RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST MYRTLE THOMPSON, FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Myrtle Thompson, VI #0300070, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of May, 2003, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Venetta Rosales, representative, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral indefinitely until such time as the trailer is no longer inhabited by
Myrtle Thompson.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0300070 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Myrtle Thompson to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until such time as the trailer is no
longer inhabited by Myrtle Thompson.

Currently the property is in violation of Chapter 23, Article III, Division 1 of Sections 23-3-20, 23-3-30 and
23-3-30.1, Chapter 23, Article IV, Division 3 of Sections 23-4-140 and 23-4-180 and Chapter 29 of
Section 29-3-10 of the Weld County Code.
REMEDY
To bring the property into compliance, the camper/trailer-Recreational Vehicle shall be abated as a
dwelling unit, the second structure shall be abated as a dwelling unit, the remaining structure shall be
repaired to habitable standards and the tires shall be removed or screened from all adjacent properties
and public rights of way.
RECOMMENDATION
If the Board of County Commissioners agree that the camper/trailer-Recreational Vehicle shall be
removed, the Department of Planning Services that this case be referred to the County Attorney's Office,
but to delay legal action for 90 days.
If the Board of County Commissioners consider the camper/trailer-Recreational Vehicle as a Mobile
Home, a Zoning Permit for a Mobile Home (ZPMH) as a "Medical Hardship"application shall be
completed and submitted to the Department of Planning Services.
If the Board of County Commissioners consider the use of a camper/trailer-Recreational Vehicle as a
dwelling unit to qualify as a Nonconforming Use (NCU), a Nonconforming Use application shall be
completed and submitted to the Department of Planning Services.

March 3, 2003 Initial inspection completed by Gary Schwartz, Weld County Sheriff's Office,
Animal Control.
April 2, 2003 Steve Wiatrowski, Health Department, conducted a site inspection regarding
septic issues.
April 2, 2003 Initial complaint received.
April 11, 2003 Ms. Rosales came into the office to discuss the situation.
April 11, 2002 Ms. Rosales submitted a letter waiving the 30 day Violation Notification.
April 15, 2003 Five day compliance encouragement letter issued.

Dear Ms. Rosales and Ms. Thompson:
The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting
with the Board of County Commissioners on May 13, 2003, at 10:00 a.m., to consider the violations
occurring on the property. The property remains in violation of the following Section(s) of the Weld
County Code:
Chapter 23,Article 111, Div 1 "A(Agricultural) Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.1 "Noncommercial junkyard."
Chapter 23,Article IV, Div 3 "Mobile Homes"
Section 23-4-140 "Mobile homes permitted in the A Zone District."
Section 23-4-180 "Temporary accessory use during medical hardship."
Chapter 29,Article III "Building Permits."
Section 29-3-10 "Building permit required."
-No building or structure regulated by this Building Code shall be erected,
constructed, enlarged, altered, repaired, moved, improved, removed, converted or
demolished unless a separate building permit for each building or structure has been
first obtained from the Building Inspection Department. (Before any demolition
permits are issued, approval must be given by the Department of Public Health and
Environment.)
To bring the property into compliance:
The "Noncommercial Junkyard" consisting of tires shall be removed or screened
from all adjacent properties and public rights-of-ways.
One (1) of the homes shall be abated as a dwelling unit. A building permit for the
remaining home shall be obtained ensuring adequate installation and remodeling.
Lastly, a RECREATIONAL VEHICLE (see definition, next page) is not considered to
be an approved dwelling unit. Therefore, according to the Weld County Code, the
camper-trailer shall be abated as a dwelling unit.

RECREATIONAL VEHICLE: A transportation STRUCTURE or self-propelled vehicle with
or without flexible, removable or collapsible walls and partitions designed to be used as a
dwelling for travel, recreation or vacation USES and not exceeding eight(8)feet in width
or thirty-two(32)feet in length. The term RECREATIONAL VEHICLE shall include: motor
home,camper bus and travel trailer, but shall not include pickup trucks with camper shells
that do not extend above the cab of the truck. For the purpose of this Chapter, a
RECREATIONAL VEHICLE shall be subject to all requirements and restrictions for MOBILE
HOMES as provided in this Chapter when its placement is intended for nontransient
residency.
This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County
Centennial Center,915 10th Street, Greeley,Colorado. It is recommended that you or a representative be
in attendance to answer any questions the Board of County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties the
business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services'staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation including the action necessary to correct the violation,
and that you were given sufficient time to remedy this violation. If you have any questions concerning this

Dear Ms. Rosales and Ms. Thompson:
It has come to the attention of the Department of Planning Services'staff that the uses on your property may
not be in compliance with the Weld County Code, Chapter 23. The potential noncompliance(s) with the
Weld County Code are, as follows:
The utilization of a Camper-Trailer/Recreational Vehicle as a dwelling unit.
Our records indicate the use of only 1 (one) of the stick built structures on the property as a
dwelling unit.
As we discussed on April 11, 2003, to bring the property into compliance the following shall occur:
The Camper-Trailer/Recreational Vehicle shall be permitted. This is currently anticipated to be
addressed at the May 13, 2003 Violation Hearing (additional information will be sent within a
week of this letter).
It shall be determined which structure will be utilized as a dwelling unit.
The remaining structure shall be abated by either repair or it shall be boarded to reduce the
ability to access. Should you choose to repair the 2n°stick built structure, it still will not be eligible
to be considered as a dwelling unit, unless additional applications are received, such as but not
limited to a Use by Special Review application.
Please contact me within five working days of the date of this letter to review these concerns with me.
Failure to close this violation or efforts to show progress, will result in a thirty-day violation notice being
issued. Feel free to contact me at the above address, telephone number or e-mail address. If you wish to
see me personally, please call to schedule an appointment so that I may reserve a sufficient amount of time
with you.

Please be advised that after meeting with Ms. Venetta Rosales (acting on behalf of Ms. Thompson), the
Department of Planning Services has come up with the following list of requirements allowing her to obtain the
septic permit:
1.) A violation hearing has been scheduled for May 13, 2003 at 10:00 a.m. before the Board of County
Commissioners. In this hearing Ms. Rosales will be asking that the Board allow Ms.Thompson to utilize the RV-
Camper/trailer instead of a Mobile Home to be utilized as a "Temporary Medical Hardship".
2.) That a building permit be obtained prior to May 13, 2003 for the remodeling of one of the stick built homes.
3.) That the other stick built structure be abated by the boarding of all windows and doors.
Prior to the finaling of the Septic Permit(SP-0300115) the above conditions shall be completed.
Therefore, please be advised that we are requesting the release of Septic Permit(SP-0300115).
