Home My WebLink About20030214.tiff RESOLUTION RE: APPROVE LICENSE AGREEMENT FOR USE OF RIGHT-OF-WAY ON WELD COUNTY ROAD 18 AND AUTHORIZE CHAIR TO SIGN - COLORADO DIVISION OF WATER RESOURCES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a License Agreement for Use of Right-of-Way on Weld County Road 18 between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and the Colorado Division of Water Resources, with terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the License Agreement for Use of Right-of-Way on Weld County Road 18 between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and the Colorado Division of Water Resources be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. NOW, THEREFORE, in consideration of the covenants and conditions herein stated, County does grant to Licensee, their successors and assigns, a license to construct, install, lay, maintain, alter, repair, operate,and remove a building or structure,pipes and concrete block foundation in WCR 18 Right of Way,in accordance with the following conditions: 1. Licensee shall acquire a permit from County prior to the beginning of and construction. 2. Licensee shall construct, install, lay, maintain, alter, repair, operate and/or remove the building or structure,pipes and concrete block foundation at it's own expense and without the aid or use of Weld County funds. 3. Licensee is prohibited from constructing, installing, laying, maintaining, altering, repairing, and/or removing the building or structure,pipes and concrete block foundation in any manner,which shall damage the traveled portion of WCR 18. 4. After Licensee has completed construction and installation of the building or structure, pipes and concrete block foundation, it shall remove any and all construction materials and debris associated with said construction and installation from the right-of-way. 5. Licensee shall have sole responsibility to maintain,keep weed free,remove debris, and to repair the same when reasonably necessary. Any such maintenance, cleaning, or repair shall be performed with due diligence after notification of the need thereof. 6. County retains the right to revoke this License Agreement at any time and for any reason. County shall give Licensee written notice of its intent to revoke this license at least ninety(90) days prior to the date of revocation. Such notice shall be sent to Licensee by certified mail to their addresses written above or served upon Licensee in accordance with the Colorado Rules of Civil Procedure. Licensee acknowledge and assure County that the placement of the building or structure,pipes and concrete block foundation within the right-of-way of WCR 18 shall not in any way alter or impair the rights of third parties, if any,to the use or enjoyment of the roadway ditch. 8. Licensee hereby release County, its officers and employees, from any and all claims for damages suffered by Licensee arising out of any damage to the building or structure, pipes and concrete block foundation caused by the actions of County employees while maintaining the right-of-way of WCR 18 for the safe use thereof by the public, or caused by the actions of any third party. The Colorado Division of Water Resources is proposing to construct a prefabricated concrete building near Weld County Bridge 18/25A, which crosses the South Platte River. The building will be constructed on the northeast corner of the bridge behind the guardrail and will house a stream gauging station required to monitor the flows within the South Platte River. The License Agreement will give the Division permission to install and maintain the gauging station within County ROW.
