I've reviewed the submittal you sent regarding the mining operation proposed near US 85. The access
is currently full movement with the US 85 Access Control Plan calling for the intersection to be limited to
a% access as a medium priority and ultimately an interchange in the long range forecast.
The traffic impact study states that improvements to US 85 should be made to bring the existing
auxiliary lanes up to standard,and that those improvements can be made within the existing pavement.
The study did not address the need for a left tum acceleration lane onto US 85. CDOT would have
required one.
With the County's assistance, CDOT would like to now take the opportunity to restrict the access to a%
movement. By restricting the access, traffic would have to travel south on County Road 27, west on
Weld County Road 6,to the new traffic signal to enter US 85.
We realize that the County may require improvements on County Road 27, but feel that the dollars that
would have been spent on the left tum acceleration lane can be spent here instead, thus implementing
a portion of the ACP.
By limiting the access we will also be impacting the properties west of US 85. As part of the ACP,
CDOT recognized that some properties would be forced to travel out of direction, but concluded that
safety outweighed convenience. The applicant would be responsible for advising the property owners
of the change.

been identified on the Brighton zozo Comprehensive Plan as being appropriate for agricultural
uses. While the City of Brighton is generally not opposed to mineral extraction uses, the fol-
lowing is offered for consideration:
> The City of Brighton is particularly concerned with the prospect of an asphalt batch
plant along HWY 85, which forms the"gateway" to Brighton, and would request that
such uses be precluded from the HWY 85 corridor, unless accompanied by stringent
buffering and landscaping standards.
> Likewise, the proposed mineral extraction adjacent to WCR 27 invokes similar con-
cerns; the City of Brighton would request that, if approved, such approval would be
contingent upon the inclusion of similar buffering and landscaping standards re-
quested for the Hwy 85 corridor.

The sheriffs office recommends the following improvements for this gravel pit
operation:
1. The sheriffs office requests that gravel trucks transporting materials out of the
area on county roads assure that their loads are covered, thus reducing loose
materials on the roadway and the amount of damage to vehicles.
2. The Sheriff's Office also requests that gravel trucks and other vehicles leaving
the site do not bring foreign materials on to the roadways on their tires. This
maybe accomplished by paving a short distance prior to entering the public
roadway.
3. The sheriffs office would however be willing to provide a program entitled
Crime Prevention through Environmental Design to the developer. This
program reduces the likelihood of criminal activity at a specific location by
"hardening"it to crime.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

Dear Mr. Ogle:
Kerr-McGee Rocky Mountain Corporation("KMG")owns the oil and gas leasehold
interests in the S/2NE/4 and NENE/4 of Section 19,Township 1 North, Range 66 West, Weld
County, Colorado(the"Property"). KMG currently operates one natural gas well and associated
production facilities located in the approximate center of the NE/4 and has rights to drill up to
three additional wells on the Property. Also, KMG's affiliate Kerr-McGee Gathering LLC
currently owns and operates a high pressure natural gas pipeline that traverses the Property.
KMG has met with the applicant and their consultant to discuss the proposed mining
operation on the Property. KMG's objective is to resolve any issues regarding the compatible
development of the mineral and surface estates through a surface use agreement prior to the
Applicant receiving final approval of the project. Therefore, KMG requests that Weld County
Department of Planning Services recommend as a condition of approval that evidence of an
executed surface use agreement between KMG and the Applicant must be provided prior to
scheduling a hearing before the Board of County Commissioners.
Although an agreement has not been reached, KMG is optimistic that a surface agreement
can be finalized and we look forward to working with the Applicant and the County throughout
this process. Thank you for allowing KMG to participate in this referral process and if you have

