RE: APPROVE RESUBDIVISION, RS #1046, FOR LOT LINE ADJUSTMENT ONLY -
DAVID AND DONNA STROHANER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 15th day of
September, 2003, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of
hearing the application of David and Donna Strohaner, 33655 Weld County Road 61.5, Gill,
Colorado 80624, for Resubdivision, RS #1046, for Lot Line Adjustment only, on the following
described real estate, to-wit:
Lots 13, 14, 15, 16, 60 and 64 of the unincorporated
Town of Barnesville, being located in part of the
E1/2 NW 1/4 of Section 18, Township 6 North,
Range 63 West of the 6th P.M., Weld County,
Colorado
WHEREAS, David Strohaner, applicant, was present, and
WHEREAS, Section 24-5-30 of the Weld County Code provides standards for review of
said Minor Subdivision Final Plat, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Planning Commission and all of the exhibits and evidence presented in this
matter and, having been fully informed, finds that this request shall be approved for the following
reasons:
1. The submitted materials are in compliance with the application requirements of
Section 24-5-30.6 of the Weld County Code.
2. It is the opinion of the Board of County Commissioners that the applicant has
shown compliance with Section 24-5-30.C of the Weld County Code, including
specifically:
a. Section 24-5-30.C.4 -- That the lot line revision complies with the
approved recorded final plat. The result of the lot line revision is two 12.5
acre lots by moving the property line between lots 13 and 14 east
approximately 108 feet. Lot 14 will incorporate the abandoned railroad and
lot 64. The south lot lines of lots 13, 14, and 64 will move north
approximately 350 feet. This lot line adjustment will increase the size of

lot 15 from 12.42 acres to 16.22 acres, lot 16 will increase from 11.44
acres to 15.17 acres and lot 60 will increase from 2.86 acres to 3.45
acres.
b. Section 24-4-30.C.4 -- Compliance with the adopted rules, regulations and
ordinances currently in force and affecting the subdivision. There is one
existing utility (Qwest) within the 25-foot utility easement. The applicants
have received permission from Qwest to adjust the lot line. The existing
25-foot utility easement will remain in place and is in compliance with the
minimum utility easement standard of twenty (20) feet as required in
Section 24-7-60.A of the Weld County Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of David and Donna Strohaner for a Resubdivision
for Lot Line Adjustment Only, RS #1046, on the hereinabove described parcel of land be, and
hereby is, granted subject to the following conditions:
1. Prior to Recording Resubdivision Plat:
A. The plat shall be labeled RS-1046 Resubdivision of the Town of
Barnesville
B. Weld County Roads 70 and 61.5 are designated on the Road Capital
Improvement Plan Map as local gravel roads, which require 60 feet of
right-of-way at full build out. There is presently 60 feet of right-of-way. A
total of 30 feet from the centerline of Weld County Roads 70 and 61.5
shall be delineated right-of-way on the plat. These roads are maintained
by Weld County.
C. All approved accesses shall be clearly shown on the plat. The applicant
shall contact the Weld County Department of Public Works to determine if
a culvert is necessary at any approved road access point. If a drainage
culvert is required, a 15-inch Corrugated Metal Pipe (CMP) is Weld
County's minimum size. If the applicant chooses to place a larger culvert
please contact the Weld County Department of Public Works to
adequately size the culvert.
D. In accordance with Chapter 8, Article II of the Weld County Code, each lot
shall be granted one residential/agricultural access. Direct access from a
public road shall be limited to one access per legal parcel for residential
use, no circle drives or additional accesses shall be granted. The road
shall be graded and drained to provide all weather access. Accesses
shall be placed in such a location as to have adequate sight distance in
both directions, shall not be placed below the crest of a hill or where
physical obstructions are present and shall be a minimum distance of 75
feet from any intersecting County or State roadway.

E. All septic systems must be on the appropriate lot. Prior to recording the
plat the Weld County Department of Public Health and Environment
recommends that the applicant review the Weld County Code pertaining
to septic systems to assure that any installed septic system will comply
with all setback requirements found in the Code.
F. The plat shall be amended to include a minimum ten (10) foot utility
easement on the side and rear lot lines and a minimum of fifteen (15) feet
allocated along front lot lines.
G. The following notes shall be placed on the plat:
1) Should noxious weeds exist on the property or become
established as a result of the proposed development the
applicant/landowner shall be responsible for controlling the noxious
weeds, pursuant to Chapter 15, Articles I and II of the Weld County
Code.
2. The applicant shall submit two (2) paper copies of the plat for preliminary
approval to the Weld County Department of Planning Services.
3. The applicant shall submit a digital file of all drawings associated with the
Resubdivision application. Acceptable CAD formats are .dwg, .dxf, and .dgn
(Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo
Coverages and Arclnfo Export files format type is .e00. The preferred format for
Images is .tif (Group 4). (Group 6 is not acceptable). (Department of Planning
Services)
4. Upon completion of Section 1, above, the applicant shall submit a Mylar plat along
with all other documentation required as Conditions of Approval. The Mylar plat
shall be recorded in the office of the Weld County Clerk and Recorder by
Department of Planning Services' Staff. The plat shall be prepared in accordance
with the requirements of Section 24-4-40.D.6 through D.9 of the Weld County
Code. The Mylar plat and additional requirements shall be submitted within sixty
(60) days from the date of the Board of County Commissioners resolution. The
applicant shall be responsible for paying the recording fee.

THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS THAT THIS REQUEST
BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 24-
5-30.B of the Weld County Code.
2. It is the opinion of the Department of Planning Services' Staff that the application has
shown compliance with Section 24-4-30.C of the Weld County Code, as follows:
a. Section 24-5-30.C.4 -- That the lot line revision complies with the approved
recorded final plat. The lot line revision is to create two 12.5 acre lots by moving the
property line between lots 13 and 14 east approximately 108 feet. Lot 14 will
incorporate the abandoned railroad and lot 64. The south lot lines of lots 13, 14,
and 64 will move north approximately 350 feet. This lot line adjustment will increase
the size of lot 15 from 12.42 acres to 16.22 acres, lot 16 will increase from 11.44
acres to 15.17 acres and lot 60 will increase from 2.86 acres to 3.45 acres.
b. Section 24-4-30.C.4 -- Compliance with the adopted rules, regulations and
ordinances currently in force and affecting the subdivision. There is one existing
utility (Qwest) within the 25-foot utility easement. The applicants have received
permission from Qwest to adjust the lot line. The existing 25-foot utility easement

will remain in place and is in compliance with the minimum utility easement standard
of twenty (20) feet as required in Section 24-7-60.A of the Weld County Code.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant,other relevant information regarding the request, and responses from referral agencies.
The Department of Planning Services' Staff recommendation for approval is conditional upon the
following:
1. Prior to Recording Resubdivision Plat:
A. The plat shall be labeled RS-1046 Resubdivision of the Town of Barnsville
B. County Roads 70 and 61.5 are designated on the Road Capital Improvement Plan
Map as local gravel roads, which require 60 feet of right-of-way at full build out.
There is presently 60 feet of right-of-way. A total of 30 feet from the centerline of
County Roads 70 and 61.5 shall be delineated right-of-way on the plat.These roads
are maintained by Weld County.
C. All approved accesses shall be clearly shown on the plat. The applicant shall
contact the Weld County Department of Public Works to determine if a culvert is
necessary at any approved road access point. If a drainage culvert is required,a 15
inch Corrugated Metal Pipe (CMP) is Weld County's minimum size. If the applicant
chooses to place a larger culvert please contact the Weld County Department of
Public Works to adequately size the culvert.
D. In accordance with Chapter 8, Article II of the Weld County Code, each lot shall be
granted one residential/agricultural access. Direct access from a public road shall
be limited to one access per legal parcel for residential use, no circle drives or
additional accesses shall be granted. The road shall be graded and drained to
provide all weather access. Accesses shall be placed in such a location as to have
adequate sight distance in both directions, shall not be placed below the crest of a
hill or where physical obstructions are present and shall be a minimum distance of
75 feet from any intersecting County or State roadway.
E. All septic systems must be on the appropriate lot. Prior to recording the plat the
Weld County Department of Public Health and Environment recommends that the
applicant review the Weld County Code pertaining to septic systems to assure that
any installed septic system will comply with all setback requirements found in the
Code.
F. The plat shall be amended to include a minimum ten (10) foot utility easement on
the side and rear lot lines and a minimum of fifteen (15) feet allocated along front
lot lines.
G. The following notes shall be placed on the plat:
1. Should noxious weeds exist on the property or become established as a
result of the proposed development the applicant/landowner shall be

responsible for controlling the noxious weeds, pursuant to Chapter 15,
Articles I and II of the Weld County Code.
2. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the
Weld County Department of Planning Services.
3. The applicant shall submit an digital file of all drawings associated with the Resubdivision
application. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles,Arclnfo Coverages and Arclnfo Export files format type
is .e00. The preferred format for Images is .tif (Group 4). (Group 6 is not acceptable).

4. Upon completion of item 1 the applicant shall submit a Mylar plat along with all other
documentation required as Conditions of Approval. The Mylar plat shall be recorded in the
office of the Weld County Clerk and Recorder by Department of Planning Services' Staff.
The plat shall be prepared in accordance with the requirements of Section 24-4-40.D.6
through D.9 of the Weld County Code. The Mylar plat and additional requirements shall be
submitted within sixty (60) days from the date of the Board of County Commissioners
resolution. The applicant shall be responsible for paying the recording fee.

The Weld County Public Works Department has reviewed this proposal. Our comments and requirements are
as follows:
COMMENTS:
WCR 70 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code
Ordinance, Section 20-1-30, as a local gravel road, which requires a 60-foot right-of-way at full build out.
There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition
of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is
measured from the future right-of-way line.

REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present.
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size
your culvert.
Direct access from a public road shall be limited; only one access is allowed per legal residential parcel. No
circle drives will be allowed. In accordance with Chapter 8, Article II of the Weld County Code, this policy shall
apply to all new and existing accesses within the unincorporated areas of Weld County. Properties within
municipalities or other counties that access Weld County roads are also subject to this policy.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.
