HomeMy WebLinkAbout20033308 JESSE & DEBBIE BANEK 27701 WCR 66 GILL,COLORADO 80624 (970)353-3675 July 29,2003 DEPARTMENT OF PLANNING SERVICES 1555N.17th AVENUE GREELEY,COLORADO 80631 To: Department of Planning Services We are within 500 feet of Mark and Kristi Weimer(case#USR-1432),who are applying for a Special Use Permit to park company equipment associated with their trucking company and operate their company from their single family residential dwelling. We have many concerns and objections to this permit being issued because it has already affected our living lifestyle and we also have safety concerns for our young inexperienced driver having to deal with added truck traffic. We are zoned residential and having a trucking company and all the equipment that goes along with it has taken from the value of our homes/property and serenity of our surroundings. There have been times that we have documented up to seven trailers parked along our east boundary and up to three trucks parked in various places on the property. These trucks and tractor- ..., trailers arrive and depart at various times of the day and night,Saturdays and Sundays and even on holidays. Nothing is more frustrating then trying to have a family picnic on a holiday and hear the sounds of air brakes,truck engines running for hours,taking away our countryside view,and dealing with the dust that their trucks create. The care and upkeep that they have done to their property has not been what we were told they would do,considering that they would be stirring up dust making excessive noise,and taking away our country view to the community and especially us. Mr.Weimer led us to believe that they would be interested in planting a tree barrier between properties,which we have already done at a three hundred dollar expense to us. He has also mentioned on different occasions of placing a dust bather on the road,which has only been done once since they began building the property. They have done very little upkeep and maintenance of their acreage,they have barely contained the weeds on the property or planted a yard or anything that would help with the dust from their truck traffic or the view of their trucking operation. Upon moving into their acreage Mr.Weimer did place gravel and asphalt chips where the tractor-trailers are parked. Lastly,our concern is the different traffic that we believe are their truck drivers coming in and out of their residents at various times of the day and night. It is very frustrating for us to pay the price to live out in the country and have a trucking company built right next door to us. How can this have taken place and why did the Weimer's not have to apply for a permit prior to running a business out of a residential dwelling? Having neighbors is always going to be a possibility but having a trucking company built and being run within 500 feet of our dwelling does not seem right. We thought this is what commercial zoning was for. On the following page is a list of some of the occurrences that have taken place with their trucking company that we believe have and will continue to affect our living lifestyle. We have also provided photos of how their company has affected our view by trucks,tractor- -- trailers,very minimal ground upkeep and also a picture of the tree barrier that we planted. He responded by saying,"I am an owner operator and an Independent trucker". This led us to believe one truck one trailer not a trucking company that so far consists of three trucks and seven trailers. May4,2003: We were invited by the Weimer's to their residence for an Ice Cream social to discuss the fact that Mark and Kristi Weimer are applying fora permit that would allow him to operate up to three trucks, unlimited trailers and build an 80'by 40' shop on their residential dwelling. We chose not to attend because we are not in agreement with any kind of business being run out of a residential dwelling that is within 500 feet of our property and has already and will continue to affect our living lifestyle. However,our neighbors to the south attended and informed us of Mr. Weimer's plans and they also are not in favor of this because they are concerned it will bring down the value of all the properties located by the Weimer property. May11,2003:Mother's Day We were trying to have a family barbeque and two trucks and trailers were coming in and out, ., they were left running and the constant sound of air brakes and moving equipment around was very frustrating on a holiday. The two tankers stayed parked there for the night. May12,2003: 5:25 am two trucks and tanker trailers departed. Driver's vehicles were parked in front of their house(again dealing with noise in the early morning hours). May18,2003: Sunday late in the afternoon two trucks pulled in turned around,backed up and again the constant noise of air brakes,back up beepers and the dust is frustrating on a Sunday afternoon. May19,2003: 5:20 am trucks are departing from residence again dealing with the early morning noise of air brakes and truck engines. May2O,2003: Two trucks pulled in around 8:45pm,turned around and then one of them was left running for over an hour before it finally departed. Trucks were idling from 3:00pm-4:30pm then they were unhooked and they were moving trailers all around and once again it was the constant noise of truck motors,air brakes,dust and taking away our country view. It looks and feels like we live next to a truck garage in town, rather then living out in the country trying to enjoy the holiday weekend and a family barbeque. May27,2003: 6:30am a driver started the truck and was pulling the tanker and left personal vehicle parked in the residence driveway. July4,2003 41°of July Holiday: Moving trucks around and at 5:00pm truck left during our barbeque. These are only some of the situations that we have documented that take place at the Weimer residence. However, like any trucking business there are many different things taking place during the day,at nights, holidays and weekends that are directly related to their business. We have many concerns about spending the rest of our lives next to a trucking company when our intentions were to live out in the country for some peace,serenity and a beautiful view,which we no longer have because our east boundary is now tractor-trailers and trucks. We believe anybody in our situation would understand that living by three trucks and seven tractor trailers,various drivers coming in and out of the residence,and running the business out of their home will take away a nice quiet lifestyle that we have worked so hard to obtain. Our property borders the Weimer property on the east side. We are concerned that a trucking company in a residential/agricultural neighborhood would greatly decrease our property value and the serenity of our rural lifestyle.We moved out here,from town,to escape the commercial/industrial ratrace. The noise of truck engines running and trucks coming and going at all hours of the night and day is already disrupting.Also the extra trailers and various equipment associated with a trucking company that starts to collect after awhile, ie: extra tires,axles,spare trailer parts etc.,we fear will be unsightly and greatly decrease our property value. We have also witnessed Mr. Weimer dumping liquid from a tanker onto his property.Mr.Weimer told us it was just water from washing out the tanker.But,what was in the tanker to start with that could be mixed with this water?? We live down hill from the Weimers. This mixture will eventually run down into our garden soil and lawn. In closing,we sincerely hope you will understand our opposition to this business being run out of the Weimer home.Please let us keep our quiet,rural setting as it was meant to be. Sincerely, A1 August 5th, 2003 r Department of Planning Services Case It USR-1432 County Planning Commissioners: My wife and I are out of state at a long planned family reunion and were unable to attend today's meeting. We desire that this letter shall serve to officially place our position on this issue into the public record. It should be read aloud if doing so will insure this wish. Our property is directly across the road from the Weimer residence, though our house sits back from the main road nearly 1500'. The issue at question is shall the Weimer residence be used for a commercial trucking business. We would prefer that it did not. As more family homes are built along county road 66, including two possible sites on the front side of our property directly across from this proposed business, the negative impact of this business will grow. We are concerned for the safety of children and animals with increased large truck use. Dairy trucks and farm equipment are already heavy on this road. We wonder at the increased need for road upkeep with grading and dust prevention which seems difficult to do already. We worry about the noise late at night and the impact visually that this business will have on potential home sales and other families who do not have an opportunity to comment on this decision today. Finally, we have talked with neighbors who live even closer to the Weimer's than we do and they strongly oppose this permit for the reasons we have mentioned here. For these reasons we must encourage you to deny this permit. The Weimer's have handled this situation very well by talking with neighbors and offering ideas to lessen noise, sight and other negative impacts on the surrounding homes. Unfortunately, we do not believe it is possible to do enough. I hope regardless of the outcome of this meeting that a good relationship can still exist. Thank you for your time today.
