Staff has also reviewed your letter dated September 26, 2002. For the record, Condition of Approval 2.A states "Due to the prime agricultural soils on Lot B, the applicant shall submit a proposed building envelope to the Department of Planning Services for review. Upon approval by the Department of Planning Services, the building envelope shall be delineated on the plat." Second Corrected Recorded Exemption 2503 has delineated two building envelopes as was approved by the Board of County Commissioners. The Wilkinson letter states that Option 2, Building Envelope for Lot B, 5.00 acres gross is unacceptable due to the proximity and location of an oil and gas well head and accompanying underground piping. Option 1, a seven acre Building Envelope is also unacceptable to due current farming practices associated with the property to the east. Staff did note that a building envelope is located directly east of the envelope associated with the Recorded Exemption 2494 property, thus enabling a property owner to build a residence in this location. There is an alternate site for a building envelope associated with this property, further, it should be noted that the rationale for the building envelope is for the retention of large tracts of viable farm ground. The placement of all building envelopes is to utilize the less productive ground(s)for structures associated with the farming operation and/or a residence for the property owner. Addressing the issue of access to the property. It is stated in your letter that access to the property is from the south off of Weld County Road 66. Per the resolution from the Board of County Commissioners, referenced above, it states per item 2.D "The lots shall utilize the existing residential /agricultural access point from State Highway 392. No circle drives or additional accesses shall be granted. This road will be graded and drained to provide all weather access." There is no evidence to suggest that access may be obtained via the twenty foot easement off of Weld County Road 66. In summary, two building envelope options were delineated on the Plat as was required by the Board of County Commissioners hearing for this case. Further, the property is considered "Prime"agricultural land as is delineated on the Important Farmlands of Weld County Map dated 1979. Section 22-2-60.A.1 £oo3 -3572_ of the Comprehensive Plan, states"Preserve prime farmland for agricultural purposes which foster the economic health and continuance of agriculture." The placement of the proposed building envelope in the middle of the farming operation and property does not reinforce this goal. Given the noncompliance the Weld County Code and the directive by the Board of County Commissioners at the August 1999 hearing, the Department of Planning Services does not grant your request for a new building envelope on the above described property. On October 4, 2002, Supplemental Exhibits C, D, E, F, G, H, and I (hereafter referred to as Exhibits C through I), pertinent to our request, were delivered to and discussed with members of the Weld County Planning Services Staff. This discussion with the members of the Planning Service Staff was helpful to improving our understanding of the requirements associated with our request for a location change of the Option 2 Building Envelope on the above referenced Lot B of RE-2503. Subsequent to and based on our October 4 discussion, we have revised the configuration of the proposed replacement building envelope in an attempt to conform to what we understand to be the requirements of Weld County. This revision to our September 26 request(and October 4 supplemental submittals) is shown on the attached Exhibit J. On attached Exhibit J, a plat of RE-2503, we have sketched(in red)the revised configuration for the proposed replacement Option 2 Building Envelope. As Weld County Planning Services staff reviews our request for a building envelope location change, we request that Exhibit J "Replacement Option 2 Building Envelope" be considered along with previously submitted support documentation contained in our letter dated October 4, 2002 (Exhibits C through I). The location and configuration of the replacement Option 2 building envelope which we propose in Exhibit J satisfies Weld County's building envelope requirements as follows: • Access— The proposed replacement building envelope is adjacent(on the north)to the legal access road to RE-2503, Lot B, thereby satisfying the item 2D stipulation of the Board of County Commissioners August 9, 1999 Resolution regarding access. • Preservation of prime farmland-- The proposed replacement building envelope will preserve prime farmland. The original Option 2 building envelope is 5 acres, as compared with the 3.1 acre size of the proposed replacement Option 2 building envelope. The length of the proposed replacement envelope(712 feet) is sufficient to allow dwellings/improvements to be placed on less productive non sub-irrigated farm ground, thereby satisfying the goal as stated in your letter to us dated October 2, 2002, which states: "The placement of all building envelopes is to utilize the less productive ground(s)for structures associated with the farming operation and/or a residence for the property owner. " • Retention of large tracts of viable farm ground/Minimize impact on current and future farming practices/Weld County Comprehensive Plan-- As stated in your letter dated October 2, 2002, "the rationale for the building envelope is for the retention of large tracts of viable farm ground. " The width of the proposed replacement envelope has been reduced to 190 feet. When this field is planted in row crops, this width will accommodate seventy-two rows with 30" row spacing. Seventy-two rows is desirable as it allows the field to be worked with an even number of passes with 2-row, 3-row, 4-row, 6-row, 8-row, or 12-row farm row-crop implements. Thus this width will have minimal impact on farming/irrigation practices on the remainder of the Lot B farmland, while still allowing the remaining land south of the proposed replacement building envelope to be farmed in an efficient and effective manner and in a manner contiguous