Owner/Authorized Agent President Rev:1.9-01 15 • Northern Colorado Constructors, Inc. Use by Special Review Questionnaire Response For NCCI Pit #1 Explain in detail the proposed use of the property. Northern Colorado Constructors (NCCI) is making application to Weld County for a Use by Special Review permit to mine, process and sell sand and gravel on a parcel of land owned by NCCI in Weld County, Colorado. The project will consist of mining approximately 75 acres of the 102 acre site. The mining will take place in 7 phases over the next 10 to 12 years with approximately 26 acres being disturbed at any one time. The mining will be done with scrapers, front-end loaders, trucks and conveyors. The product will be processed on the site with crushers and wash equipment. The product will be loaded into trucks by front-end loader and removed from the site over county and state roads. Explain how this proposal is consistent with the intent of the Weld County Comprehensive Plan. Section 22-5-80 of the Weld County Comprehensive Plan entitled "Commercial and mineral resource deposits goals and policies" states in A. 1. CM. Goal 1. "Conserve lands which provide valuable natural mineral deposits for potential future use in accordance with state law." This site contains a significant commercial deposit of sand and gravel located in the alluvium of the South Platte River and is available for extraction. Paragraph B. 1. CM. Goal 2. "Promote the reasonable and orderly development of mineral resources." There other mining operations within one-half mile of this site which indicates this area is ready for reasonable and orderly development of the resource. Paragraph B. 2. CM. Policy 2. " The operation of a mine site in unincorporated Weld County shall be subject to obtaining a use by special review permit in accordance with Chapter 23 of this Code." NCCI is applying for a use by special as stated in this policy. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23, and the zone district in which it is located. Chapter 23 of the Weld County Code Zoning Section 23-3-40. Uses by special review. "The following buildings, structures and uses may be constructed, occupied, operated and maintained in the A (Agricultural) Zone District upon approval of a permit in accordance with the requirements and procedures set forth in Article II, Division 4 of this Chapter." Paragraph A. 3. "Open Pit Mining and material processing, subject to the provisions of Article IV, Division 4 of this Chapter." This site is in the A zone district and is considered a proper use with the proper permit. What type of uses surround the site. Explain how the proposed use is consistent and compatible with the surrounding land use. This site consists of pasture land with several old meander stream beds through the site. The site is very flat sloping very gently to the northeast. The site is poorly vegetated with poor grass and noxious weeds. The South Platte River lies approximately 2200 feet east of the site. The Meadow Island Ditch#1 is located along the west boundary of the site and a discharge ditch from Sand Hill Reservoir lies along the south boundary. According to the Federal Emergency Management Agency flood insurance rate map panel number 080266 0868 C & 0866C the entire site is in the 100 year flood of the South Platte River. There are three gas wells on the property and one tank battery serving tw rof the wells. Adjacent land uses include irrigated agriculture land to the north, pasture land to the west, pasture land and a tree farm to the east and pasture land and several homes to the south. The site is bounded on the east by Weld County Road 25 and on the south by Weld County Road 18. There is an existing gravel pit one-half mile north of the site and another mine one-forth mile southeast of the site. The existing structures on the site will be removed at the proper time so as to not interfere with the mining process. At the completion of the project the resulting ponds, after reclamation, will be used for water storage. Sand and gravel operations are generally located in areas like this site and the operators will do what is necessary to be compatible with the surrounding land uses. The end use of the site will be irrigation water storage which will be very compatible with the agriculture nature of the area. Describe, in detail the following. How many people will use this site? - 10 How many employees are proposed to be employed at the sit?. - 10 What are the hours of operation? — 7AM to 7PM What type and how many structures will be erected on the site? There will be a portable office and a scale house. There will also be a shop building for machine repair. What type and how many animals will be on this site? None What kind of vehicles will access this site? There will be 22 ton gravel trucks, 16 ton gravel trucks, pick-ups and cars. Who will provide fire protection to the site? Fort Lupton Fire District r What is the water source on the property? Bottled water will be used for domestic use. There will be no