A public hearing was conducted on October 1, 2003, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated September 12, 2003, and duly published
September 18, 2003, in the South Weld Sun, a public hearing was conducted to consider the
request of Marcum Midstream 1995-2 Business Trust, for a Site Specific Development Plan and
2nd Amended Use by Special Review Permit#996 for an Oil and Gas Support Facility(Brinewater
Disposal) in the A(Agricultural)Zone District. Lee Morrison,Assistant County Attorney, made this
a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the record
as written. He stated the site is located on approximately 12 acres, and it lies within the three-mile
referral area of the Town of Kersey. Mr. Ogle stated the original permit was issued in 1992 and
amended 1993, and this expansion will add six storage tanks to the existing 18 tank farm, for an
increase of 1,000 to a total of 6,000 barrels on average per day, and an expansion of 480 feet to
the pump house. Mr. Ogle stated the surrounding property is predominately agricultural with single
family residences in the immediate vicinity. He stated potable water will be provided by bottled
water, and the existing individual sewage disposal (vault) system handles the effluent flows. Mr.
Ogle stated the primary access is from Weld County Road 46, a local gravel road; and the primary
haul route will be from Weld County Road 53 traveling north or south. Mr. Ogle stated of the ten
referral agencies which reviewed this proposal, seven offered comments, some with specific
conditions, and no letters have been received from surrounding property owners. Mr. Ogle offered
photographs of the property. Responding to Commissioner Geile, Mr. Ogle reiterated the
modification to the original application, includes six additional 500-barrel tanks, increasing the
capacity to a total of 6,000 barrels, and the amendment is for the purpose of allowing the applicant
to keep more water on site. Cindy Etcheverry, Department of Public Health and Environment, was
present to answer questions. Don Carroll, Department of Public Works, stated the site is located
five miles south of Kersey on Weld County Road 53, which is paved, at the intersection with Weld

County Road 46. Mr. Carroll stated there is an existing road maintenance agreement, under which
Conquest maintains the road from the site entrance on Weld County Road 46 to Weld County
Road 53, including dust abatement, since it is associated with the designated haul route. Mr.
Carroll stated the site has been worked since 1992, and there has been good cooperation with the
applicant, there have been no problems with them, and the trucks utilize the haul route.
Dale Butcher, applicant representative, stated he has been in this oil basin since 1986 and he has
never been this busy. He stated there is more activity going on than in the last 15 years, and he
explained this application would give Conquest the ability to store more water to pump into the
ground on an even basis throughout the week. Mr. Butcher stated that with the current capacity,
if they pump seven days a week, 24 hours a day, there is a period of approximately 12 hours on
Sunday during which they have no water to pump; therefore, they need another 12 hours of
capacity, or approximately 1,500 barrels per week. Responding to Commissioner Masden, Mr.
Butcher stated the applicant prefers to pump 24/7, and they deal with problems as they arise,
although there are a couple of other wells in the area. Mr. Butcher stated they do a lot of
preventative maintenance, therefore, there is not much downtime.
No public testimony was offered concerning this matter. Chair Long verified Mr. Butcher stated he
agrees with the Conditions of Approval and Development Standards.
Commissioner Vaad moved to approve the request of Marcum Midstream 1995-2 Business Trust
for a Site Specific Development Plan and 2nd Amended Use by Special Review Permit #996 for
an Oil and Gas Support Facility (Brinewater Disposal) in the A (Agricultural) Zone District, based
on the recommendations of the Planning staff and the Planning Commission, with the Conditions
of Approval and Development Standards as entered into the record. The motion was seconded
by Commissioner Masden, and it carried unanimously. There being no further discussion, the
hearing was completed at 10:35 a.m.
