HomeMy WebLinkAbout20030753.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #3507 - ELIZABETH WILSON / HEIRS OF RICHARD WILSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #3507, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land," and WHEREAS, the request for Recorded Exemption #3507 was submitted by Elizabeth Wilson and the Heirs of Richard Wilson, 6707 Weld County Road 19, Fort Lupton, Colorado 80621, for property which is located in part on the following described real estate, to-wit: Part of the N1/2 of Section 33, Township 2 North, Range 67 West of the 6th P.M., Weld County, Colorado being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A," said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 77 acres and 3.4 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land." BE IT FURTHER RESOLVED by the Board that Recorded Exemption #3507 by Elizabeth Wilson and the Heirs of Richard Wilson is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) Regulations. 2. The applicant has proposed a well as a possible source of adequate water for the lots. Property owners are advised that the quantity of water available for usage may be limited to specific uses, i.e., "Domestic Use Only," etcetera. Because each situation is unique, the Department of Planning Services encourages property owners to contact the Office of the State Engineer, Division of Water Resources (1313 Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to discuss each individual situation. 3. Topographic or physical features of the proposed Lot A, such as ravines, ditches, streams etc. may limit the area available for a new or replacement septic system. In the event the proposed lot is not of sufficient size to allow the installation of a septic system the lot may need to be enlarged. 4. Prior to recording the plat: A. The plat shall be titled: Recorded Exemption No. 1311-33-2 RE-3507 B. In accordance with Chapter 8, Article II, of the Weld County Code, Lot A shall be granted one residential/agricultural access. Direct access from a public road shall be limited to one access per legal parcel for residential use, no circle drives or additional accesses shall be granted. The road shall be graded and drained to provide all weather access. Accesses shall be placed in such a location as to have adequate sight distance in both directions, shall not be placed below the crest of a hill or where physical obstructions are present. C. Lot B shall use the existing agricultural/oil and gas/ditch road access points necessary for agricultural operations as no additional accesses shall be granted. D. The plat shall reference the existing access agreement which allows the property owners to cross the 180-foot strip of property adjacent to Weld County Roads 16 and 17. The reference shall include the Weld County Clerk and Recorder's reception number. E. All approved accesses shall be clearly shown on the plat. F. The applicant shall address the requirements of Weld County School District RE-8, as stated in the referral response dated February 11, 2003. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. G. The plat shall indicate the required setback from oil and gas structures as stated in Section 23-3-50.E of the Weld County Code. H. The applicant shall provide the Weld County Department of Planning Services with a Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. I. The applicant shall complete all Conditions associated with Amended Recorded Exemption #2425, and submit the plat for recording to the Department of Planning Services. J. The following notes shall be placed on the plat: 2003-0753 RE3507 RE #3507 - ELIZABETH WILSON / HEIRS OF RICHARD WILSON PAGE 3 1) All proposed or existing structures will meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, H, I, M, and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery, or 150-foot radius of any wellhead, shall require a variance from the terms of the Section 23-6-10 of the Weld County Code. 2) Any future structures or uses on site must obtain the appropriate Zoning and Building Permits. 3) Prior to the release of Building Permits, the applicant shall submit a recorded deed describing the Lot upon which the Building Permit is requested with the Building Permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 4) Prior to the release of Building Permits, the applicant shall submit evidence to the Department of Planning Services that Lots A and B have an adequate water supply of sufficient quality, quantity and dependability. 5) Potential purchasers should be aware that Lot A may not be eligible for a domestic well permit which allows for outside irrigation and/or the watering of stock animals. The State Division of Water Resources issues all well permits. 6) Potential purchasers should be aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. The Weld County Department of Public Health and Environment strongly encourages well users to test their drinking water prior to consumption and periodically thereafter. 