irrigation. What is the sewage disposal system on the property? Portable units will be used. If storage or warehousing is proposed, what will be stored? The only storage on the site will be sand and gravel in outdoor piles. Explain the proposed landscaping for the site. Explain the proposed reclamation procedures. The landscaping and reclamation is explained in the attached reclamation plan as submitted to the Department of Minerals and Geology. The mining plan as submitted to the state is attached. Explain how the storm water drainage will be handled on the site. The storm water on the undisturbed portion of the site will be handled the same as it is now. The storm water either infiltrates into the soil or flows to the existing drainage ditches. The storm water on the disturbed portions of the site will be directed to the pit effluent pond and discharged to the Platte River with the pit dewatering effluent. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. The mining process is scheduled to begin in early 2002 and the landscaping and reclamation will take place as the mining is completed. It is anticipated it will take 10 —12 years to complete the project. Explain where storage and/ or stockpile of wastes will occur on this site. There will be stockpiles of overburden which will be used in the reclamation of the site but there will be no waste material generated on the site except that from the office and shop which will be disposed of by commercial trash haulers. • DESCRIPTION OF MINING OPERATION NCCI PIT#1 A. There shall be 4 loaders, 5 haul trucks, a crusher, a wet screen and stacking conveyors used on the site. B. The site shall have 1 shift worked with a maximum of 15 employees and an average of 10 employees. C. The pit will be a dry pit. D. The traffic from the site will use Weld County Roads 18 and 25 and the bridge at the intersection of roads 18 and 25. E. There will be 2 stages active at one time, each stage is approximately 10 acres. F. The entire project will take between 8 and 10 years depending on demand for the product. There are 7 stages each will require approximately 12 to 16 months to complete each stage. G. The over burden to be removed is approximately 2 feet thick and the mineral deposit is approximately 28 feet thick. H. The proposed end use of the site is for lined irrigation water storage. The reclamation process is explained in the attached reclamation plan approved by the State of Colorado Department of Minerals and Geology. I. The technical advice for this type of reclamation comes from the Platte Valley Soil Conservation Service and Rollin Consulting. There is a complete mining plan narrative attached that has been approved by the Colorado Department of Minerals and Geology. • EXHIBIT D - MINING PLAN This section follows the requirements outlined in Section 6.4.4 of the Colorado Mined Land Reclamation Boards Construction Rules and Regulations. A. Background The purpose of this application is to obtain authorization for Northern Colorado Constructors Inc. —Aggregate Division(NCCI)to mine,process and sell sand and gravel and to operate a concrete batch plant on property owned by NCCI. NCCI will mine approximately 73 acres of the 102 acre parcel located at the northwest corner of the intersection of Weld County Roads 18 and 25.Please see the attached index map (Exhibit B) for the specific location of the area to be mined. B. Operational Methods a. Description of mining method: The applicant will begin mining on the north side of the mining area and proceed through the site in phases as shown on the Mining Plan Map. Upon completion of mining Phase I, the site will be mined from north to south with the processing area being at original surface until there is enough space in the pit to move the operation into the pit. A typical section will be about 10 acres in size. Only one section or .-. portions of two sections and the processing area will be disturbed during any phase of mining. This will minimize the amount of land disturbed at any one time. Please refer to the Mining Plan Map for details on the phasing order. Site preparation Initial disturbance of the property will include removal of topsoil from the first phase, establishing a processing area and dewatering. Proposed Mining Process for Each Section Before any mining commences, the operator will install a dewatering trench around the section to be mined. This water will be pumped and discharged into a pond on the property or into a ditch which discharges to the Platte River pursuant to a discharge permit from the Colorado Department of Public Health and the Environment (CDPHE). The site will comply with all CDPHE regulations including monitoring and reporting requirements for the life of the mine. After the section is dewatered, loaders and trucks will strip the topsoil and stockpile it. The overburden will ultimately be used in reclaiming and sloping the shore. When the alluvium is sufficiently dry, an excavator will place the gravel on conveyors or NCCI Mining Proposal for the NCCI Pit#1—MLRB