Long, Chair Commissioner Robert D. Masden, Pro-Tem - EXCUSED Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Monica Mika Health Department representative, Pam Smith Public Works representative, Drew Scheltinga The following business was transacted: I hereby certify that pursuant to a notice dated February 14, 2003, and duly published February 20, 2003, in the South Weld Sun, a public hearing was conducted to consider the request of Charles and Alice Greenman for Change of Zone #1026 from the R-1 (Residential) Zone District to the PUD (Planned Unit Development) Zone District with E (Estate) and C-1 (Neighborhood Commercial) Zone Uses. Lee Morrison, Assistant County Attorney, made this a matter of record. Chair Long advised Charles and Alice Greenman, applicants, that they have the option of continuing this matter to a date when the full board will be present. However, if they decide to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Masden will listen to the record and make the determining vote. The applicants indicated they would like to proceed today. Monica Mika, Director of Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She gave a brief description of the location of the site, which is currently in violation for operating an antique business. She stated 12 referral agencies reviewed this proposal and all responded favorably, and staff has received no correspondence of opposition from the surrounding property owners. Ms. Mika explained the site currently consists of two parcels totaling 2.78 acres, and the applicants are not proposing any additional septic systems at this time. She stated the applicants have requested a waiver of the Site Plan Review requirements because they will be addressed through the Conditions of Approval for this Change of Zone. She further stated the application materials were submitted prior to approval of the Intergovernmental Agreement (IGA) with the City of Longmont, so those issues do not apply to this application. She stated the application indicates three storage units and the antique business, with the option for additional uses under the C-1 zoning. Ms. Mika stated the site will be accessed from Weld County Road 1, with one access serving the residence and the second to be used by business clients. 2003-0762 PL1650 CO : FL, //L<,_) ,P60 HEARING CERTIFICATION - CHARLES AND ALICE GREENMAN (COZ#1026) PAGE 2 Pam Smith, Department of Public Health and Environment, stated the septic system was evaluated prior to this application; however, her review was based on home use only. She stated there is no restroom in the shop, and although the customers can use the restroom in the house, the system must now be evaluated by an engineer for a commercial use. She stated this is addressed under Condition #2.A. She further stated the business uses water-based paints, which are stored on sealed containers, therefore, the applicants are not required to submit a Waste Handling Plan. Drew Scheltinga, Department of Public Works, stated staff is currently working on the preliminary design for Weld County Road 1, which serves this property. He stated there are numerous residences and accesses along this portion of the road, and the future design is still uncertain. He anticipated the road will be widened to the west, so he is not sure of the final impact to this site. Mr. Scheltinga stated the applicants have entered into an agreement which requires the relocation of signs and other obstructions in the right-of-way to accommodate the final roadway design. He further stated eventually the site will be limited to one access. In response to Commissioner Vaad, Mr. Scheltinga stated the customer parking is in the front along Weld County Road 1; however, it will eventually be relocated to the rear of the shop. In response to Commissioner Vaad, Mr. Greenman stated at the time they purchased the site, it was not residential. Ms. Mika reiterated this is a Change of Zone to the PUD (Planned Unit Development) Zone District requiring landscaping and open space; however, those requirements have been waived for this parcel. No public testimony was offered concerning this matter. In response to Chair Long, the applicants stated they have reviewed and agree with the Conditions of Approval as proposed. Commissioner Geile moved to approve the request of Charles and Alice Greenman for Change of Zone#1026 from the R-1 (Residential) Zone District to the PUD (Planned Unit Development) Zone District with E (Estate) and C-1 (Neighborhood Commercial) Zone Uses, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Vaad, and it carried unanimously.
