I am one of the Mineral Rights Owners in the above described land. I want you to know that I would like an
agreement in place prior to the development of anything on this land. I also ask that any development be

I have had an inquiry from Fred Otis, below is some suggested language
that may be beneficial to your Planning Commission relative to our PC's
recommendation of approval for the Change of Zone for Great Western RR.
Sorry about any confusion, but I was rushed Thurs to get it out and
since Clark R and Alex Y were at the PC mtg and saw and heard the
positive approval, it did not appear to be any problem. Take a look at

Subject: Change of Zone (CZ-1040) Great Western Railway
Company of Colorado, LLC
Dear Ms. Daniels-Mika:
The Town of Windsor Planning Commission reviewed this referral at its
regular meeting of May 21, 2003.
The property is located partially inside and partially outside the
Town's Growth Management Area (GMA). That portion of the subject
property that is within the GMA is delineated as Light Industrial on the
Town's Land Use Plan map, while that portion of the subject property
that is outside the GMA is delineated as Low Density Estate Single
Family Residential. Since (a)the subject property straddles the GMA
boundary, and (b)the applicant has stated that the subject property
will be annexed to Windsor in the future, I am writing at this time to
advise your department, the Weld County Planning Commission and the Weld
County Board of County Commissioners that at the May 21, 2003 Windsor
Planning Commission meeting, the Windsor Planning Commission approved an
amendment to the Town's Land Use Plan Map of the comprehensive plan to
change the land use depiction for the subject property described above
from Light Industrial and Low Density Estate Single Family Residential
to a Heavy Industrial land use depiction, which allows proposed uses
such as the Owens-Illinois Glass manufacturing facility. Likewise, the

THE DEPARTMENT OF PLANNING SERVICES= STAFF RECOMMENDS THAT THIS
REQUEST BE APPROVED FOR THE FOLLOWING REASONS:
2. D. Section 23-2-30.A.4. - Street or highway facilities providing access to the
property are adequate in size to meet the requirements of the proposed
zone districts. The Weld County Public Works Department reviewed this
request and indicated several conditions to be implemented at Site Plan
Review regarding transportation paving of the access roads and a
drainage study. Issues regarding access and right-of-way have been
addressed in the Conditions of Approval and Development Standards.

application for the Site Plan Review. The Change of Zone plat map will