II2Permit 14 haul trucks which will convey the material to the processing area. As the area is mined, overburden will be placed along the edges to create the shoreline of a future pond. Topsoil will be placed on finished grades and the area will be seeded. After the mining of a phase is substantialy completed, a dewatering trench will be constructed around the next phase to be mined and the process will begin again. b. Earthmoving: sand and gravel will be excavated by loader and loaded onto conveyors or haul trucks which will convey the material to the processing area. c. All water diversions and impoundments: the perimeter of the mining phase will be dewatered by digging a trench approximately 34 feet deep to bedrock. The water will be pumped and discharged into a pond on the property, then into a ditch which discharges to the Platte River. Wash water for the processing equipment will be recycled through a series of small ponds within the processing site (see Mining Plan Map). Upon completion of mining Phase I, the wash ponds will be relocated to the Phase I mining area for the remainder of the operation. All water required to operate the facility will be provided by the existing water rights associated with the property or water rights purchased for the project. d. Size of the area to be worked at any one time within the mining area: excluding the processing area and stockpiles, a maximum of 25 acres will be disturbed at any one time. Concurrent reclamation of the site will include grading, replacement of topsoil and seeding of the pond embankments. Undisturbed areas will be managed as irrigated pasture or other appropriate cover crop until mining commences on each phase. e. Timing: The applicant anticipates that mining will begin in the winter of 2001. It will take approximately 8 to 10 years to mine and reclaim this property. Annual production is estimated to be between 320,000 and 500,000 tons. This may vary depending upon the demand for construction material which may impact the total life of the mining operation. The property will be mined in 7 phases, each phase will take between 10 to 16 months to complete (see Mining Plan Map). Reclamation will proceed in conjunction with the mining of each phase and will consist of regrading, backfilling, replacement of topsoil and seeding of pond banks. f. Nature, depth and thickness of the deposit to be mined and the thickness and type of overburden to be removed: Please refer to Exhibit I — Soils Information for a copy of the test hole logs. The nature, depth and thickness of the deposit to be mined and the thickness and type of overburden to be removed is shown on the test hole logs. NCCI Mining Proposal for the NCCI Pit#1—MLRB 112Permit 15 • The primary commodity to be mined/extracted is sand and gravel. The intended use is for construction materials. Anticipated incidental production will include gold that is recovered as part of the standard washing and screening operation. NCCI Mining Proposal for the NCCI Pit#1-MLRB 112Permit 16 EXHIBIT E - RECLAMATION PLAN This section follows the requirements outlined in Section 6.4.5. The proposed mining and reclamation plans focus on minimizing the ecological impacts of mining, minimizing the length of time of impact and maximizing long-term benefits. A. Describe the type(s) of reclamation the Operator/Applicant proposes to achieve,why each type was chosen,the amount of acreage accorded to each, and a general discussion of reclamation methods as related to the mechanics of earthmoving. NCCI developed the reclamation plan based on the depth and configuration of the gravel resource. Reclamation for the mining area includes: Ponds NCCI will create five ponds during final site reclamation. The lakes will total approximately 67 acres in size. Anticipated uses include irrigation water storage and recreational use. Earthmoving The topsoil will be replaced by loaders and generally graded with a blade. All grading shall be done in a manner that controls erosion and siltation of the affected lands to protect areas outside the affected land from slides and other damage. In addition, all backfilling and grading shall be completed as soon as feasible after the mining process. All disturbed areas shall be regraded and smoothed to a finished grade that is suitable for revegetation or the final land use. NCCI Mining Proposal for the NCCI Pit#1—MLRB 112Permit 17 As noted previously, the area will be reclaimed as mining proceeds. Backfilling, finish grading, topsoil placement and seeding will occur throughout the life of the mine. Shoreline treatment will include slope variation to encourage diversity in the type of vegetation that will thrive on the reclaimed property. Typical cross-sections of the shorelines are included on the Reclamation Plan Map. B. Compare the proposed post-mining land use to other land uses in the vicinity and to adopted state and local land use plans and programs. The land use in the area is generally agriculture and the post-mining use of water storage and wetlands will