RE: APPROVE REVISIONS TO OPERATIONS MANUAL, SECTION 2.000, SOCIAL
SERVICES DIVISION POLICIES AND PROCEDURES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Department of Social Services has presented revisions to the
Operations Manual, Section 2.000, Social Services Division Policies and Procedures, to the
Board of County Commissioners of Weld County, for consideration and approval, and
WHEREAS, after review, the Board deems it advisable to approve said revisions, copies
of which are attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, ex-officio Board of Social Services, that the revisions to the Operations
Manual, Section 2.000, Social Services Division Policies and Procedures be, and hereby are,
approved.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 12th day of February, A.D., 2003.

RE: Revision to Section 2.000, Social Services Division Policies and
Procedures, Weld County Department of Social Services
Operations Manual
Enclosed for Board approval is a revision to Section 2.000, Social Services Division
Policies and Procedures, Weld County Department of Social Services Operations
Manual. This revision was reviewed at the Board's Budget Work Session held on
February 10, 2003.
The revision is to add policies and procedures Change of Venue for Dependency &
Neglect Cases from one judicial district to another judicial district. These policies will
document existing practice and will be shared with other county departments of social
services and the Court. Add Section 2.618, Change of Venue.

2.618 Change of Venue

The Department accepts and sends Change of Venue cases according to Colorado
Statutes, C.R.S. § 19-3-20, and Colorado Department of Human Services, Volume
7 rules, Section 7.304.4.
2.618.1 Accepting Cases from Other Counties
Added 2/03
A. When the Court receives a case from another judicial district, a complete
copy of the case file is sent to the paralegals and a review date is set. The
paralegals will review the file to verify that all respondents have entered an
admission or a default. A default must have been entered against them and
that a decree has been entered with respect to all children. If these criteria
have not been met, the Assistant County Attorney will be notified so that
an objection to the Court's acceptance of jurisdiction may be filed
immediately.
B. The Department's Change-of-Venue Coordinator should have received
notice from the other county's Coordinator prior to the transfer. Once that
notice is received or once the paralegals notify the Coordinator the case is
in Weld County, the Coordinator should assess the case under the criteria
set forth in Volume 7, Section 7.304.4(E). If the case is not appropriate
for a change of venue, the Assistant County Attorney should be notified so
that an objection can be filed with the Court.
C. If a case meets the criteria of the statute and Volume 7, the case will be
accepted. A Family Services Plan (FSP) letter is due at the initial hearing.
2.618.2 Sending Cases to Other Counties
A. The Department's Change of Venue Coordinator will be contacted by the
caseworker whenever a case is appropriate for change of venue. All
respondents must have entered admissions or there must be a default
against them and there must be a decree with respect to all children. The
Coordinator will review the case, and if the coordinator agrees the case is
appropriate under Volume 7 rules, the Coordinator will make the required
contacts with the receiving county. The request for Change of Venue will
be made in the next court letter and the request will be made at that
hearing after all appropriate action has been taken.

B. When the Court unexpectedly changes venue to another county, the
caseworker will notify the Coordinator immediately so that the transfer can
be expedited.