7) Potential purchasers should be aware that approval of this Recorded Exemption does not guarantee that well permits will be issued for the lots. Any lot may be deemed non-buildable if the lot owner is unable to obtain a well permit. The State Division of Water Resources issues all well permits. 8) Prior to the release of Building Permits for any structure exceeding 3,600 square feet, the applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code (UFC). 2003-0753 RE3507 6 RE #3507 - ELIZABETH WILSON / HEIRS OF RICHARD WILSON PAGE 4 9) Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 10) Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Weld County Road Impact Program, Area 3. 11) Potential Purchasers are hereby notified that confined animal feeding operations are located in the area. The first is located north of Weld County Road 16 and east of Weld County Road 17, and is permitted by Use by Special Review#1356 for 1,450 head of cattle. The second is located north of Weld County Road 16 and west of Weld County Road 19, and is permitted by Use by Special Review#1231 for 2,500 head of cattle. Off-site impacts that may be encountered include noise from trucks, tractors and equipment; dust from animal pens and odors from animal confinement, silage, and manure. 12) Weld County's Right To Farm statement, as it appears in the Weld County Code, Appendix 22-E, shall be placed on the Plat. 5. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of the Board of County Commissioners Resolution. The applicant shall be responsible for paying the recording fee. 6. Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. The preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with the following criteria as listed in Section 24-8-40.B.1 through 24-8-40.8.6 of the Weld County Code: A. Section 24-8-40.8.1 - Conformance with the urban growth boundary goals and policies contained in Chapter 22 of the Weld County Code as well as any approved intergovernmental agreement when the recorded exemption application is located within a specified intergovernmental boundary area. The lot is not within an intergovernmental boundary area. However, the lot is within the three mile referral area for the Towns of, Firestone and Frederick and the City of Dacono. In referral response the Town of Firestone indicated no comment and the City of Dacono indicated no conflicts with the proposal. The Town of Frederick did not respond to the referral request. B. Section 24-8-40.8.2- Compatibility with existing surrounding land uses. The proposal will create one additional 3.4 acre lot which is consistent with the existing surrounding land uses. C. Section 24-8-40.8.3-Consistency with the intent of the zone district the recorded exemption is located within as expressed in Chapter 23 of the Weld County Code. D. Section 24-8-40.8.4-Consistency with the purpose of efficient and orderly development as expressed in Section 24-1-30 of the Weld County code. The proposal meets all of the applicable goals listed in the Statement of purpose as follows: 1) Section 24-1-30.A -Assisting orderly and integrated development. 2) Section 24-1-30.8 -Promoting the health, safety, and general welfare of the residents of the County. 3) Section 24-1-30.C-Ensuring conformance of land subdivision plans with the public improvement plans of the County and its various municipalities. 4) Section 24-1-30.D- Ensuring coordination with public municipal improvement plans and programs. 5) Section 24-1-30.E-Encouraging well-planned subdivisions by establishing adequate standards for design and improvement. 6) Section 24-1-30.F-Improving land survey monuments and records by establishing standards for surveys and plats. 7) Section 24-1-30.G- Safeguarding the interests of the public, the homeowner, and the subdivider. 8) Section 24-1-30.H-Securing equitable handling of all subdivision plans by providing uniform procedures and standards. 9) Section 24-1-30.1-Preventing loss and injury from fire in wooded terrain. 10) Section 24-1-30.J-Preserving agricultural land and promoting its most productive agrarian use. 11) Section 24-1-30.K-Ensuring irrigation water currently associated with a farm or rural unit of land will be retained for agricultural uses. 12) Section 24-1-30.L - Preserving natural vegetation and cover and promoting the natural beauty of the County. 13) Section 24-1-30.M-Preventing and controlling erosion, sedimentation, and other pollution of surface and subsurface water. 14) Section 24-1-30.N-Preventing flood damage to persons and properties and minimizing expenditures for flood relief and flood control projects. 15) Section 24-1-30.0 - Restricting or regulating building in flood hazard overlay district areas, shorelands, areas covered by poor soils, or in areas poorly suited for building or construction. 