Pursuant to the State Engineer's August 7, 1995 memorandum to county planning
directors, this office is no longer providing comments on land use actions that do not involve a
subdivision as defined in Section 30-28-101(10)(a), C.R.S. This referral does not appear to
qualify as a"subdivision". However the following comments are provided for your information.
We have reviewed the above referenced proposal to create a gravel mining operation
and Concrete and Asphalt Batch Plant on a 112-acre parcel.
Based on the submitted information it appears that the Gravel Mining operation will cause
depletions to the South Platte River due to evaporative losses from exposed ground water and
operational losses. A Temporary Substitute Water Supply Plan or court approved
augmentation plan must be obtained to replace the depletions caused by the operation.
The plan states that three wells located on the property will be used within the gravel
mining operation. If the wells do not qualify under 37-92-602(c)C.R.S. as commercial exempt, all
depletions from the wells must be covered by a Temporary Substitute Water Supply Plan or court
approved augmentation plan. The wells must be repermitted pursuant to the Temporary
Substitute Water Supply Plan, court approved augmentation plan or as a commercial
exempt well.
Gravel pit operators typically must first obtain approval from the Colorado Division of
Minerals and Geology(DMG)prior to mining. As part of that process the applicant will need to
address the potential concerns of State Engineer's Office as they relate to water rights.

Environmental Health Services has reviewed this proposal for a mineral resource
development facility; including open pit mining and materials processing and a concrete
and asphalt batch plant. We have no objections to the proposal, however, we do
recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit an Air Pollution Emission Notice (A.P.E.N.) and
Emissions Permit application to the Air Pollution Control Division, Colorado
Department of Health and Environment for emissions of criteria, hazardous or
odorous air pollutants.
2. The applicant shall submit a dust abatement plan to the Environmental Health
Services, Weld County Department of Public Health & Environment, for approval
prior to operation.
3. The Environmental Health Services Division was unable to locate a septic permit
for the septic system serving the existing residence. The septic system shall be
reviewed by a Colorado Registered Professional Engineer. The review shall
consist of observation of the system and a technical review describing the
systems ability to handle the proposed hydraulic load. The review shall be
submitted to the Environmental Health Services Division of the Weld County
Department of Public Health and Environment. In the event the system is found
to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
4. A CDPS Permit shall be obtained from the Water Quality Control Division of the
Colorado Department of Health for any proposed discharge into State
Waterways.

5. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14). Alternative protective
measures may be allowed provided they comply with these regulations.
6. The applicant shall submit evidence to the Department of Planning Services,
from the Colorado Division of Water Resources, demonstrating that the well(s)
are/is appropriately permitted for the use.
7. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,

as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14).
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Light industrial Zone as delineated in 25-12-103 C.R.S., as amended.
7. The facility shall utilize the existing public water supply.
8. The applicant shall remove, handle, and stockpile overburden, soil, sand and
gravel from the facility area in a manner that will prevent nuisance conditions.
9. All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
10.The applicant shall operate in accordance with the approved "waste handling
plan".
11.Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
12.Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
13.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
14.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
15.The operation shall comply with all applicable rules and regulations of the
Colorado Division of Minerals and Geology.

Site Specific Development Plan and Special Review Permit for Mineral Resource Development
Facilities, including open pit mining and materials processing; including a Concrete and Asphalt
Batch Plant in the A (Agricultural) Zone District.

There are no active or historical permits on record for this parcel.
1. A building permit shall be obtained prior to the construction of the concrete or asphalt batch
plants, scale, shop building, office trailer and any other structure placed on the parcel.
Demolition permits are required for the demolition or removal of any structure on the property.
A plot plan shall be submitted showing all structures with accurate distances between
structures, and from structures to all property lines.
2. A plan review is required for each building for which a building permit is required. Plans
shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of
plans are required when applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 1997 Uniform
Building Code; 1998 International Mechanical Code; 1997 International Plumbing Code; 2002
National Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
5. Building wall and opening protection and limitations shall be in accordance with UBC Table
5-A. Separation of buildings of mixed occupancy classifications shall be in accordance with
UBC Table 3-B and Chapter 3. Setback and offset distances shall be determined by the Zoning
Ordinance.

6. Building height shall be measured in accordance with the 1997 Uniform Building Code for the
purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
7. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain whether the buildings are existing or new.

