RESOLUTION RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING AMENDED USE BY SPECIAL REVIEW PERMIT#713 FORASALVAGE YARD IN THE A(AGRICULTURAL) ZONE DISTRICT - MANUEL AND ANITA BALDERAS, DBA M AND B SALVAGE WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,on July28,2003,a Show Cause Hearing was conducted to consider revocation of Use by Special Review Permit#713 for a Salvage Yard in the A(Agricultural)Zone District,issued to Manuel and Anita Balderas, dba M and B Salvage, 2732 Weld County Road 27, Fort Lupton, Colorado 80621-8312, and WHEREAS, Manuel and Anita Balderas are the current owners of the facility located on property being further described as follows: SE1/4 of Section 22, Township 2 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS,at said hearing of July 28,2003,the Departments of Public Health and Planning Services advised the Board, by Memorandum, that the facility has come into compliance with Development Standards as set forth in Amended Use By Special Review Permit#713, and WHEREAS,after hearing all testimony presented,the Board deemed it advisable to dismiss said Show Cause. Some of these vehicles are upside down. The vehicles which still contain fluids, need to be remedied. Standard#10 The cars and salvage materials shall not exceed 6 feet in height. - In some areas, vehicles are currently parked 10 - 12 feet in height. Standard#16 The property owner or operator shall be responsible for complying with all of the foregoing Developments Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. -Violation of Development Standards#3 & 10 of AmUSR-713. REMEDY To bring the property into compliance, the vehicles shall be drained, thus insuring the adequate containment of fluids. Mr. Balderas shall continue to provide copies of receipts for fluid pick-up, showing adequate disposal. Additionally, the stacks of vehicles shall be reduced to only be 6 feet in height. 2003-0856 RECOMMENDATION The Department of Planning Services that this case be scheduled for a Show Cause Hearing, but to schedule the hearing out about 4 (four) months to allow adequate time for the violations of the AmUSR- 713 to be corrected. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services." #16,which states:"The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners." As we previously discussed time will be of the essence; however, failure to correct this problem will result in this office scheduling a Probable Cause Hearing before the Board of County Commissioners. It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we have no discretion in this matter if you fail to correct this violation. Our home is located directly north of the salvage yard. I believe there are some safety and health concerns with the yard. There are stacks of cars piled on top of each other probably in the six to seven foot range in height. Along the north fence line cars are piled fence high, and have been there for years and years. There are piles of batteries, engine blocks, and other parts lying around. I am sure all the fluids, etc. are leaking into the soil and eventually into the ground water supply. Many times there are cars parked in front of the old shop which faces Road 18. These cars are right next to the road, and present a traffic hazard. I would like to emphasize that I have no objection to the operation of this business, but I do feel they should be made to live by the rules of their use permit. The way it is now, it is a definite risk in the areas of health and safety, and it is extremely unsightly. To put it bluntly, the place needs cleaned up. Sincerely, Sharon L. During an on site inspection conducted July 22, 2003, the following activities were observed to have taken place since the last hearing: 1. Waste oil is removed regularly by an oil recycling company. 2. Antifreeze is recycled at the facility or removed by recycling company. 3. Freon removal contractor has been obtained. 4. Cars and salvage materials previously stacked above 6 feet in height have been removed.
