This letter outlines the topics reviewed and discussed during the January 30, 2003 meeting. 1. The necessity of amending the existing Conditional Use Permit through a Use by Special Review application to enable the present and future occupants of the housing units to live in the building year round. Presently the Conditional Use Permit limits the occupancy of the dwelling units to a period of time May through September of any year. 2. Septic concerns. Continue working with Pam Smith, Weld County Department of Public Health and Environment to address and resolve the outstanding issues. 3. Written evidence that the tenants occupying the housing units are employed year round as "Farm Labor"for area farmers. 4. Physical evidence that the elements associated with the Noncommercial Junkyard, consisting of Derelict Vehicles and miscellaneous debris, are screened at all times from adjacent property owners and public rights-of-way. As an interim measure, acknowledgment that these elements will be screened or removed from the property and that appropriate action will be taken for compliance. 5. Connie O'Neill, Weld County Department of Public Health and Environment spoke to you about the existing water issues, including providing direction as to how to permit the community water supply for this facility. 6. Javier was provided with a "Notice of Inquiry" form dated January 30, 2003, to be sent to the Town of Hudson. This form acknowledges that the facility is within the Urban Growth aDD3- 35�� // -io -ac9/O Boundary area recognized by Weld County Government and the Town. Weld County Department of Planning Services is in receipt of a letter dated February 6, 2003 from the Town Board of Trustees stating their concerns and issues. A photocopy of this letter is enclosed. As discussed, and as stated in the Town's letter, the Town of Hudson does not wish to consider an annexation petition for the above referenced property. Given this development, this office will require a Use by Special Review application to be submitted to this office by Friday February 28, 2003. Please contact me within five working days upon receipt of this letter to review these concerns with me. The buildings,RV units and other modular buildings appear to need major repairs and may be in serious violation of building, health and safety codes. 5. The property is not compatible with the Town's current Comprehensive Plan for the area. 6. Significant utility development costs would be involved to serve the property if it were annexed to the Town. • 7. A large pond in the southwest corner of the site maybe contaminated from manufacturing operations previously conducted on the site and is currently a dumping ground for trash and other debris. The Town would be reluctant to the consideration of any annexation petition for the property until the above issues and concerns could be satisfactorily resolved. NARRATIVE FACTS : ON 081702 AT APPROXIMATELY 1650 HOURS UPON DOING A DIRECTED PATROL THROUGH THE HUDSON SPANISH COLONY, I DROVE PAST AN AREA IN WHICH WE 'VE HAD A PROBLEM WITH SEVERAL VEHICLES WHICH HAD BEEN LEFT ON SCENE WITH TRUNKS THAT CHILDREN COULD GET INTO, AS WELL AS ABANDONED REFRIGERATORS . UPON MY WARNING ADVISEMENT THAT THEY NEEDED TO REMOVE THE ITEMS IN TWO WEEKS, I WAS CHECKING AND UPDATING THE AMOUNT OF WORK THAT HAD TAKEN PLACE SO FAR. I OBSERVED A BOBCAT TYPE FRONT LOADER POURING APPROXIMATELY ONE AND A HALF INCH ROUND ROCKS INTO AN APPROXIMATELY 40 FOOT BY THREE FOOT WIDE TRENCH WHICH HAD BEEN COMPLETELY FILLED WITH A GREENISH COLORED WATER. UPON CLOSER EXAMINATION, I SAW THAT THE LINE WAS RUNNING IN THE DIRECT LINE FROM THE BUILDINGS AT THE SPANISH COLONY AND APPEARED TO BE A DIRECT LINE WITH THE CURRENT SEWAGE SYSTEM. I THEN MADE CONTACT WITH JAVIER RODRIGUEZ-QUINTANA TO GIVE THE ABOVE VERBAL PARAPHRASED STATEMENTS . HE ALSO POINTED OUT WHERE THE SEPTIC SYSTEM WAS AND I NOTICED THAT THERE WAS A DEPRESSION THAT RAN ALONG THE SAME ANGLE CONSISTENT WITH THE LINE WHICH HAD CURRENTLY BEEN BACKFILLED OVER. THERE WAS ALSO SOME COLLAPSING OF THE DIRT AS IT SETTLED AND THE LINE WENT DIRECTLY FROM THE RESIDENCES AT THE SPANISH COLONY . IT DID NOT COME FROM THE DIRECTION OF THE SEPTIC SYSTEM WHICH IS APPROXIMATELY 50 FEET AWAY FROM OUR PRESENT LOCATION AND AT A COMPLETELY DIFFERENT ANGLE . I THEN REMOVED MY CAMERA AND TOOK SEVERAL PHOTOGRAPHS OF THE OPEN TRENCH, AS WELL AS I HAD THE HUDSON CODE ENFORCEMENT OFFICER ALSO RESPOND. HE MADE SOME PHONE CALLS TO DETERMINE WHETHER OR NOT THE CURRENT SEWAGE SITUATION WOULD POSE A HEALTH RISK TO THEIR WATER SUPPLY, AT WHICH TIME HE SAID THAT IT WOULDN ' T, AND TOOK NO FURTHER ACTION . AFTER PROCESSING THE PHOTOGRAPHS, AND PUTTING THEM INTO EVIDENCE, I REQUESTED THAT THIS CASE BE SHIPPED OUT TO THE HEALTH DEPARTMENT, TO BETHANY SALZMAN WITH PLANNING AND ZONING, FOR HER FOLLOW-UP AND PROPER ACTION.