16) Section 24-1-30.P- Preventing loss and injury from land slides, mud flows, and other geologic hazards. 17) Section 24-1-30.Q-Providing adequate space for future development of schools and parks to serve the population. 18) Section 24-1-30.R-Ensuring the planning for and provisions of an adequate and safe source of water and means of sewage disposal. E. Section 24-8-40.8.5 - Compliance with the recorded exemption standar s set forth in Section 24-8-80 of the Weld County Code. 1) Section 24-8-80.A - The water supply for all lots as proposed by the recorded exemption application is adequate in terms of quality, quantity, and dependability. The applicant has indicated that the lots may be serviced by Central Weld County Water District or individual wells. 2) Section 24-8-80.8-An adequate sewer service is available to serve the uses permitted on both proposed lots. The sewer service shall comply with the requirements of the applicable zone district and the Weld County Health Department. The applicant is proposing Individual Sewage Disposal System for any future residence. 3) Section 24-8-80.C-An adequate legal access exists for all proposed lots to a public road. All accesses shall be in accordance with Chapter 8, Article H of the Weld County Code. The applicant has included an existing access agreement to cross the 180 foot strip adjacent to Weld County Road 16 with the application. 4) Section 24-8-80.D- The proposed recorded exemption will comply with Chapter 23,Article V of the Weld County Code. The site is not located within an overlay district. 5) Section 24-8-80.E- The minimum size of any lot proposed is not less than one (1) acre, except where smaller lot sizes are allowed in the zone district or where exempted by the Board of County Commissioners. The proposal will create a 3.4 acre lot. 6) Section 24-8-80.F-The decision to approve a recorded exemption may be conditioned to mitigate impacts or address concerns of referral agencies. Existing or future public rights-of-way shall be dedicated or reserved in conformance with Chapter 22 of the Weld County Code and any adopted intergovernmental agreements, or master plans of affected municipalities. The site is not adjacent to any Weld County Road right of way. 7) Section 24-8-80.G-The recorded exemption application shall include the total contiguous land ownership, except in the Agricultural Zone District. In the Agricultural Zone District when a contiguous ownership equals at least twice the minimum lot size (160 acres), or a parcel otherwise recognized as a complete quarter section, a portion of the lot equal to the minimum lot size (80 acres)may be used in the recorded exemption application. The three(3)-lot recorded exemption application shall include the total contiguous land ownership equal to no less than twice the minimum lot size (160 acres) in the Agricultural Zone District, or is a parcel otherwise recognized as a complete quarter section. The fact that the applicant has conveyed, within the last calendar year, land which would have been considered contiguous had it been retained, may be considered as evidence of an intent to evade the purpose provisions of Sections 24-1-30 and 24-8-20 of the Weld County Code. 8) Section 24-8-80.H-The proposed recorded exemption is not part of a recorded exemption approved within the last ten (10) years. This provision shall not apply in any commercial or industrial zone district. On March 17, 1999 the Board of County Commissioners denied Recorded Exemption 2426 on the site. As directed by the Board, the applicant has included with the Recorded Exemption application evidence of substantial change as required by Chapter 2, Article II, Section 2-3-10 of the Weld County Code. a. It is the opinion of the Department of Planning Service's staff that the applicant has demonstrated that a substantial change has occurred. b. The Weld County Board of County Commissioner's Resolution dated March 17, 1999 denied Recorded Exemption 2426 for the following reasons: 1. The proposal evades the purpose of the Weld County Subdivision Ordinance as defined in Section 1.3. 2. The division would be inconsistent with efficient,orderly and integrated development pursuant to Section 1.3.1 of the Weld County Subdivision Ordinance. 3. Pursuant to Section 11.5.1.2 of the Weld County Subdivision Ordinance, this proposal is not consistent with the Weld County Comprehensive Plan. 4. Any further division of these lots will increase the density of the existing linear subdivision inconsistent with Section 11.5.1.2 of the Weld County Subdivision Ordinance. 