The construction of structures over property lines is allowable under the Weld County Code, however the construction of structures over known and documented easements is not allowable. As previously stated in letters from this office dated April 3, 2000, Anderson to Taylor; October 22, 2002, Ogle to Taylor; April 7, 2003, Ogle to Taylor and April 11, 2003, Ogle to Taylor, should construction of any structure, including the proposed hangar(s) occur over any easement, a Final Plat of the PUD will be required prior to the release of any building permit. Avenue • I Greeley; CO 8031 , Dear Mr. Ogle: • thank you for taking the time to talk with me once More regarding Block 2,Platte Valley ' Aitpark PUD, S-409. At your suggestion,tam writing to again ask for an exemption • from the requirerhent to re-plat the airpark to accommodate the two corporate hangars on Block 2, for the following reasons_ . ' 1). The 10 that public utility easement accessing Block 2 from the North would not be affected. . 2) The interior utility easement would be utilized by one individual owner for electricity,telephone and eventually water for tiro large hangat units. All'of these utilities would still access the hangar from the North by way of the public,easement, and would be the responsibility of the owner to continue the ' installation within the hangar block. 3) The basic electricity for Block 2, originally installed by United Power, is in :place at the north end of the block in the public easement, designated as the , • meter bank location. I talked with Rich Gonzalez at United Power'today,.and • he advised me that they have no Obligation past this location and no concern 'as to the location of the internal easement. 4) In the letter dated April 3,2000,wewere given approval to build one large or two to four small hangars. As one large building would have covered the '' ' entire block, including the interior easement. I interpreted this to mean that the easement could be alteied to accommodate the hangar building or buildings. , This interpretation was the basis of our marketing efforts to sell this block and • complete the PUD project. • 7507 WCR 39 O Ft. The crosswind runway to the South and the approach pattern to the West, prohibit any future development in either of these directions from the existing PUD. Therefore,the South end of the existing internal easement would have been the final stop for all utilities in this Southwest area. 6) We fully intend to do a Re-Subdivision at some future date to accommodate additional development on the west side of the airport. However, at the present time, we are overwhelmed with other activities and issues t the airport and to do an amendment to the PUD in a timely manner would be almost impossible. Hopefully, due to the fact that this easement issue involves one individual property owner, and the utility entities will not be affected by the location of the easement,you will be able to convince the Department of Planning Services to grant us an exemption to the re-platting requirement. Finally, it is my understanding that the proposed hangar construction, over the lot lines, for Roy Murray,is acceptable as his building will not affect the interior easement on Block 3. The Department of Planning Services reviewed the proposal to sell six lots of Block two to a single corporation for the purposes of constructing two new hangers owned wholly in part by a single corporation and the proposal to sell two adjoining lots of Block 3 to a single entity for the purposes of construction a single hanger. The sale of said lot(s) is beyond the review of this office, however, the construction of the proposed hanger(s)over the utility easements will require an application through the County. Given this proposed action the Department of Planning Services will require a Re-Subdivision application and re-platting of the PUD. In as much as you will be the sole owner of Lot 4 and Lot 5,Block 3,with both of the lots titled to Roy W.and Jody Murray,we have approved your request to build over the lot lines to accommodate a single hangar unit,similarly titled to Roy W. and Jody Murray,as follows: I) Hangar size will be 60 feet wide by 40 feet deep. 2) There will be a 20 foot easement between Lot 2 and Lot 4 and between Lot 6 and Lot 8,to comply with the Weld County Fire Code.
