RE: ACTION OF THE BOARD CONCERNING DUST BLOWING COMPLAINT - SW1/4
SW1/4, S26, T2N, R64W
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, has been
informed, in accordance with Section 35-72-101(1), C.R.S., that dust is blowing from property
located in the SW1/4 SW1/4, Section 26, Township 2 North, Range 64 West of the 6th P.M.,
Weld County, Colorado, lying south of the railroad right-of-way, excluding that portion of said
property platted as the Town of Keenesburg, Colorado, and said property being owned and/or
operated Richard and Sharon Stewart, P.O. Box 248, Keenesburg, Colorado 80643-0248, and
WHEREAS, the Board has caused an inspection of the above described parcel of land,
and
WHEREAS, a hearing was held on the 24th day of March, 2003, at which the following
persons were present Norm Wells, Brighton U.S.D.A. Soil Conservation Service Office, and
WHEREAS, Richard and Sharon Stewart were notified of said hearing by first class
mail, dated March 14, 2003, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the recommendation of the Longmont Soil Conservation
District and all of the exhibits and evidence presented in this matter and, having been fully
informed, deemed it advisable to continue this matter to allow the property owner time to
appear before the Board to respond to the charge of blowing dust.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that this matter be, and hereby is, continued to March 31, 2003, at 9:00
a.m.
BE IT FURTHER RESOLVED, that Norm Wells, Brighton U.S.D.A. Soil Conservation
Service Office, be, and hereby is, requested to contact the property owners in an attempt to
develop a dust abatement plan.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 24th day of March, A.D., 2003.
