RESOLUTION
RE: APPROVE PARTIAL VACATION OF SPECIAL USE PERMIT#344 - PAT CANTRELL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated January 18, 1978, the Board approved Special Use
Permit#344 for a Dairy Operation in the A (Agricultural) Zone District for Pat Cantrell, Route 1,
Box 66A, Gill, Colorado 80624, on the following described real estate, to-wit:
Part of the S1/2 of Section 22, Township 4 North,
Range 64 West of the 6th P.M., Weld County,
Colorado
WHEREAS, pursuant to Condition of Approval #1.B.2, and in accordance with
Sections 23-2-200.G and 23-2-260.D, the Board has received a request from Cordell and
Crystal Dye, 20400 Weld County Road 55, Kersey, Colorado 80644, current owners, for the
partial vacation said Special Use Permit#344, as well as a revised map illustrating the vacated
portion of the property and the existing permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said partial vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Special Use Permit#344 be, and hereby is, partially vacated as
indicated on the revised map.

The Department of Planning Services is requesting that a portion of SUP-344 be amended to
be consistent with the boundaries as proposed in USR-1400. The request is forwarded to the
Board of County Commissioners as a condition of approval.
Background Information:
Legal Description: Lot A of RE-1209; pt. SW4 of Section 22, T4N, R64W of the 6th P.M. Weld
County, CO. Parcel Number: 1053-22-000015
Location: 20400 WCR 55, Kersey, CO 80644
USR-1400: USR-1400 was applied for by Cordell and Crystal Dye for a dog kennel not
to exceed 150 dogs.
SUP-344: Applied for by Cantrell Dairy and is a permit for 500 head, located on the
same parcel as USR 1400.