fit with the current surrounding uses. There is a water storage gravel pit approximately % mile north of this site. The gravel mining proposal and Sketch Plan application are currently being reviewed by Weld County. We will forward a copy of the County's recommendation regarding the Special Use for Gravel Mining once the Weld County review process has been completed. A. Describe how the Reclamation Plan will be implemented to meet each applicable requirement of Section 3.1. The Operator will carry all reclamation to completion with reasonable diligence, and each phase of reclamation shall be completed within five years from the date the Operator informs the Board or Office that such phase has commenced. NCCI will comply with all reclamation measures set forth in Section 3.1.5: Grading will create a final topography that is appropriate for ponds and anticipated future land use. All grading will be performed to help control erosion and siltation of the affected lands. All backfilling and grading shall be completed as soon as feasible after the mining process. Any drill or auger holes that are part of the mining operation shall be plugged with inert material, which shall prevent harmful or polluting drainage. Maximum slopes and slope combinations will be compatible with the configuration of surrounding conditions and selected land use. All slopes will be compatible with specified MLRB standards. All mined material to be disposed of within the affected area will be handled in such a manner so as to prevent any unauthorized release of pollutants to the surface drainage system. NCCI will comply with applicable Colorado water laws governing injury to existing water rights and with applicable state and federal water quality and dredge and fill laws and regulations. The Applicant will stabilize and protect all surface areas of the affected land, including spoil piles so as to effectively control erosion. NCCI will comply with all standards and conditions applicable to classified and unclassified groundwater. NCCI Mining Proposal for the NCCI Pit#1—MLRB 111Permit 18 NCCI will protect the existing and"reasonably potential" future uses of groundwater. We are in process of applying for a well permit and required temporary substitute supply plan to augment evaporative loss from the ponds. We will forward copies of the appropriate documents once the State Engineer has completed review of the applications. All aspects of the mining and reclamation plans shall take into account the safety and protection of wildlife on the mine site, at processing sites, and along all access-roads to the mine site with special attention given to critical periods in the life cycle of those species which require special consideration. Topsoil shall be removed and segregated from other spoil. Topsoil stockpiles shall be stored in places and configurations to minimize erosion and located in areas where disturbance by ongoing mining operations will be minimized. Once stockpiled,topsoil shall be rehandled as little as possible. In those areas where revegetation is part of the reclamation plan, land shall be revegetated in a way as to establish a diverse, effective, and long-lasting vegetative cover that is capable of self-regeneration without continued dependence on irrigation or fertilizer and is at least equal in extent of cover to the natural vegetation of the surrounding area. NCCI will post appropriate signage at the entrance to the mine site. D. Plans for topsoil segregation, preservation and replacement; for stabilization,compaction, and grading of spoil; and for revegetation. Topsoil shall be removed and segregated from other spoil. Please refer to the Mining Plan Map for specific location of stockpiles. For reclamation, topsoil will be replaced by a loader and generally graded with a blade. All grading shall be done in a manner that controls erosion and siltation of the affected land to protect areas outside the affected land from slides and other damage. In addition, all backfilling and grading shall be completed as soon as feasible after the mining process. Final grading will create a final topography that is appropriate for the final land use. For example, final grading along lake shores will replace topsoil at a maximum 4:1 slope to meet the grade at the top of the banks. Topsoil will be replaced on all slopes above the high water line. Bare mineral soil along the shoreline wetland bench (below the high water line) will be scarified in mid-May to late June to allow for Cottonwood and other wetland vegetation establishment. Topsoil will be uniformly placed and spread on all areas disturbed by the mining, above the anticipated high water line. The minimum thickness shall be to 6 to 12 inches above the surrounding finished grade. The topsoil shall be keyed to the underlying and surrounding material by the use of harrows, rollers or other equipment suitable for the purpose. In those areas where revegetation is part of the reclamation plan, NCCI will revegetate the land in such a way as to establish a