RE: SHOW CAUSE HEARING CONCERNING USE BY SPECIAL REVIEW PERMIT#1098 FOR
A MAJOR FACILITY OF A PUBLIC UTILITY FORA9.5-MILE UNDERGROUND NATURAL
GAS PIPELINE IN THE A (AGRICULTURAL) ZONE DISTRICT - PRAIRIE MOUNTAIN
PIPELINE COMPANY/ B.P. PIPELINES (NORTH AMERICA) INC.
A public hearing was conducted on March 17, 2003, at 10:00 a.m., with the following present:
Commissioner David E. Long, Chair
Commissioner Robert D. Masden, Pro-Tem
Commissioner M. J. Geile - EXCUSED
Commissioner William H. Jerke
Commissioner Glenn Vaad
Also present:
Acting Clerk to the Board, Esther Gesick
Assistant County Attorney, Lee Morrison
Planning Department representative, Sheri Lockman
The following business was transacted:
I hereby certify that pursuant to a notice dated February 28, 2003, and duly published March 6,
2003, in the South Weld Sun, a public hearing was conducted to consider revocation of Use by
Special Review Permit #1098 for a Major Facility of a Public Utility for a 9.5-mile underground
natural gas pipeline in the A (Agricultural) Zone District, issued to Prairie Mountain Pipeline
Company by the Weld County Planning Commission on January 4, 1996. Bruce Barker, County
Attorney, made this a matter of record. He stated records indicate the applicant did not satisfy the
Conditions of Approval, the plat was never submitted for recording, and the pipeline was not
constructed. Following a request from B.P. Pipelines (North America) Inc., current permit holder,
the Board deemed it advisable to vacate said Use by Special Review Permit #1098 on March 5,
2003, therefore, he recommends this hearing be dismissed.
CommissionerJerke moved to dismiss the hearing to consider revocation of Use by Special Review
Permit#1098 for a Major Facility of a Public Utility for a 9.5-mile underground natural gas pipeline
in the A (Agricultural) Zone District, issued to Prairie Mountain Pipeline Company, do current
permit holder, B.P. Pipelines(North America) Inc., based on the recommendations of the Planning
staff and County Attorney. The motion was seconded by Commissioner Masden, and it carried
unanimously. There being no further discussion, the hearing was completed at 10:35 a.m.
