The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 18 is designated on the Transportation Plan Map as a local gravel road, which has an average daily
traffic count of 69 vehicles. This count was taken 7/10/2000.
REQUIREMENTS:
Access: The applicant indicated that the existing access from WCR 18 is to be used. It is a shared access
— with an existing home site. Also on the plat drawing, the applicant identified a future access point to WCR 18.
When this future access point is developed, the applicant shall provide a Weld County Access Information
Sheet to the Public Works Department for review and approval of a safe and adequate access.
Circulation: The access and circulation pattern shall be surfaced with gravel. The gravel shall support semi-
truck traffic and shall be graded to prevent drainage problems. The applicant has identified on the plat drawing
many 90° turns. All corners and intersections shall have adequate turning radius to accommodate large
trucks.
The applicant identified the gravel access road as being 20 feet in width, and it will be privately maintained.
Verification is required from the fire/emergency district in the area to determine if the 20 feet width is adequate
for their response.
Storm Water Drainage: This proposed USR site has ponds and a historical drainage pattern throughout the
property. Any time that the gravel access road crosses a drainage pattern, the applicant shall accommodate it
with a culvert crossing to provide an all-weather access to the facility. The storage magazines, metal boxes,
and trailers, and the type four units, should not block the historical flow pattern. The applicant indicated that no
personnel will work at the site full time, although there are approximately five operators and mechanics who
maintain the site.
The historical flow pattern and run-off amounts will be maintained in such a manner that will reasonably
preserve the natural character of the area and prevent property damage of the type generally attributed to run-
off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off.
'Future Right-of-Way: The applicant should verify with CDOT if there is a future right-of-way plan for the 1-76
corridor. This should be identified on the plat drawing.

Environmental Health Services has reviewed this proposal for a fireworks storage
facility. We have no objections to the proposal, however, we do recommend that the
following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
6. All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling.
7. The applicant shall operate in accordance with the approved "waste handling
plan".

There are no current or historical building permits on record for this parcel.
1. A building permit will be required for each storage structure. Although storage structures
such as those described in the USR application are not regulated by the building code, the
structures must be adequately anchored to the ground to resist wind pressures, and if placed
on foundations, the foundations must be inspected. Any electrical installation will require a
permit and inspections. The permit application shall include a plot plan showing distances
between all buildings and from buildings to property lines.
2. If structures are placed on foundations, the foundations shall be designed by a Colorado
registered engineer based on a soils report or an open hole inspection conducted by a
Colorado registered engineer. Submit two copies of the engineered foundation plan, stamped
by a Colorado registered engineer, at the time of permit application.
3. Setback and offset distances shall be determined by the Zoning Ordinance.
4. Building height shall be measured in accordance with Chapter 23 of the Weld County Code
in order to determine compliance with offset and setback requirements. Offset and setback
requirements are measured to the farthest projection from the structure.

The Department of Planning Services reviewed the above referenced Use by Special Review
Plat and offers the following comments:
Section 23-3-250.A.5.a states "That portion of a Lot which abuts a public or private street right-
of-way shall be landscaped for a distance of ten (10) feet, measured at a right angle from the
Lot line towards the interior of the Lot. Driveways may pass through the required landscaped
areas."
The applicant states that the on-site landscape treatment exists in the form of native grasses.
Given the use of the site and the location, a Landscape Plan is not required. The site shall
conform to Section 23-3-250.B.7, Property Maintenance specific to noxious weeds and the
height of all on-site grasses having a height of less than 12 inches.
Section 23-3-350.D provides for adequate street access. The applicant shall demonstrate a
safe and approved access. Appropriate language shall be included on the plat delineating the
access to this parcel.
The internal circulation within the fenced storage yard appears to be adequate. The Department
of Public Works shall be contacted to verify all access requirements Additionally, the Fire
District shall review the plan for compliance with their requirements.
Section 23-3-250.A.9 addresses outside storage. Uses involving outdoor storage of vehicles,
equipment or materials when permitted shall be screened from public rights-of-way and
adjacent properties.
Section 23-3-350.H addresses the issue of trash collection areas. Areas used for storage or
trash collection shall be screened from adjacent public rights-of-way and adjacent properties.
These areas shall be designed and used in a manner that will prevent wind or animal
scattered trash.
Section 23-3-260 addresses operation standards for Commercial uses. The applicant shall
address the issue of on-site lighting, including security lighting in applicable. Subsection B.6
states "any lighting ... shall be designed, located and operated in such a manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties...."
The applicant has not delineated any on-site sign. If an on-site sign is desired, the signs shall
adhere to Section 23-4-90.A and .B of the Weld County Code.

Subject: USR- 1416
The sheriffs office has no concerns with this Special Use Permit. The sheriff's office
would however be willing to provide a program entitled Crime Prevention Through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening"it to crime.
The Sheriff's Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.