In consultation with the West Adams Conservation District(WACD), we have reviewed the
above referenced application and would like to provide the following comments. I have also,
attached a copy of our previous review of this project that was sent to the Colorado State
Division of Minerals and Geology. While the application does show some changes from the
original plan, we still feel that there are additional items that need to be addressed.
On page 25, under Topsoil Segregation..., reference is made to revegetating the topsoil
stockpiles, if they remain longer than one growing season. Phase one, for example, indicates 7
years to complete and that topsoil from phase two will be used in reclaiming it, with this known,
there would be no need to wait one growing season to start establishing the temporary cover.
Temporary cover should be established immediately upon completing the berms and before
undesirable vegetation comes in. Soil erosion could begin as soon as the berms are built and thus
they need to be protected.
Also, on page 25 and 26, reference to `final grades' indicates a 3:1 slope, which can make
establishing permanent vegetation more difficult than a 4:1 slope would. These 3:1 slopes are
also more susceptible to `sloughing' due to wave action. Should foreign water be allowed to run
down the slopes, serious erosion will take place. All foreign water,both from on-site and off-site
should not be allowed to run down the slopes and should be diverted. The contour furrows that
are proposed will afford some protection between each one but will do little to control larger
volumes of runoff water.
Topsoil should be spread in lifts not to exceed 4 inches and worked into the slopes to assure good
adhesion and minimize soil `creep'. Fertilizer testing and application at the specified rate needs
to take place prior to planting, not after the seeding fails, as indicated in the plan. There is also

of our office for this input, as well as no mention of mulch application rates. We strongly feel
this needs to be addressed.

The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, for a gravel mining operation, materials processing which
includes a concrete and asphalt batch plant in the (A) zoned district. Our comments and requirements are as
follows:
COMMENTS:
All three Weld County roads shall be a part of the designated haul route:
WCR 27 (Old US Highway 85) is designated on the Road Capital Improvement Plan in the County Wide
Impact Fee Code Ordinance, Section 20-1-30, as a collector status road. The road is maintained by Weld
County pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-
50, the required setback measured from the future right-of-way line. On WCR 27 between WCR 6 and WCR 8,
our most current traffic count reflects 1,781 vehicles per day.
WCR 8 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code Ordinance,
Section 20-1-30, as a collector status road. The required setback is measured for the future right-of-way line.
Our most recent traffic count is 1,137 vehicles per day. This 24-hour count was taken April 1996.
WCR 6 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code Ordinance,
Section 20-1-30, as a local paved road. The indicated that WCR 6 will be a portion of the designated haul
route west of US Highway 85 at the new light, then disburse north or south. Our most recent traffic count is
210 vehicles per day. This 24-hour count was taken May 1998.
Traffic Study Outbound: The applicant's traffic consultant, LSC, has submitted a traffic study dated January
14, 2003. A second copy has been sent to Gloria Hess-Idler, CDOT, for review. The applicant identified that
the haul route shall be from the pit entrance on WCR 8 then east on WCR 27 (Old US Highway 85) then south
to WCR 6 thence west to US Highway 85 at the new light.
Traffic Study Inbound: The inbound traffic will utilize US Highway 85 to WCR 8 east to the pit entrance only.
REQUIREMENTS:
Site Access: In reviewing the traffic study, the applicant indicated that on a daily basis the site will generate a
total of 170 external daily vehicles trip, (85 entering and 85 existing on a typical week day.) The applicant shall
install an acceleration or deceleration lane at the entrances to accommodate this volume. A construction
—drawing will be required for review and approval.

