation is to release
the collateral, in the form of a personal check from a representative for Ruben Rodriguez.

Night Club
At the request of the applicant, I performed a site visited April 4, 2003, to verify
improvements associated with collateral (Exhibit A) for a privately maintained facility.
Paving of the new access point from WCR 16 to the existing paved parking lot, the
pedestrian crosswalk, striping, closing of the two access points from the US Highway 85
Frontage Road, and the curb stops have all been completed.
There are two items that need to be completed prior to release of collateral.
1. In the northeast corner of the paved parking lot, the applicant needs to
expose the parking lot inlet drain to accommodate drainage at this location.
There are mounds of debris from the snow storm that cover the inlet area.
Those piles should be dozed down and incorporated into the existing gravel
parking area.
2. The septic or the water trench has sunk between the two metal buildings
creating a hazardous condition to the traveling public. This trench must be
re-compacted and re-paved properly.
Notify the Weld County Public Works Department to do a follow-up inspection once these
two items have been completed. Upon approval, the Public Works will recommend
release of collateral.
All other non-transportation items should be verified by Planning Services prior to total
release of collateral.

I would like to inform the Weld County Planning and Zoning that the Plan
Review SPR-341, and the Department of Transportation that the recommendations for
plan review SPR-341 have been completed.
I request the release of the collateral posted to complete plan review # SPR-341
the list included, additional landscaping, parking Area, Closing the Old Entrances to the
property parking area, building a fence for the trash dumpsters, handy cap parking spots
add side walk to the street, additional lighting, septic system, stop sign. Parking stops
around building etc.