with the remainder of Lot B. Likewise, the length of the proposed replacement envelope will allow construction of improvements to be done in a manner which minimizes the impact on prime farmland while at the same time not detrimentally impacting the ability to effectively and efficiently farm the remaining portions of the Lot B prime farmland. By referring to Exhibit I (attached to our letter dated October 4, 2002), please note that the proposed replacement building envelope is contained within a smaller tract of farmland, identified on the Farm Service Agency Aerial Map as Section 1B, Tract 11294 (23.3 acres). Therefore, the largest tract of farmland within RE-2503 Lot B, identified on the Farm Service Agency Aerial Map as Section 1 C, Tract 11294 (36.7 acres)will be preserved and remain unaffected by the proposed building envelope. The length and width configuration of the Exhibit J replacement Option 2 building envelope, along with its location within Section 1B, Tract 11924, as indicated on the Farm Service Agency Aerial Map, not only satisfies the goal of retaining large tracts of viable farm ground within Lot B, but also ensures minimal impact on current and future farming practices. As owners of Lot B of RE # 0805-19-2-RE-2503, we hereby request a building envelope location revision or replacement of Option 2 Building Envelope for Lot B. On Exhibit A, we have sketched(in red)the proposed replacement building envelope for Option 2 Building Envelope for which we are requesting approval. Please note that the proposed replacement building envelope is approximately 1.84 acres in size, as opposed to 7 acres(existing Option 1 Building Envelope) or 5 acres (existing Option 2 Building Envelope). Also enclosed please find Exhibit B, a plat of adjacent properties Corrected RE# 0805-19-3-RE2494. On Exhibit B, we have highlighted the ingress/egress/utility easement for Lot B of RE#0805-19-2-RE-2503. Upon examination of the existing Option 2 Building Envelope site, we find this building envelope unsuitable as a building site due to: 1) its proximity to an existing gas well head and 2) the buried gas pipeline which extends north from the gas well head, beneath the building envelope, to the holding tanks located on the west side of Lot A of RE-2503. The gas well head is located approximately 197.85 feet east of the west property line of RE-2503 and 586.27 feet south of the northern parcel line(135.55 feet south of the southern boundary of the Option 2 Building Envelope). The buried gas pipeline originates approximately 202.35 feet east of the west property line of RE-2503, and 586.27 feet south of the northern parcel line, but then extends northward, under the building site envelope to the holding tanks. Since the gas well head is approximately 135.55 feet south of the Option 2 Building Envelope and the gas pipeline lies beneath the building envelope, we strongly assert that building a home on the existing Option 2 Building Envelope would not be a safe or prudent choice. Although the Option 1 Building Envelope site does not pose the severe safety issues that are of concern with the Option 2 site, Option 1 is not acceptable as a building site due to its adverse impact upon the irrigated farming practices utilized on the eastern section of Lot B, RE-2503. As shown on the Exhibit A plat, Lot B of RE-2503 is an L-shaped parcel of land, with the longer section of the"L' on the eastern side of Lot B. The head ditch for irrigating all of Lot B is on the northern end of the fields, near the northern end of the property. Placing a building envelope at the north east corner of Lot B would be highly disruptive to farming/irrigating practices since the eastern section of Lot B is irrigated from north to south, from the concrete head ditch on the north. When planted in row crops,the irrigation sets run the entire length of Lot B. The adjacent parcels of land adjacent parcels of land to the east and south(see Exhibit B plat)also depend on utilization of the concrete ditch along the north-eastern portion of Lot B, RE-2503, for delivery of irrigation water as well. In fact, the farming practice for the past several decades has been that the same farmer has either owned or leased Lot B of RE-2503, and the adjacent Lot B of RE-2494. Therefore, the row crops are contiguous from the RE- 2503 Lot B parcel, into the southern"L"portion of the adjacent RE-2494 Lot B parcel. We hope that the Weld County Planning and Zoning Department would agree that building a home on the Option 1 Building Envelope would not be the best choice for preserving farmland or for optimal farming practices. Considering the problems outlined above related to the existing Option I and Option 2 Building Envelopes, we hereby request that the Option 2 Building Envelope site for Lot B be changed to the proposed replacement Option 2 Building Envelope, as sketched(in red)on the Exhibit A plat. Not only is the proposed replacement building envelope a safe distance from the gas well head/buried gas pipeline, but its configuration will also be less disruptive to the farming/irrigating practice on the remainder of the RE-2503 Lot B parcel because it is narrower and because of its orientation relative to existing surface irrigation ditches. Additionally, please note that Lot B of RE-2503 has ingress/egress/utility access from Weld County Road 66, via access easements through Lots A and B of RE # 0805-19-3-RE-2494 (as highlighted on Exhibits A and B). The eastern boundary of the proposed replacement building envelope is adjacent to the west side of the north-south access, which extends from Weld County Road 66 on the south, north to the access road along the north side of RE-2503 Lot B, thereby allowing convenient access to the proposed replacement building envelope. Also, the eastern boundary of the proposed replacement building envelope is a"natural"divider for Lot B of RE-2503, due to: 1)the presence of an existing north-south irrigation ditch; 2)the presence of an underground irrigation pipeline which carries irrigation water to an adjacent property south of RE-2503 Lot B; 3)the configuration of Lot B of RE-2503; and 4)the presence of the access easement.