WCR 27/WCR 6: The right turn lane shall be added to accommodate truck turning westbound on WCR 6.
The intersection detail improvements shall take into consideration the right-of-way, drainage, utility, and other
such issues. If widening is required, the applicant is responsible to acquire additional right-of-way or relocation
of the utilities, if needed.
CDOT: Turn lanes on US Highway 85 at the intersection of WCR 8 need to be brought up to current
standards. Coordinate with CDOT on improvements at this location.
US Highway 85 Traffic Control Plan: This intersection is being identified as a % access at T-intersection
with a future bridge. Coordinate with CDOT for any improvements associated with this intersection. The
applicant indicated that this intersection will only be used on return trips.
Existing Road Pavement Status: The Weld County Public Works Department has evaluated the existing
road pavement status of WCR 8, WCR 27, and WCR 6 for additional overlay requirements to accommodate
the proposed heavy hauling on this route, if needed.
WCR 6 was evaluated, and has 3.5 inches of existing hot bituminous pavement. To meet the structural
requirement for WCR 6, an additional two inches of new hot bituminous pavement must be placed over the
existing pavement with gravel shoulders between US Highway 85 and WCR 27.
WCR 27 (Old Highway 85) has seven inches of existing hot bituminous pavement and six inches of existing
concrete, as it was an old state highway. WCR 27 between WCR 6 and WCR 8 requires no additional asphalt.
WCR 8 has four inches of existing hot bituminous pavement. An additional three inches of new hot bituminous
pavement with gravel shoulders will be required between US Highway 85 and WCR 27.
In coordination with these upgrades to the pavement sections, excel or decel lanes will be required a the
entrances at WCR 8 and WCR 27 as well as improvements to all intersection affected on the designated haul
route.
Road Maintenance and Improvements Agreement: The applicant shall enter into a Road Maintenance and
Improvements Agreement with the Weld County Public Works Department for the designated haul route and all
intersection improvements associated with this USR.
On-Site Improvements: The approach road shall be paved with asphalt or concrete for approximately 300
feet prior to entering on to WCR 8 and WCR 27 to accommodate dust control or tracking from the pit.
Off-Street Parking and Loading Zones: Off-street parking spaces and loading zones shall be surfaced with
gravel, asphalt, concrete, or the equivalent and shall be graded to prevent drainage problems.
Future Right-of-Way: The applicant shall identify on the plat drawing future right-of-way for WCR 8 as it is
classified as a collector status road, which requires an 80-foot right-of-way at full build out. There is presently
a 60-foot right-of-way. The set back will be determined from the future right-of-way. The applicant shall
dedicate an additional 10-foot right-of-way in front of the property for future widening and installation of a
deceleration lane at the entrance.

WCR 27 was an old state highway; verify the existing right-of-way width. This road is designated as an arterial
status road, which requires a 130-foot right-of-way at full build out. The applicant shall dedicate an additional
35-foot right-of-way for the widening and installation at the acceleration lane at the exit.
WCR 6 is still classified as a local paved road with a 60-foot right-of-way.
Storm Water Drainage: The entire site will be graded to direct storm water run-off towards ditches, detention
system, and de-watering system. A CDPS permit (for de-watering operation) may be obtained from the
Colorado Department of Public Health and Environment.
The historical flow patterns and run-off amounts will be maintained on site in such a manner that will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.

Dear Mr. Ogle:
n Thank you for the opportunity to review and comment upon the application submitted by
Premier Paving Inc. for approval of a gravel mining pit and concrete/asphalt batch plant.
On behalf of the Fort Lupton Planning Commission, I would like to express our
recommendation for denial of the application for the following reasons:
1. The proposal is not consistent with the Fort Lupton Comprehensive Plan. This
type of intense industrial development that includes an asphalt batch plant is in
conflict with the land use plan. The land use plan designates the area between
County Road 10 and Road 6 as Agricultural, suitable for agriculture and ag-
related uses.
2. The proposal is not consistent with the Fort Lupton Transportation Plan. The
applicant proposes to add a significant number of vehicle trips to the surrounding
roadway system, without proposing any substantial roadway improvements. The
only "improvements"proposed fall into the category of re-striping on Highway
85. The Commission is convinced that the surrounding roadway system,
specifically Weld County Road 8 and 27, should be improved to arterial standards
according to the Fort Lupton Transportation Plan.

3. If it is the County's intention to continue approving high-traffic, high-impact land
uses in the area without requiring that the transportation system be improved
concurrently, the City intends to pursue annexation of the area to ensure that
development will pay its own way. Recent zone changes from low-intensity
agriculture uses to high-intensity I-3 uses, coupled with the proliferation of gravel
mining operations will create an area of intense development without adequate
infrastructure. The Commission encourages the County to work with the
Colorado Department of Transportation to ensure that the purpose and intent of
the US 85 Access Control Plan IGA is accomplished.
4. Finally, it is the belief of the Commission that the proposed mine and batch plant
is not in the best interest of the health, safety and welfare of the citizens of Fort
Lupton. This proposal is no better and no less of an impact to the community
than a similar application that was opposed by the City and denied by the County
approximately 2-1/2 years ago.