5, The proposal increases the need for more urban-type services in the area. c. Pursuant to Chapter 2, Article II, Section 2-3-10 of the Weld County Code, the Board of County Commissioners shall consider whether within the concept of a new application, the facts and circumstances of which are substantially changed from the initial application: Criteria 1. --Has the land-use application substantially changed? (e.g., substantial changes in lot size or density, in internal or external roads, or, in the case of a rezoning, in the uses proposed) Criteria 2. —Have the surrounding land-uses substantially changed ? (e.g., has the adjacent land use changed during the period of time since the last application such that what would be compatible with the adjacent use has changed) Criteria 3. — Have applicable provisions of the law substantially changed? (e.g., the applicant is proposing using a different procedure so a different set of criteria apply or the applicable ordinance has been amended by the Board so the criteria have substantially changed) Criteria 4. — Within the concept of rehearing the previously denied application, is there newly discovered evidence that the applicant could not have discovered with diligent effort at the time of the original application ? d. Recorded Exemption 2426 (RE-2426) proposed to create a 20 acre lot for the development of a minor subdivision. Staff comments for RE-2426 indicate concerns were in regards to the potential • • cumulative number of residences to be created and the compatibility with A.Goal 7 of the Weld County Code which stated"Protect agricultural land from encroachment by those urban uses which hinder the operation efficiency and productivity of the agricultural uses." Planning staff does concur that this proposal does appear to constitute a substantial change from the previously submitted application. 9) Section 24-8-80.1- The proposed recorded exemption is not part of an approved subdivision or recorded subdivision plat or unincorporated community legally filed prior to adoption of any regulations controlling subdivisions. 10) Section 24-8-80.J- The proposed recorded exemption does not evade the statement of purpose as set forth in Section 24-1-30 of the Weld County Code. As stated above the proposal meets all of the applicable goals listed in the Statement of Purpose. F. Section 24-8-40.8.6-Adequate provision for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and the County. Conditions of Approval and Development Standards ensure that there are adequate provisions for the protection of health, safety, and welfare of the inhabitants of the neighborhood and County. Should the Board of County Commissioners approve this request, the Department of Planning Services' staff recommends the following conditions be attached:. 1. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views,spaciousness,wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms,those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. • Section 35-3,5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed,will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self- sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic,sand burs,puncture vines,territorial farm dogs,and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 5. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County Code. Water Supply Statement: a. Domestic Use: The applicant has purchased a tap which can be used for the proposed recorded exemption (Proposed Lot "B"). Proposed Lot "A" is eligible for a domestic water tap, subject to current requirements of Central Weld County Water District (CWCWD). CWCWD states that applicant's tap fee agreement dated August 1998 should suffice as proof that domestic water is available. Irrigation Water: The proposed boundary changes will bring the lot lines into a more natural conformity with land usage and the natural topography, but will have no impact on irrigation. 2. Description of current use of the property: Wilson Recorded Exemption Questionnaire Both of the proposed lots are currently nonprime farmland, used for raising wheat and native grasses common to the area. There are no dwellings on either parcel. There are oil and gas wells with accompanying structures and storage tanks on proposed Lot "A". There are no structures on proposed Lot "B". Proposed Boundary Changes: There are no structures on the portion of Existing Lot B RE 2425 that would become part of Proposed Lot A. Boundary changes will have no effect on current usage of the farm ground of either proposed Lot A or Lot B or Existing Lot B RE 2425. 