RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT#1098 - PRAIRIE
MOUNTAIN PIPELINE COMPANY/ BP PIPELINES (NORTH AMERICA) INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated January 6, 1994, the Weld County Planning
Commission did approve Use by Special Review Permit#1098 for a Major Facility of a Public
Utility for a 9.5-mile underground natural gas pipeline in the A (Agricultural) Zone District for
Prairie Mountain Pipeline Company on the following described real estate, to-wit:
The preferred pipeline route began approximately
one mile east of Keenesburg, Colorado, (the SE1/4
of Section 24, T2N, R64W) in Weld County. The
pipeline follows an overland route running in a
southeast direction through Weld County for
approximately 9.5 miles, passing through the
following Sections: T2N, R63W, Section 19, 30,
and 31, and T1 N, R63W, Section 5, 8, 17, 16, 21,
22, 27, 26, and 35. The preferred pipeline route
exits Weld County at the border between Weld
County and Adams County, approximately 3,000
feet east of County Highway 79 (the center of the
southern edge of Section 35, Ti N, R63W)
WHEREAS, the Department of Planning Services staff recommended the vacation of
Use by Special Review Permit#1098 due records which indicate the applicant did not satisfy
the Conditions of Approval, the plat was never submitted for recording, and the pipeline was not
constructed, and
WHEREAS, the Board has received a request from BP Pipelines (North America) Inc.,
801 Warrenville Road, Suite 700, Lisle, IL 60532, current permit holder, to vacate said Use by
Special Review Permit#1098, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Use by Special Review Permit #1098 be, and hereby is, vacated.

SUBJECT: Show Cause Hearing for USR-1098
On February 10, 2003 the Board of County Commissioners held a Probable Cause hearing for Use by
Special Review 1098. USR-1098 was submitted on October 10, 1995 by Prairie Mountain Pipeline
Company for a 9.5 mile underground natural gas pipeline. The Board scheduled a Show Cause hearing
for March 17, 2003.
On March 3, 2003, County Staff received the attached letter stating that BP Pipelines has acquired the
assets of Prairie Mountain Pipeline Company and they wish to vacate USR-1098. The Weld County
Department of Planning Services is recommending the vacation of USR-1098 and the cancellation of the
Show Cause hearing.

Re: Request to Vacate USR-1098
Dear Sirs:
Through recent transactions, BP Pipelines (North America) Inc., has acquired the
assets of Prairie Mountain Pipeline Company, the former Permittee of USR-1098.
Please be advised that BP Pipelines (North America) Inc., has no interest in pursuing
the 9.5 mile underground natural gas pipeline in the Agricultural Zone District which
was the subject of USR-1098. Therefore, the company requests that USR-1098 be
vacated by the Board of County Commissioners of Weld County.
