The Department has reviewed the request to change from R-5 (Mobile Home) to Agricultural. The
property has been historically used as a feedlot facility and a dairy facility is proposed for this
property through a pending USR application (USR 1405). Development Standards, Conditions of
Approval, and Operation Standards for the special use permit will mitigate any adverse impacts to
surrounding areas.
The property is in the service areas of the St. Vrain Sanitation District and Little Thompson Water
District, and both districts are capable of providing service to the property. An existing septic system
for the residence (G19681104) must be properly abandoned as part of the connection to St. Vrain
Sanitation District.
The Department recommends approval of this application with the following conditions:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner
that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include
those wastes specifically excluded from the definition of a solid waste in the Solid Wastes
Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial
Zone as delineated in 25-12-103 C.R.S., as amended.
6. Any abandoned septic system must comply with the Weld County Code Section 30-4-20 (D).
The applicant should contact the Department to update existing septic permits for those
systems that have been abandoned.
