RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 75 - JAMES
DAVIS.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners previously ap-
proved Recorded Exemption No. 75 for James Davis concerning pro-
perty located in the West Half of Section 34 , Township 7 North,
Range 65 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS, James Davis has requested that Recorded Exemption
No. 75 be amended by re-dividing the property so that Lot A
contains 17 . 280 acres and Lot B contains 81 . 633 acres . The
legal description is as follows :
A parcel of land located in the W1 of Sec-
tion 34 , Township 7 North, Range 65 West
of the 6th P.M. , Weld County, Colorado
being more particularly described as

of said Section 34 and considering the

WHEREAS, the Board of County Commissioners has studied the
request to amend Recorded Exemption No. 75 and deems it advisable
to approve said amendment.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that amendment to Recorded
Exemption No. 75 as stated herein be, and hereby is , approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 22nd day of
October, A.D. , 1980 .

RE: Amendment to Recorded Exemption #75
Dear Commissioners:
The attached application, plat, and related items are in reference to a request fran
James Davis for a amendment to Recorded Exemption #75. The parcel of land on which
this request has been made is described as W2 Section 34, T7N, R65W of the 6th p.m. ,
Weld County, Colorado. This property is located 2 miles east and n mile north of
Eaton.
The request is to amend Recorded Exemption #75 by re-dividing the property such that
Lot A contains 17.280 acres and Lot B contains 81.633 acres. Both lots have a
residence located on than.
Based upon the information submitted, the Department of Planning Services Staff
reccr ends approval of this requested amendment for the following reasons:
1. The impact on surrounding agricultural land uses would not appear to be
any different than the original request which has already been approved.
The Town of Eaton has set forth no objections to this request.
2. This request is in canpliance with Section 9-4A of the Weld County Subdivision
Regulations.

Dear Sirs;
I am requesting an ammended Recorded Exemption on part of the
Northwest Quarter (NW ) Section 34, Township 7 North, Range 65 West of
the 6th P.M. , Weld County, Colorado. The property was split in
1973. Since then I have built a large home and would like to have
this new home on the 17.280 acre parcel. The other home will be
on the 31 acre and 50 acre parcel, which together would make a nice
81.633 acre farm.
I presently own one-half of the Clark farm which is North of
Eaton, and I would like to buy out Dick Woods one—half interest in
this farm. Since interest rates are too high to borrow money to
make this purchase feasible at this time, I would like to sell
the 17.280 parcel with the new home.

There are no engineering problems anticipated by this
request except the possibility of the southeast portion
of Lot B becoming land locked. The lay of the land in
this area makes it appear as though ingress and egress
to the southeast portion of Lot B could be difficult.