4. Reason for the Recorded Exemption and proposed use of property: Reason for Recorded exemption: This Recorded Exemption (RE) application is being filed in conjunction with an application to amend existing boundary lines between existing 80-acre parcel #131133000046 and Existing Lot B of RE-2425. Reason for Proposed Boundary Changes The original parcel configuration reflected the Wilsons' desire to build a new home "with a view" on that portion of Proposed Lot "A" which is currently part of Lot B RE-2425. Since Richard Wilson's death in September 2001, the plan to build a new house on Proposed Lot "A" is no longer feasible for his widow. The newly proposed lot line amendments more closely follow the natural topography of the land, and follow the existing irrigation ditch and road which service existing Lot B of RE-2425. The new boundaries also approximate the actual separation of existing fields. Proposed Lot "A" is planted in dryland wheat, and the bulk of Lot B of RE-2425 is presently in irrigated alfalfa and grass. In addition, the proposed amended RE utilizes the existing ditch access road which follows the ditch and divides most of Proposed Lot "A" from Lot B RE- 2425. Proposed Use: Proposed Lot "A" is currently under contract for sale to Longmont Broadcasting, LLC. Their expressed intent is to maintain the property as Wilson Recorded Exemption Questionnaire 2 a dryland farm, and to make application to build up to 2 communication towers, with supporting structures, as permitted in the agricultural zone. Proposed Lot "B", the recorded exemption, creates a parcel of approximately 3.4 acres contiguous to the remaining Wilson farm, to be used by the son, who is currently farming the property since his father's death in Sept 2001. He and his wife are currently residing in a 632 square foot tenant house on his mother's property, and would like to build their own home while continuing to farm for his mother. The recorded exemption would facilitate and support continuing the family farming operation. Proposed Boundary Changes: Make both parcels more usable, by following the natural topography of the land, by utilizing existing ditch and road as a natural boundary, and by facilitating farm usage as outlined above. 5. Description of location, size, use of new lots: Proposed Lot "A" is in the northwest corner of the parcel, at the corner of WCR 17 and WCR 16. It will be 93.88 acres in size. It is under contract to be sold, and new owners will continue agricultural use, and have expressed intent to apply for permits to build two communication towers. Proposed Lot "B" is east of Proposed Lot "A" and north and west of Existing LOT B RE-2425. Proposed Lot "B" will be approximately 3.4 acres in size, and will be used as a rural residential property by applicant's son who will continue to farm the adjoining property belonging to his family. Proposed Boundary Changes: Would facilitate economical continued use of existing farmland by separating dryland wheat ground on Proposed Lot A from Existing Lot B- RE-2425 which is planted below the irrigation ditch in alfalfa. This promotes continued agricultural use of the land and community stability. It protects and maintains our agricultural heritage. Proposed Boundary Change: Promotes natural boundary of existing ditch and ditch road which utilize the natural contour of the road. 13. Statement explaining consistency with efficient and orderly development. This proposal for a Recorded Exemption is consistent with efficient and orderly development. It is located on the tag end of a dryland wheat parcel. Using it as a building site will encourage planting native grasses which will help stabilize and hold the ground, as well as promote the natural beauty of the area. The proposal has the minimal impact of allowing one additional building site on a total of 170 acres. Provisions are available for adequate water and septic. Wilson Recorded Exemption Questionnaire 5 i The general welfare of the residents of the area will be enhanced by having another small family farm, thereby maintaining rural heritage, and by the continued agricultural use of the Wilsons' existing adjoining farm. Impact to sheriffs patrols and fire protection is minimal. The property is located in Fort Lupton Fire District. Proposed Boundary Changes: Improve the conformity of the parcels to the topographical contour of the land, maintaining the existing ditch and ditch road as natural boundaries between parcels. If I understand the intent of the two proposals the end result will be three pieces of property, one o£93.88 acres to be sold, one of approximately 77 acres to be farmed, and one for a building site. Based upon expected student generation rates from what appears to be the possibility of one new single-family unit on 3. 4 acres, the new home would generate approximately 1 new student to be accommodated within district. Bus transportation would likely be provided. It is understood that approval of the proposed new lot does not yet add a residential unit to enrollment potential. However, certain school issues should be considered at this .important juncture, including school site planning, transportation access and facility capacity. The current facilities that would serve this lot are Twombly Primary, Butler Elementary, Fort Lupton Middle School and Fort Lupton High School. Customer agrees to pay the tap fee of$ 5.100 00 Five Thousand One Hundred and 00/100 Dollars. 2.