diverse, effective, and long-lasting vegetative cover that is capable of self-regeneration without continued dependence on irrigation or fertilizer and is at least equal in extent of cover to the natural vegetation of the surrounding area. Seed will be drilled and mulched. NCCI Mining Proposal for the NCCI Pit#1—MLRB 112Permit 19 The revegetation plan shall contain a list of the preferred species of grass, legumes, forbs, shrubs or trees to be planted, the method and rates of seeding and planting, the estimated availability of viable seeds in sufficient quantities of the species proposed to be used, and the proposed time of seeding and planting. The seeding mixture shall be applied at a pure live seed (PLS) rate per acre per the drawings. The formula for determining the quantity of pure live seed (PLS) shall be: Pounds of Seed (Bulk) X Purity X Germination = Pounds of Pure Live Seed (PLS) All grass seed furnished shall be delivered in sealed bags showing weight, analysis and vendor's name. In certain areas where access is limited, seeding may be accomplished by hand broadcasting seed over the area. Special care shall be taken to assure the proper seeding rate is used on these areas. After broadcasting of the seed has been accomplished, the seed shall be raked into the soil to a depth of 1/." to 1/4" and rolled. The seeding mixture shown above applies at twice the pure live seed (PLS) rate per acre. NCCI Mining Proposal for the NCCI Pit#1—MLRB II2Permit 20 r-, Fertilization will be determined at final reclamation based on a soils test performed by Colorado State University in conjunction with the Soil Conservation Service. Material for mulching shall consist of hay or straw, oats, wheat, barley, or rye, and shall be free of noxious weed seeds. At least 50% of the mulch by weight shall be uniform in length. Mulch will be applied to seeded areas. All newly seeded areas shall receive a uniform layer of mulch applied at the rate of 2 tons per acre, crimped with a crimper or other approved methods. Seeding will take place once final grading and replacement of topsoil have been completed for each phase. Timing of seeding will be consistent with standard horticultural practice for dryland applications - generally between late September and the middle of April to assure adequate moisture for germination. Long term maintenance of the shoreline vegetation will be the responsibility of the end user. D. A schedule indicating how and when reclamation will be implemented. The schedule shall include: 1. An estimate of the periods of time which will be required for the various phases of reclamation; Reclamation will proceed concurrent with each phase of the mining. Backfilling, grading and replacement of topsoil will be completed as soon the material adjacent to the pond bank has been removed to a point that will allow shaping of the bank or backfilling of the area. The backfilled areas and regraded banks will be seeded at the earliest appropriate time to ensure there is adequate moisture for germination. 2. A description of the size and location of each area to be reclaimed during each phase; and Reclamation for each phase will consist of backfilling, regrading, replacement of topsoil and reseeding of perimeter banks and backfill areas. This area will consist of approximately 3-5 acres. The final phase will also include removal of the processing equipment. The operator will regrade the area, replace the topsoil and reseed it. It is anticipated that the site access road and haul road will be used for future access to the site. 3. An outline of the sequence in which each stage or phase of reclamation will be carried out. The reclamation sequence will proceed concurrently with mining and will include ^ NCCI Mining Proposal for the NCCI Pit#1—MLRB I I2Permit 21 backfilling, regrading of mined sites, replacing 6 to 12 inches of topsoil and seeding during the appropriate season to assure adequate moisture for germination and weed control to assure that grasses can establish. I have discussed the sanitation requirements with the Weld County Health Department and we are in the process of requesting that we be allowed to use the existing system if it is found to be suitable. If it is not usable we will request the use of a vault on the site. If this is not allowed we will construct a septic system that is approved by the County. There is an existing well on the site which is for domestic use. We have contacted the state engineer and this well can be changed to commercial use . We are in the process of making this change now. We have included in the plan set-backs from all property lines of 25 feet and 200 feet from ditches. Also we have agreed with the oil companies to use their requested setbacks at all facilities. The buildings on the site will be removed when mining starts so the will be no setback required. I have enclosed a copy of the reclamation plan for the site, as approved by the State of Colorado Department of Minerals and Geology, which indicates the location of the irrigation water lakes.
